Dahl None Each member of the City Council having received copies of the Minutes of November 19, 1956, reading of the Minutes was dispensed with and approved on motion of Councilman Heinly, seconded by Jerome and carried. Hee~ring "S. E. Southern Pacific a~d Delhi A~nex" Ord~ n~nce This being the date set for hearing protests on annexation to the City of certain unin- habited territory designated "S.E. Southern Pacific and Delhi Annex", and there being no protests, on motion of Councilman Heinly, seconded by Jerome and carried, the following Ordinance entitled: "Ordinance declaring the annexation of that certain territory designated 'S.E. Southern Pacific and Delhi Annex'" Hearing Amendment Plan. Com. Ordinance e was introduced, considered and placed on file for second reading. . This being the date set for hearing on the amendment initiated by the Planning Commission for the reclassification of property on the east side of Sycamore Street and the west sid of Cypress Avenue from Walnut Street to Delhi Road, from R-2 and R-3 Districts to P-PK District and modify the existing C-1 and C-2 Districts in said area, by the addition thereto of PK$ protests were voiced by L. R. Snyder, 2112 S. Sycamore Street and Mrs. W.T Daiker, 2028 So Sycamore Street, against the reclassification of the whole area but had to no objection/the modification. On motion of Councilman Jerome, seconded by Markel-and carried, the recommendation of the Commission was approved to modify the existing C-1 and C-2 Districts in said area by the addition of PK and the following Ordinance entitled: Hearing Amendment Lemon Heights Investment Corp. "Ordinance amending Article IX of the santa Ana Municipal Code creating changes in district boundaries, and amending Sheets Nos. 4, 30, 31 and 42 of the Districting Map to show the reclassification,, was introduced, considered and placed on file for second reading. ,, This being the date set for hearing on the amendment application of Lemon Heights Invest- ment Corp., for the reclassification of a 2.31 acre parcel of property located on the north side of Sixth Street, beginning at a point approximately 108.04' west of Linwood Avenue, with a frontage of approximately 154.56' on Sixth Street and extending north for approximately 385.50', from the R-1 District to the R-3 District. J. F. Stone, 609 Lin- wood Street, objected to the reclassification of the property to R-3 District because Lots I to 29 on Linwood Avenue north of Sixth Street were restricted to R-I District and the Hearing Amendment Plan. (reconsidered 12-3-56) applicant's property should remain as R-1 District. On motion of Councilman Jerome, seconded by Markel and carried, the recommendation of the Planning Commission was and the amendment application of Lemon Heights Investment Corp., denied by the following vote: Ayes, Councilman J. Ogden Markel, William Jerome, Tilghman A. Taylor, Milford W. Dahl Noes, Councilmen Dale H. Heinly Absent, Councilmen None . This being the date set for hearing and no protests having been received, the amendment initiated by the Planning Commission for the reclassification of property to the rear lot lines on both sides of West First Street from Artesia to Birch Street, from ~the R-2 to C-1-PK District, from the R-3 District to the C-2-PK District and for the modification of the existing C-1 and C-2 Districts by the addition thereto of PK. On motion of Council- man Heinly, seconded by Jerome and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Aha Municipal Code creating changes in district boundaries, and amending Sheets Nos. 16, 24, 29, 33 and 37 of the Districting Map to show the reclassification" was introduced, considered and placed on file for second reading. This being the date set for the hearing on the~aunexation designated "Delhi and Newport Annex", on motion of Councilman Heinly, seconded by Markel and carried, the hearing was continued until January 21st, 1957. ,, A tabulation of bids was presented by the Manager for the construction of pavement on Fourth Street approximately 800 feet east of the Freeway, as follows: Total Sully-Miller Contracting Cc~pany 1~i~,39~.i0 Certified check of $2,000.00 R. OO On recommendation of the Manager and on motion of Councilman Jerome, seconded by Markel and carried, the bid of Ro J. Noble Company in the sum of $11,023.25, was accepted and the other bidsrejected and bonds ordered returned. Communication was read from the Planning Commission recommending approval of variance application of Vahan Apelian for permission to use the property situated on the west side of Flower Street (1702 South Flower Street) for construction of four single-family resi- dences, as shown on plot plan, and a protest was read with fifty-eight property owner's signatures abtached opposing the variance. Messrs. G. P. Anderson, Melvin Rosenbaum and Paul Banks objected to the construction on the basis that it would adversely effect the value of adjoining property. Mr. Frezon, Expediter and Mr. W. R. Bro,n, Agent of the applicant,offered to submit a new plot plan. On motion of Councilman Jerome, seconded by Heinly and carried, the variance application of Vahan Apelian was referred back to the Planning Commission to receive the new plot plan. Communication was