Home My WebLink About74-1213/88 EXHIBIT A NOT WITH RESOLUTION AT TIME OF PREPARATION FOR MICROFILMING' RESOLUTION NO. 74-121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA GRANTING TO THE ATCHISON, TOPEKA & SANTA FE RAILWAY COMPANY, A CORPORATION, ITS SUCCESSORS AND ASSIGNS, A PERMIT TO CONSTRUCT, MAINTAIN AND OPERATE LEAD TRACKS ACROSS EDINGER AVENUE, WEST OF RITCHEY STREET IN THE CITY OF SANTA ANA WHEREAS, The Atchison, Topeka & Santa Fe Railway Company, a corporation, has applied for a permit to construct, maintain and operate its standard gauge lead tracks across Edinger Avenue, west of Ritchey Street, in the City of Santa Ana, the centerline of which is described on the attached description marked Exhibit "A" and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED as follows: SECTION 1. A permit is hereby granted to the Atchison, Topeka & Santa Fe Railway Company, a corporation, its successors and assigns, to construct, maintain and operate standard gaugue lead tracks across Edinger Avenue west of Ritchey Street, as more particularly described in Exhibit "A" attached hereto and incorporated herein. SECTION 2. This permit is specifically made subject to, and conditioned upon, the approval of the City Engineer as to the agreed upon detailed plans and specifications relating to said crossing. SECTION 3. The Atchison, Topeka & Santa Fe Railway Company shall pay all costs for improving said grade crossing including any crossing protection as may be ordered by the State of California Public Utilities Commission, either now or in the future.
