HomeMy WebLinkAbout75-158CJL: pld 10-30-75 RESOLUTION NO. 75-158 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AFFIRMING THE ACTION OF THE PLANNING COMMISSION ON VARIANCE APPLI~ CATION NO. 75-52, APPROVING SAID VARIANCE APPLICATION FILED BY JAMES LUKENS WHEREAS, the City Council of the City of Santa Ana duly set a public hearing, and a public hearing was duly held on November 3, 1975 , to review the Planning Commis- sion's approval of Variance Application No. 75-52. NOW, THEREFORE, BE IT RESOLVED, that based on such public hearing and the oral and documentary evidence submitted therein, the City Council of the City of Santa Ana does hereby affirm the action of the Planning Commission approving Variance Application No. 75-52 and does hereby approve said Variance Application filed by James Lukens. BE IT FURTHER RESOLVED, that the City Council hereby adopts as its findings of fact for approval of Variance Appli- cation No. 75-52 those "Finding of Fact, Variance 75-52" pre- pared and submitted by the Planning Commission. Description of Proposal: The applicant proposes to add beer and wine sales to retail items sold at the existing drive-in dairy outlet. No additional square footage will be necessary for the sale of the additional items. 2. Area Description: A. Property: An irregular shaped parcel with 116' of frontage on Edinger Avenue, a depth of 605' and a total area of approxima, tely 47,812 square foot (1.09 acre) B. Surrounding Development: North (acress Edinger) single family residences South - Pasture area for dairy East - commercial stores, three single family residences West - single family residences, dairy C. Street System: Edinger Avenue is a planned arterial highway. D. Surrounding Zoning: See attached SDM E. Present ~Use: Combination retail dairy sales, store and milk processing plant in a building 115' x 20'. In addition a 22' x 25~ general business office is on the property for the subject use. VA 75-52 Page One James Lukens 3. General Plan Compatibility: The General Plan designates this area as iow density residential. 4. General Findings: (a) There are no special circumstances applicable to the sub- ject property which would cause a strict application of the zoning ordinance to deprive the subject property of privileges not other- wise at variance with the intent and purposes of Chapter 41 of the Santa Ana Municipal Code; and (b) That the granting of the Variance is not necessary for the preservation and enjoyment of one or. more substantial rights; and (c) That the granting of the Variance will be materially detri- mental to the public welfare or injurious to surrounding property; and (d) That the granting of the Variance will adversely effect the general plan of the City of Santa Ana. 5.