read from the Planning C~mmission reconmending approval of variance application of C. H. Brockman to permit the use of property situated at 1425 South Bri Street for erection of a 50-square foot Neon sign above the roof of existing building, to advertise the present business and on motion of Councilman Heinly, seconded by N~rkel and carried, action on the variance was continued to the meeting to be held December 17, 1956 and the applicant to be notified to appear. ,, It was moved by Oounci]mau Jerome and seconded by Heinly, that variance application #841 of Industrial Enterprises, Inc., be approved to permit deletion of rear yard requirements on property situated on the west side of Oak Street from Dyer Road south to the City Limits (Lots I to 7 inclusive, Tract 2948), subject to the approval of the Fire Motion lost. Area bounded by Walnut, Bishop, Shelton & Flower Communication was read from the Planning Cc~mission recommending approval of variance application #8~2 of Case-Swayne Co., Inc., to permit construction of an office building, 35' x 60' on property situated at 1661 East Palm.Avenue. R. M. Phillips and other prope: ty owners in the vicinity stated that they had not seen any signs posted on the variance and protested against further construction by the applicants. On motion of Councilman Jerome, seconded by Markel and carried, actiOn was continued until the meeting of Decem- ber 17, 1956. On motion of .Councilman Jerome, seconded by Heinly and carried, the recommendation of the Planning Ccmmission was approved and the variance application of Wright, Ltd., denied for permission to construct three duplexes, with a 5 foot decrease in front yard requirements on triangular-shaped parcel of property situated on the west side of Spurgeon Street at the Freeway. Communication was read from the Planning Co~ission again recommending the denial of variance application of John and Hazel Wightman to permit the establishment and operatiol of a beauty salon in residence at 618 South B~oadway, and recommending that South B~oad- way south of Bishop Street to Edinger Street remain as R-l, R-2 and R-3 Districts as provided by the Zoning Ordinance. On motion of Councilman Jerome, seconded by Taylor ant carried, the recommendation of the Planning Conmission was approved and the variance application of John and Hazel Wightman denied. ,, On motion of Councilman Heinly, seconded by Jerome and carried, the amendment initiated by the Planning Commission to reclassi~ property on the north side of Walnut Street fro~ Maple Avenue to Cedar Street from the R-3 to the P-PK District, was referred back to the Commission to correct the procedure and legal description in Resolution No. 1059. . On motion of Councilmau Heinly, seconded by Taylor and carried, action was continued to December l?, 1956, on the request of the Northwest Santa Ana Homeowners Assn. Inc. for traffic signs and signals. ,, It was moved by Councilman Heinly, seconded by Taylor and carried, that the variance application #8~1 of Industrial Enterprises, Inc., be reconsidered. On motion of Councilman Heinly, seconded by Taylor and carried, the recommendation of th~ Planning Ccmmissionwas approved and the variance application of Industrial Enterprises, Inco, to permitdeletion of rear yard requirements on property situated on the west side of Oak Street from Dyer Road south to the City Limits,(Lots i to ? inclusive, Tract 29~8 was _/granted on condition that the plans and specifications on buildings erected thereon, are approved by the Fire Department. On motion of Councilman Heinly, seconded by Taylor and carried, Preliminary Map of J.V. Sarinana on property situated on the west side of English Street, beginning at a point 87.~7' south of the center line of Eighth Street, consisting of four lots each 5~' wide and llO' deep, was approved subject to the conditions of the Department of Public Works. ,, The Council having unanimously waived the reading of the Ordinance, on motion of Council- man ~arkel, seconded by Jerome and carried, the following Ordinance entitled: "Ordinance No. NS-2~7 amending Article IX of the Santa Aha Municipal Code creating changes in district boundaries, and ~,~nding Sheets No. 33 and 3~ of 'the Districting Nap to show the reclassification" of property in the area from Walnut Street to Bishop Street, and from Shelton Street to the rear of lots facing Flower Street, excluding R-3 property on Bishop Street, from the R-1 to R-2 District, reference Planning Commission initiated amendment, was con- sidered and passed by the following vote: Ayes, Councilmen Dale Ho Heinly, J. Dahl Noes, Councilmen None Absent, Councilmen None On motion of Councilman Markel, seconded by Jerome and carried, the communication, from the Boundary Commission reference proposed annexation of territory to the City of Tustim, "Revere Annexation" stating that the boundaries of the proposed annexation are reason- ably definite and certain although it overlaps a previously requested annexation area to Santa Ana, was received and filed. On motion of Councilman Heinly, seconded by Markel and carried, the City Attorney was instructed to file a protest with the City of Tustin on its proposed annexation of terri- tory designated "Revere Annexation". ,, On motion of Councilman Heinly, seconded by Taylor and carried, the communications from the Planning Commission recommending approval of proposed annexation of parcel of land consisting of approximately 57 acres, knu.