RESOLUTION NO. 75-132
A RESOLUTION OF THE CITY COUNCIL OF TIIE
CITY OF SANTA ANA REVERSING THE ACTION
OF THE PLANNING COMMISSION ON CONDITIOI~AL
USE PER~4IT APPLICATION CUP 75-7 APPROVING
SAID CONDITIONAL USE PER~4IT APPLICATION
AND APPROVING APPEAL NO. 352 FILED THEREON

WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on September 2, 1975,
on Appeal No. 352 filed by Regina Harris in opposition to
the Planning Commission's denial of Conditional Use Permit
Application No. 75-7.
NOW, THEREFORE, BE IT RESOLVED, that based on such
public hearing and the oral and documentary evidence submitted
therein, the City Council of the City of Santa Ana does hereby
reverse the action of the Planning Co~aission denying Conditional
Use Permit Application No. 75-7, and does hereby approve said
Conditional Use Permit Application No. 75-7 and does hereby
approve Appeal No. 352 filed thereon in opposition to the
Planning Commission's action.
BE IT FURTHER RESOLVED, that the City Council hereby
adopts the attached findings of fact supporting approval of
Conditional Use Permit Application No. 75-7.
PASSED AND ADOPTED by the City Council of the
City of Santa Ana at its regular meeting held on
2nd day of September , 1975.

DETAILS OF PROPOSAL:
1. Description of Proposal:
The applicants, The Small World Community Development
Corporation, a non-profit organization, proposes the
establishment of an infant day care center for low
income, welfare families and infants in one parent homes
in an existing single family residence. The applicants
plan for a maximum of 16 infants at one time. This
would include: 8 infants, age 6 weeks to 13 months; 8
toddlers, age 13 months to 2 1/2 years.
The teacher-child ratio would be 1 to 4 paid staff plus
a director and an assistant director. According to the
applicants, teachers will be paid from revenue sharing
funds.
The subject residence contains approximately 1,200 square
feet. The rear yard is fenced and contains approxi-
mately 1,850 square feet.
While the.Department of Housing and Urban Development
(HUD) owns the subject property, this agency is merely
leasing the land and will not be involved in the pro-
ject. HUD states that the house, while undergoing
improvements, must still remain a residence.
2. Area Description:
A. Property:
The subject lot is 60' x 107' with an area of 6,420
square feet located on the west side of Forest
Avenue north of Myrtle Street.

B. Surrounding Development:
Single family homes in all directions.
C. Street System:
Forest Avenue is a 66' wide local street.
D. Comparable Applications or Circumstances:
None in the area.
E. Surrounding Zoning: See attached SDM
F. Present Use: vacant residence
3. General Plan Compatibility:
The General Plan designates the area for low density
residential uses.
Approval is subject to the following conditions:
A. Planning: 1,2,3,14
B. Public Works: 22c
5. The following requirements must also be metz
A. That the outdoor play area or other outside acti-
vity be confined to the rear yard.
B. That the driveway and garage areas be kept clear
for vehicular traffic and parking.
C. That the applicants meet all the requirements of
the Health Department.
D. That the driveway and front yard areas not be used
for off-street parking.
Public Works Department
E. Improvements:

Forest Avenue: Replace sidewalk to city stan-
dards where asphalt exists on sidewalk.
Fire Department
The building and its use shall conform to the regu-
lations of Title 19, California Administrative Code
(Public Safety) and the Uniform Fire Code.

This CUP shall be reviewed by the Planning Department
'at the end of a 10-month period which shall deter-
mine whether or not the use shall continue.
6. General Findings:
(a) This~use is necessary or desirable to provide a
service or facility which will contribute to the
general'well-being of the neighborhood or the com-
munity; and

That such use will not, under the circumstances of the
particular case, be detrimental to the health, safety
or general welfare of persons residing or working in
the vicinity, or injurious to property or improve-
ments in the vicinities; and
That the proposed use will comply with the regula-
tions and conditions specified in Chapter 41 of the
Santa Ana Municipal Code for such uses; and
(d)
That the granting of this Conditional Use will not
adversely effect the general plan of the City of
Santa Ana.
