RESOLUTION NO. 76-1
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA IN SUPPORT OF
HR-9801.
WHEREAS, under present federal law, Congress has no
power to oversee administrative rule and regulation making
procedures and policies of the Executive Branch of the Federal
Government, and
WHEREAS, in the opinion of this Council, the rule
and regulation making power of the Executive Branch of the
Federal Government has been exercised in the past, from time
to time, in a manner to thwart the intent of Congress and to
impose upon local elected officials duties, responsibilities
and other requirements that are more stringent than was in-
tended by Congress, and
WHEREAS, the exercise of such powers by the Executive
Branch of the Federal Goverment has thereby usurped the decision
making authority of local elected officials and imposed unneces-
sary and unreasonable delays and complications upon the process
of carrying out federal programs.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana as follows:
1. That this Council does hereby support enactment
of HR-9801, which, if adopted, "may prevent the adoption
by the executive branch of rules or regulations which are
contrary to law or inconsistent with congressional intent or
which go beyond the mandate of the legislation which they are
designed to implement", and does hereby urge its passage.
2. The Clerk of the Council is directed to forward
copies of this Resolution to Senators Cranston and Tunney;
Congressman Peter W. Rodino, Jr., Chairman of the House
Judiciary Committee; Congressman Ray J. Madden, Chairman of
the House Rules Committee; members of the House of Representatives
who represent districts in Orange County; the League of California
Cities; and the County Supervisors Association of California.
PASSED AND ADOPTED by the City Council of the City
of Santa Ana at its re§ular meeting held on the 5th
day of January , 1976.
