HomeMy WebLinkAbout74-101Recorded July 16, 1974 1Z:00 Pm 3Z rain past Bk 11197 Pg 283 RESOLUTION NO. 74-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ORDERING THE VACATION OF PORTIONS OF LINCOLN AVENUE AND FRUIT STREET WHEREAS, on recommendation of the Department of Public Works and the Planning Commission of the City of Santa Ana, Resolution No. 74-93 was adopted giving notice of intention to vacate portions of Lincoln Avenue and Fruit Street; and WHEREAS, Resolution No. 74-93 was published and notice of intention to vacate was posted as required by law; and WHEREAS, on July 15, 1974, a public hearing was duly held on said vacation; and WHEREAS, the Department of Public Works has deemed it essential to the health, safety, and welfare that an easement be retained over said right of way for the City of Santa Aha for utility purposes. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Santa Ana hereby finds that the above_mentioned street is unnecessary for present or prospective street purposes and does hereby make its order abandoning and vacating for street purposes that certain right of way located in the City of Santa Ana, County of Orange, State of California, described as follows: Parcel 1 The west half of Lincoln Avenue, (formerly Lincoln Street) 50.00 feet wide, in the Hawkins Addition, in the City of Santa Ana, County of Orange, State of California, as shown on the Map recorded in Book 13, Page 26 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, California, bounded northerly by a line 52.00 feet southeasterly of and parallel with a line described as having a bearing and dis- tance of south 64° 18' 10" west 1421.66 feet in a deed to the City of Santa Ana recorded December 17, 1968, in Book 8818 page 197 of Official Records and bounded southerly by the easterly prolongation of the southerly line of lot 17 of Block "E" of said Hawkins Addition. Parcel 2 That portion of Fruit Street in the Hawkins Addition, in the City of Santa Ana, County of Orange, State of California, included within the description of said Hawkins Addi- tion, as per Map recorded in Book 13 Page 26 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, Calif- ornia; bounded northerly by the southerly line of Lot 17 Block "E" of said Hawkins Addition RESOLUTION NO. 74-101 PAGE TWO and its westerly and easterly prolongation; bounded westerly by the southerly prolonga- tion of the easterly line of lot 18 of Block "E" of said Hawkins Addition; bounded easterly by the southerly prolongation of the center- line of Lincoln Avenue, (formerly Lincoln Street) 50.00 feet wide, as shown on said map, and bounded southerly by the southerly line of said description, being also a line para- llel with and southerly 20.00 feet from the southerly line of said lot 17. Parcel 3 A strip of land 30.00 feet wide in the "Santa Ana East" addition in the City of Santa Ana, County of Orange, State of California, as shown on the Map recorded in Book 10 Pages 43 and 44 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, Calif- ornia; bounded northerly by the northerly line of lots 39 and 44 of said "Santa Ana East" addi- tion and its westerly and easterly prolongation; bounded southerly by a line 30.00 feet southerly from and parallel to the northerly lot lines of lot 39 and 44 of said "Santa Ana East" addition; bounded easterly by the southerly prolongation of the centerline of Lincoln Avenue, (formerly Lincoln Street) 50.00 feet wide, in the City of Santa Ana, County of Orange, State of California, as shown on the Map recorded in Book 13 Page 26 of Miscellaneous Records in the office of the County Recorder of Los Angeles County, California, known as the Hawkins Addition; bounded westerly by the southerly prolongation of the easterly line of lot 18 of Block "E" of said Hawkins Addition. BE IT FURTHER RESOLVED that the public convenience and necessity require the reservation of an exclusive permanent easement over said portions of Lincoln Avenue and Fruit Street by the City of Santa Ana for utility purposes. BE IT FURTHER RESOLVED that these proceedings are taken subject to said utility easements rights retained by the City of Santa Ana. PASSED AND ADOPTED by the City Council of the City of Santa Ana at its regular meeting held on the 15th day of Ju~ , 1974.
