HomeMy WebLinkAbout74-179RESOLUTION 7~4-179 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND GRANTING VARIANCENO. 74-30 FILED BY CALVARY EVANGELICAL LUTHERAN CHURCH. BE IT RESOLVED: That based upon the Findings of Fact of the Planning Commission, and the evidence presented at a public hearing held November 18, 1974, the City Council of the City of Santa Ana does hereby grant Variance No. 74-30 filed by Clavary Evangelical Lutheran Church, northwest cor- ner of Euclid and McFadden Streets, Santa Ana, California, to construct a private tennis club in the R 1 zone, and to allow an on-sale liquor license within 300' of property zoned and used for residential, subject to the following conditions: 1. That development be according to the approved plot plan, except for minor modifications approved by the Planning Department. 2. That all conditions of the Building Department be met. 3. That a landscape plan be submitted to and approved by the Planning Department, including the provisions of Sec. 41- 618 of the Zoning Ordinance (prior to issuance of a building permit) and that said landscaping be implemented (prior to utility release) and be continuously maintained. 4. That any trash areas be enclosed in accordance with the Planning Department standards. 5. That there be no after-hours operation (between 2:00 A.M. and 6:00 A.M.). 6. That the business remain a bona fide eating establish- ment as defined by the Alcoholic Beverage Control. 7. That there be no gaming devices, such as pool tables, pinball machines, motion picture booths, etc. 8. That interior lighting of the establishment be in ac- cordance with A.B.C. regulations. 9. That there be no conduct or entertainment allowed on the premises as prohibited by Ordinance NS-1047. 10. That a screening plan for mechanical equipment or ap- purtenances be submitted to and approved by the Planning Depart- ment. 11. That all conditions of the Fire Department be met. Prior to the Issuance of a Building Permit applicant must: 1. Submit to the Department of Public Works, for their approval, an acceptable final grading plan or an on-site drain- age plan, or both, showing the direction and means of flow to the adjacent street(s) or channel(s) when this property is de- veloped. Plan is to include existing and proposed elevations at the property lines. Applicants should check with the Depart- ment of Public Works for extent of study needs. RESOLUTION NO. 74-179 Page 2 2. Dedicate required street or alley right-of-way. 3. Provide construction plans for required street improvement. 4. Pay drainage assessment fee. 5. Pay water service connection charges. 6. Pay street lighting deposit for future street lights. 7. Pay street tree charges. 8. Construct necessary street improvements: a. paving b. curb and gutter c. sidewalk d. driveway e. tree wells 9. Ail public improvement construction shall be subject to inspection and approval by the Department of Public Works. 14. Ail elevations shall be referenced to the 1958 Orange County Survey Datum. 15. Required property dedications shall be initiated by the owner, through the Department of Public Works, at least four weeks prior to application for a building permit, or use as ap- plicable, to avoid delay. The following requirements must also be met: 1. Ail alcoholic beverages shall be sold and consumed within the clubhouse building. 2. Ail lights on courts shall be located in such a manner as not to reflect on adjacent residential property. 3. Court fence shall be not higher than 10' in height within 20' of Euclid Street. 4. Elevations of building shall meet with the approval of the Planning Department. 5. Play area to be expanded. Recreation building shall be moved or relocated in a northerly direction a sufficient distance to provide adequate turning radius for driveway. 7.~ Ail signs shall be subject to the approval of the Planning Department as to size, location and design. 8. Parking area to meet Ordinance requirements. 9. A 42" high decorative wall shall be constructed behind the planter area adjacent to the parking area on McFadden Ave. 10. Service station shall meet with Ordinance requirements pertaining to signs, outdoor display and landscaping prior to issuance of building permits for tennis club. 11. Church site shall meet Ordinance requirement as to required offstreet parking prior to the issuance of building permits for the tennis club. The following requirements are also to be complied with prior to the issuance of a Building Permit or use: 1. Submit a parcel map to the City and comply with all applicable Council approved conditions. 2. Applicant shall make a formal request to abandon the existing dedicated, but not improved, alley.