~A as the "First and Tustin Southwest Annex" and from the Boundary Commission advising that the boundaries are reasonably definite certain, were received and filed. The Council having unanimously waived the reading of the Resolution, on motion of man Heinly, seconded by Taylor and carried, the following Resolution entitled: "Resolution No. 56-308 initiating proceedings for the annexation of territory to the City of Santa Ana, designated "First and Tustin SW Annex", and giving notice of time and place of hearing of protests thereto" was considered and passed by the following vote: Ayes, Councilmen Dale H. Heinly, J. Ogden Markel, William Jerome, Tilghman A. Taylor, Milford W. Dahl Noes, Councilmen None Absent, Councilmen None It was moved by Councilman Heinly, seconded by TaYfor a nd carried, that the City be instructed to take the~necessary legal action,to establish the prior rights of the City of Santa Ana, against the City of Tustin reference the proposed annexation known as the "Revere Annexation". Bonney On motion of Councilman Jerome, seconded by Markel and carried, the communication from the Boundary Commission was received amd filed, reference the proposed annexation of territory to the City of Garden Grove, Annexation No. 9. On motion of Councilman Jerome, seconded by Markel and carried, the communications from the Boundary Commission were received and filed, reference the proposed annexation of territory to the City of Tustin, designated "Hillview Annexation". On motion of Councilman Jerome, seconded by Markel and carried, the Resolution of the Board of Supervisors and Notice of Filing of Notice of Intention to cLrculate a Petition seeking the Incorporation of a new City to be known as "Fountain Valley" were received and filed. On motion of Counc~lmau Heinly, seconded by Taylor and carried, the City Attorney was instructed to prepare and file a protest with the Board of Supervisors reference the granting of permission to file a notice of intention to circulate a petition for the incorporation of a new City to be known as Fountain Valley, in view of the fact that the overlapping area had previously been filed on by the Cit~ of Santa Ana. On motion of Councilman Heinly, seconded by Jerome and carried, the communication from the Boundary Commission was received and filed, reference the boundaries of the proposed City of Fountain Valley and stating that the boundaries are reasonably definite and cer- tain as correcte~by the County Surveyor's office, although it overlaps an area in a proposed annexation to the City of Santa Ana. On motion of Councilman Markel, seconded by Taylor and carried, the request of Rev. L. Ho Willi~mson, Pastor of Chestnut Street Mission, 335 E. Chestnut Street, for a special license to preach at variou~ locations on Fourth Street as time and conditions permit, was referred back to the applicant to meet the requirements of the Ordinance for more specific information on She locations, dates, time and the number and names of the mem- bers of the Church assisting in the preaching. On motion of Councilman Jerome, seconded by Markel and carried, the M~vor was authorized to sign an offer to purchase approximately 1.416 acres of Excess State Lands Parcel No. 200 (Unit 2), in the County of Orange, located adjacent to the easterly boundary of Prentice Park and southwesterly of the Santa Ana Freeway, for ~he sum of $5,890.00; war- rant to be issued for said sum and forwarded to the State of California, Division of Highways for transmittal to the California Highway Commission for approval. ,, On motion of Councilman Jerome, seconded by Markel and carried, the bond of Roy Russell filed for the improvements within the boundaries of Record of Survey ~186, C-56, located at Santiago Avenue and Edgewood Road, in the sum of $700.00, was ordered released and improvements accepted as completed. On motion of Councilman Jerome, seconded by Markel and carried, the certification from the Department of Commerce Bureau of the Census,advising on the official count of the returns of the Special Census, taken as of October 27, 1956, showing the population of Santa Ana as 69,345, was received and filed. . On motion of CounciLman Jerome, seconded by Markel and carried, the communication from the State Department of Public Norks was received and filed, stating that the estimated gas tax revenue for the fiscal year ending June 30, 1957, is $192,930.00; based on the new population. On motion of Councilman Markel, seconded hy Jerome and carried, the resignation of Sidney L. Lowry as a member of the Personnel Board, was accepted with regrets and a let- ter of appreciation for his services was ordered sent. On motion of Councilman Jerome, seconded by Markel and carried, Alfred C. Bonney was appointed as a member of the Personnel Board to fill the vacancy created by the resigna- tion of Thos, W. On motion of Councilman Jerome, seconded by Markel and carried, the co~unication of the Metropolitan Water District enclosing a tabulation listing the member-areas of the Dis- trict