HomeMy WebLinkAbout75-157CTD:po 10-23-75 RESOLUTION NO. 75-157 A RESOLUTION OF THE CITY COUI;CIL OF TttE CITY OF SANTA AIWA APPROVING A MAP AND DECLARING INTENTIOI~ TO VACATE A PORTIO~ OF SIXTH STREET IN THE HICKEYS, ~DREWS, CRANES ADDITIO~ TO SANTA ANA BETWEEN ROSS STREET AND SANCTA ANA BOULEVARD, SUBJECT TO THE RESERVATION AND EXCEPTION OF A CERTAII~ EASEIIENT AND RIGtlT OF WAY; DIRECTING TIlE CLERK OF TItE COUNCIL TO FILE SAID MAP IH tIER OFFICE; DESCRIBING SAID STREET AND TttE EASE~IENT AND RIGItT OF WAY TO BE RESERVED AND EXCEPTED; SETTING A PUBLIC HEARING THEREON; AI~D DIRECTING NOTICE HEREOF TO BE POSTED BE IT RESOLVED by the Council of the City of Santa Aha: SECTION 1: This Council of the City of Santa Ana does hereby approve that certain map entitled, "Proposed Street Abandonment Map (of) A Portion of Sixth Street In The Hickeys, Andrews, Cranes Addition to Santa Ana, Book 5 Page 352 Los Angeles County Records, as the map showing the portion of Sixth Street between Ross Street and Santa Ana Boulevard which this Council hereinafter declares its intention to vacate subject to the reservation and exception of a certain easement and right of way hereinafter described. SECTION 2: The Clerk of the Council is hereby directed to file said map in her office where the same may be examined by any and all persons desiring to do so. SECTION 3: Pursuant to and in accordance with provisions of Part 3 of Division 9 of the Streets and Highways Code of the State of California, this Council does hereby declare its intention to order the vacation of, and to vacate that portion of Sixth Street between Ross Street and Santa Ana Boulevard subject to the reservation and exception of the easement and right of way hereinafter described which is dilenated on said map, to which reference is hereby made for full and further particulars. SECTION 4: Notice is hereby given that at the hour of 7:~ ~.m. or as soon thereafter as the matter can be heard, on the 8th day of December 1975 , in the Council Chambers of the City of Santa Aha, 22 Civic Center Plaza, Santa Ana, California, a public hearing will be held by this Council at which time any and all persons interested in or objecting to the proposed vacation of Sixth Street between Ross Street and Santa Ana Boulevard and the reservation and exception of the easement and right of way, hereinafter described, may appear and be heard. SECTION 5: The Clerk of the Council is hereby directed to cause the Resolution to be published in The Register within fifteen (15) days after the date of adoption of this Resolution and at least ten (10) days before the date set for said hearing. SECTION 6: The Director of Public Works is hereby directed to cause notices of said proposed street vacation to be posted conspicuously along the line of the aforesaid Sixth Street between Ross Street and Santa Ana Boulevard, which is proposed to be vacated, at least ten (10) days before the date set for said hearing. Such notices shall be posted not more than three hundred feet (300') apart, but at least three shall be posted. Such notices shall state the passage of this Resolution of Intention and the time and place of the hearing. (3) RESOLUTION NO. 75- 157 PAGE TWO SECTION 7: Said section of said street proposed to be vacated is more fully described as follows: A portion of Sixth Street, 60 feet wide of Hickeys', Andrews' and Crane's Addition to Santa Ana, in the City of Santa Ana, as shown on a map thereof recorded in Book 5, Page 352, of Miscellaneous Records of Los Angeles County, California, more particularly described as follows: Beginning at the intersection of the centerlines of said Sixth Street and Ross Street, 50 feet wide, as said streets are shown on said map; thence Easterly along said centerline of Sixth Street a distance 53 feet to its intersection with a line parallel with said centerline of Ross Street, said intersection being also the true point of beginning; thence Northerly along said parallel line a distance 30 feet to the North line of said Sixth Street; thence Easterly along said North line of Sixth Street a distance 363.99 feet to a point on a tangent curve concave Southeasterly having a radius of 382 feet, a radial to last said point bears North 00~21'36'' West, last said point being also a point of cusp; thence Southwesterly along last said curve through a central angle of 32032'54'' an arc distance of 217.00 feet to its intersection with the south line of said Sixth Street, a radial to last said point of intersection bears North 32054'30" West; thence Westerly along said South line a distance 157.91 feet to last said line parallel with the centerline of Ross Street; thence Northerly along last said parallel line a distance 30 feet, to the true point of beginning. Reserving and excepting to the City of Santa Ana the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereof proposed to be vacated. PASSED AND ADOPTED by the City Council of the City of Santa Aha at its regular meeting held on the 3rd day of November , 1975.
