HomeMy WebLinkAbout75-130CJL:nr RESOLUTION NO. 75- 130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, REVERSING THE ACTION OF THE PLANNING COMMISSION ON VARIANCE APPLICATION 75-35, DENYING SAID VARIANCE APPLICATION, AND APPROVING APPEAL NO. 351 FILED THEREON BY ROBERT J. MOORE WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana On September 2: 1975 , on Appeal No. 351, filed by Robert J. Moore in opposition to the Planning Commission's approval of Variance Application 75-35; NOW, THEREFORE, BE IT RESOLVED that, based on such public hearing and the oral and documentary evidence submitted therein, the City Council of the City of Santa Ana does hereby reverse the action of the Planning Commission approving Variance Application 75-35, and does hereby deny said Variance Application, and does hereby grant said Appeal No. 351 filed thereon in opposi- tion to the Planning Commission's action. BE IT FURTHER RESOLVED, that the City Council hereby adopts the attached findings of fact supporting denial of Variance Application 75-35. Description of Proposal: The applicant proposes to operate a lock and key shop in an existing building. The leasable square footage for this use is 11' X 21' (231 square feet). A portion of the building is presently being utilized as a beauty shop. The two-story building also has two apartments on the second floor. The retail sales of locks and keys requires an approved variance. NOTE: Based upon floor area for existing and proposed uses, parking spaces required would require 8 open spaces and 2 covered spaces (for residential use). Ten open spaces exist on site at present. 2. Area Description: A. Property: 45' x 142', or approximately 6,390 square feet of land area, located approximately 100 feet southerly of Walnut Street on Broadway. B. Surrounding Development: north: east: south: west: single family home single family and professional office doctor's office single family C. Street System: Broadway is a planned arterial street. D. Comparable Applications or Circumstances: VA 75-18, approved on 6/6/75. Retail use of an older professional/commercial building. E. Surrounding Zoning:. See attached SDM. F. Present Use: A beauty salon, vacant office and two residential units. The building was converted to two office/commercial areas on the front portion and two residential units in May, 1956. 3. General Plan Compatibility: The General Plan designates the area as a multi-use corridor. 4. General Findings: There are no special circumstances applicable to the subject property which would cause the strict appli- cation of the zoning ordinance to deprive the subject property of privileges not otherwise at variance with the intent and purposes of the Santa Ana Municipal Code Zoning Chapter 41; and (a) The granting of the variance is not necessary for the preservation and enjoyment for one or more substantial property rights; and (b) (c) The granting of the variance will be detrimental to the public welfare or injurous to surrounding property. 5.
