HomeMy WebLinkAbout74-093RESOLUTION NO. 74-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROVING MAP AND DECLARING INTENTION TO ABANDON PORTIONS OF LINCOLN AVENUE AND FRUIT STREET WHEREAS, the Department of Public Works and the Planning Commission have recommended a public hearing be set on the question of said abandonment, a request for the abandonment of portions of Lincoln Avenue and Fruit Streets. WHEREAS, the Department of Public Works Las deemed it essential to the health, safety and welfare that an ease- ment be retained over said right of way for the City of Santa Aha for utility purposes. NOW, THEREFORE, BE IT RESOLVED that the City of Santa Ana hereby approves the map attached hereto and orders the same filed with the original of this resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries for said right of way proposed to be abandoned. The City Council declares its intention to proceed under the provisions of the Street Vacation Act of 194~ (~S8300-8374 of the California Streets and Highways Code) to abandon those portions of Lincoln Avenue and Fruit Streets in the City of Santa Ana, County of Orange, State of California, described as follows: Parcel 1 The west half of Lincoln Avenue, (formerly Lincoln Street) 50.00 feet wide, in the Hawkins Addition, in the City of Santa Ana, County of Orange, State of California, as shown on the Map recorded in Book 13, Page 26 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, California, bounded northerly by a line 52.00 feet southeasterly of and parallel with a line described as having a bearing and dis- tance of south 64° 18' 10" west 1421.66 feet in a deed to the City of Santa Ana recorded December 17, 1968, in Book 8818 page 197 of Official Records and bounded southerly by the easterly prolongation of the southerly line of lot 17 of Block "E" of said Hawkins Addition. Parcel 2 That portion of Fruit Street in the Hawkins Addition, in the City of Santa Ana, County of Orange, State of California, included within the description of said Hawkins Addi- tion, as per Map recorded in Book 13 Page 26 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, Calif- ornia; bounded northerly by the southerly line of Lot 17 Block "E" of said Hawkins Addition RESOLUTION NO. 74-93 PAGE TWO and its westerly and easterly prolongation; bounded westerly by the southerly prolonga- tion of the easterly line of lot 18 of Block "E" of said Hawkins Addition; bounded easterly by the southerly prolongation of the center- line of Lincoln Avenue, (formerly Lincoln Street) 50.00 feet wide, as shown on said map, and bounded southerly by the southerly line of said description, being also a line para- llel with and southerly 20.00 feet from the southerly line of said lot 17. Parcel 3 A strip of land 30.00 feet wide in the "Santa Ana East" addition in the City of Santa Ana, County of Orange, State of California, as shown on the Map recorded in Book 10 Pages 43 and 44 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, Calif- ornia; bounded northerly by the northerly line of lots 39 and 44 of said "Santa Ana East" addi- tion and its westerly and easterly prolongation; bounded southerly by a line 30.00 feet southerly from and parallel to the northerly lot lines of lot 39 and 44 of said "Santa Ana East" addition; bounded easterly by the southerly prolongation of the centerline of Lincoln Avenue, (formerly Lincoln Street) 50.00 feet wide, in the City of Santa Ana, County of Orange, State of California, as shown on the Map recorded in Book 13 Page 26 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, California, known as the Hawkins Addition; bounded westerly by the southerly prolongation of the easterly line of lot 18 of Block "E" of said Hawkins Addition. BE IT FURTHER RESOLVED that the public convenience and necessity require the reservation of an exclusive permanent easement over said portions of Lincoln Avenue and Fruit Street by the City of Santa Ana for utility purposes. BE IT FURTHER RESOLVED that these proceedings are taken subject to said utility easements rights retained by the City of Santa Ana. BE IT FURTHER RESOLVED that July 15, 1974, at the hour of 7:30 p.m. in the Council Chambers, 22 Civic Center Plaza, Santa Ana, California, is hereby fixed as the hour and the place for hearing all persons interested in or objecting to said proposed street abandonment. PAGE THREE 74-93 BE IT FURTHER RESOLVED that the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this reso- lution one time in The Register, and the Director of Public Works is ordered to post notices of street vacation conspic- uously along the'line of said street, stating the passage of this resolution of intention to vacate, and the time and place of hearing thereon. Said notices shall be posted not more than 300' apart and at least three (3) such notices shall be posted. Both publication and posting shall be completed at least ten (10) days before the date of the hearing.
