RESOLUTION NO. 75-133
A RESOLUTION OF ~IE CITY COUNCIL OF TIlE
CITY OF SANTA ANA REVERSING TttE ACTION
OF THE PLANNING CO~ISSION ON VARIAI~CE
APPLICATION NO. 75-40 ,APPROVING SAID
VARIANCE APPLICATION, AND APPROVING
APPEAL NO. 353 FILED TtIEREO1; BY ANDERSON
CONSTRUCTION COMPANY
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on September 2, 1975,
on Appeal No. 353 filed by Anderson Construction Company
in opposition to the Planning Commission's denial of Variance
Application No. 75-40.
NOW, TttEREFORE, BE IT RESOLVED, that based on such
public hearing and the oral and documentary evidence submitted
therein, the City Council of the city of Santa Ana does hereby
reverse the action of the Planning Commission denying Variance
Application No. 75-40, and does hereby approve said Variance
Application No. 75-40 and does hereby approve Appeal No. 353
filed thereon in opposition to the Planning Commission's action.
BE IT FURTtIER RESOLVED, that the City Council hereby
adopts the attached findings of fact supporting approval of
Variance Application No. 75-40.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its regular meeting held on the 2nd
day of September , 1975.

SUPPORTING APPROVAL OF
VARIANCE APPLICATION 75-40

VA PURPOSE: To construct a mobile home park in the M 1 District

DETAILS OF PROPOSAL
1. Description of Proposal:
Applicant proposes a mobile home park that will contain forty-four
(44) mobile home sites.
Development is proposed as follows:
a) Total area 5.65 acres, gross or 5.17 net acres
b) Density of 8.51 units per acre
c) Recreation area - 13,100 square feet
d) Interior streets - 1.07 acres
e) Net mobile home sites - 3.14 acres
f) Average mobile home site area - 3,109 square feet
g) Guest parking spaces - 24 total
h) 44 mobile home sites proposed
(Applicant proposes to eliminate the utility storage
area and utilize the area for two additional mobile
home sites to make a total of 44.)
Area Description:
A. Property:
A rectangular shaped parcel on the west side of Clinton Street
with 707 feet of frontage on Clinton Street and 300 feet of
depth. Site contains approximately 5.65 acres.
B. Surrounding Devel'opment:
North - storage yard
East - across Clinton Street, apartments
South - mobile home park and Pacific Electric right of way
West - storage yard

C. Street System:
Clinton Street is a local 60 foot wide street that dead
ends at the Pacific Electric Right of Way.
D. ComparableApplications or Circumstances:
Mobile home park to the south is in the City of Garden
Grove.
CUP 74-1 for a mobile home park was denied on the sub-
ject Property in 1974. The denial by the Planning Com-
mission was not appealed.
E. Surrounding Zoning: See attached SDM.~ '
F. Present Use: Vacant.
3. General Plan Compatibility:
General Plan indicates medium density residential 8 to 15
units per acre. (It should be noted that property to the
northand west is zoned M1.)
4. Subject to the following conditions:
A. Planning: 2, 3, 4, 13, 14
Public Works: 1, 3, 5, 8a, 10, 13', 15, 17, 2la, b, c,
d, 23, 25, 26, 27, 40, 41, 42, 43
*Orange County Sanitation District 92
5. The following requirements must also be met:
A minimum 15 foot landscape strip be maintained along
the west and north property lines inside of mobile
home park.
An 8 foot high decorative block ,wall be constructed
along the north and west property lines. A ~ foot
high decorative wall be constructed along the east
and south property lines.
Decorative wall design shall meet the approval of the
Planning Department.
Five foot landscape strip be maintained along the
street property line between the 6 foot wall and the
street.
That the 15 foot wide planter located along the north
and west property line be planted with trees or shrubs
6 feet on center which have a vertical growth habit.
These trees or shrubs shall all be 5 gallon size or
larger.
F. Compliancewith Mobile Home Park Ordinance.
Utility storage area remain as indicated on the plot
plan.

The following requirement is also to be complied with
prior to the issuance of a Building Permit:
(1)
Provide a letter from Garden Grove Sanitary Dis-
trict about availability of their lines for
service and capacity.
Note: City of Santa Aha has no sewer main in
Clinton Street at this location.
The following requirement is also to be complied with
prior to issuance of utilities release by the Depart-
ment of Building Safety and Housing=
(1)
Construct any necessary storm drain facilities
that may be necessary as approved by the Depart-
ment of Public Works.
Dedications: Clinton Street .- Street easement for a
width of 30 feet from center line to property line and
a cul-de-sac as required.
J. Improvement Plans:
(1) Clinton Street
(2) Water main
(3) Storm drain if required
K. Improvements:
(1)
Clinton Street with curb and gutter 18 feet west
of the center line, pavement to meet existing
pavement and sidewalk.
(2)
Provide for cul-de-sac at southerly terminus of
Clinton Street as required by the Department of
Public Works.

Provisions complying with the following Codes shall
apply:
1971 Uniform Fire Code
Title 19, California Administrative Code, Public
Safety
Title 24, California Adlninistrative Code, Housing
and Commercial Development
Title 25, California Administrative Code, State
Building Standard.
National Fire Protection Association Standards
Plans incorporating the above codes showing Fire Depart-
ment access driveways, automatic fire protection sys-
tems, portable fire extinguishers and on-site fire
hydrants shall be submitted for approval by the Fire
Department prior to the issuance of a building permit.
6. General Findings:
(a)
There are special circumstances applicable to t_he
subject property which would cause the strict
application of the zoning ordinance to deprive the
subject property of privileges not otherwise at
variance with the intent and purposes of the
Santa Aha Municipal Code Zoning Chapter 41; and

(b)
The granting of the variance is necessary for the
preservation and enjoyment for one or more sub-
stantial property rights; and
(c)
The granting of the variance will not be detri-
mental to the public welfare or injurious to sur-
rounding property; and
(d) The granting of the variance will not adversely
affect the general plan of the City.
Variance is granted on the condition that all
prospective tenants be given the written notice
attached hereto as Exhibit "A" which is by this ref-
erence incorporated herein as though fully set forth.

NOTICE TO TENANT
YOU are hereby notified that because of the
proximity of this mobile home park to certain manufacturing
and industrial businesses, there is a potential for dust
and noise polution. You are urged to consider this in
applying for occupancy, and you should also be aware that
such noise and dust pollution, if it should occur, may not
exceed Environmental Protection Agency standards.