and showing their respective assessed valuations, percentage participation and the number of votes to which each is entitled, as of November, 27, 1956, was received and ,, On motion of Councilman Jerome, seconded by Markel and carried, the cash bond of Richard Murison in the amount of $150.O0, filed for the sidewalk improvements within the bounda- ries of Record of Survey at 1~25 Grace Street, was ordered released and the improvements accepted as completed. On motion of Councilman Markel, seconded by Jerome and carried, the audit report of Evans and Company for the fiscal year ended June 30, 1956, was received, filed and sub- mitted to the Council as a co~ittee of the whole. On motion of Councilman Jerome, seconded by Markel and carried, the minutes dated Novem- ber 28, 1956 of the Personnel Board, were received and filed. On motion of Councilman Jerome, seconded by Taylor and carried, the applications of Fay Rose, Lloyd W. Neal, Frederick G. Goring Jr., Richard A. Bowen, Ernest D. Somards, Frank A. Brewer, Donald F. Reimer, William R. Steele, Bernard P. Phillips, Helen Shaw and Donald A. Wilbur, to drive taxicabs, were granted. On motion of Councilman Jerome, seconded by Taylor a~d carried, the notification of the Department of Alcoholic Beverage Control of beverage application of Albert C. Gutierrez, 1432 W. Fourth Street, was received and filed. Communication of the Chamber of Commerce was read recon~ending that the City Ordinance banning dances in restaurants be reviewed by the City Council and if present circumstan- ces and best public interest warrants such action the Ordinance be modified. On motion of Councilman Heinly, seconded by Markel and carried, the communication was filed and the submitted to the Council as a committee of/whole and the Manager and Attorney instructed to acquire standard Ordinances from other cities and report to the Council. Communication was read from the Chamber of Commerce recommending that the widening of North Main Street from 7th Street to the bridge be expedited, that a rush hour parking ban be established on 1st Street between Main and Birch Streets and that a three-phase signal be installed at th~ intersection of 17th S~reet and Main Street. On motion of Councilman Jerome, seconded by Markel and ~arried, ~he recommendations were referred t o the Manager and Traffic Engineer for study and recommendation. Communication of the Chamber of Commerce was read, requesting the Council to give con- sideration towards filling vacancies on City Commissions and if the City is redistricted, in accordance with the Charter, that councilmanic representation be given to the westerly area or any other area that is annexed to the City. It was moved by Councilman Heinly, seconded by Markel and carried, that the Council adopt a policy with respect to areas being annexed to the City of Santa Ana, as follows: lo If and when the areas are annexed, the residents will be considered in future appoint ments to Commissions. 2. Any area annexed to the City will be given full consideration in the districting of the Wards of the City of Santa Ana in so far as representation on the Council is con- cerned and there will be no "gerrymandering" on any annexation to the City of Santa Ana. 3. That the Charter will be followed hy the Council as soon as the population reaches 120,000. On motion of Councilman Jerome, seconded by Markel and carried, the written recommenda- tion of the Manager dated December 3, 1956, setting forth salary step increases for eigh~ employees, effective December l, 1956, was received, filed and approved. On reco~nendation of the Director of Public Works and on motion of Councilman Heinly, seconded by Jerome and carried, the request of Bovee and Crail Construction Company for an extension of time on their contract for construction of the Bristol Street Pumping Station to January l, 1957, was granted. On motion of Councilman Heinly, seconded by Markel and carried, the recommendation of th, Traffic Com~ittee was approved and the request of Mrs. Georgia Bradley was denied for two or three car green zones in front of the Nursery School, 309 East Walnut Street. On motion of Councilman Jerome, seconded by Taylor and carried, the recommendation of the committee was approved and the request of O. L. Halsell Foundation for permission to install a 30 foot driveway on Birch Street at the approximate center of the lot on the southwest corner of Birch and Sixth Streets, was granted condi$ioned on the closing of the small driveway just to the north of the alley. It was moved by Councilman Jerome, seconded by Taylor and carried, that the Department oJ Public ~orks be authorized to solicit three property owners on the west side of B~istol Street between Washington Avenue and Ma~tha Lane to construct sidewalks at their expense. On motion of Councilman Jerome, seconded by Taylor and carried, the recommendation of the Traffic Committee was approved and the request of Knox Cleaners, 702 South Main Street, denied for a 12 Minute Parking Zone. On motion of Councilman Jerome, seconded by Taylor and carried, the recommendation of th~ Traffic Committee was approved and the request of Mrs. N. Pedersen, 2042 South Main Street, denied for a no parking zone in front of her store.
