HomeMy WebLinkAbout76-034RESOLUTION NO. 76-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA EXPRESSING ITS CONCERN REGARDING THE METHODS OF OPERATION OF FAMILY CARE HOMES AND GROUP HOMES IN THE CITY, AND URGING THE LEGISLATURE TO AMEND THE STATUTES APPLICABLE THERETO. WHEREAS, this Council has been informed that operators of state-authorized, certified or licensed family care homes or group homes serving six or fewer mentally disordered or other- wise handicapped persons or dependent and neglected children are operating facilities consisting of more than one adjacent residential properties in the City; and WHEREAS, such facilities amount, in the opinion of this Council, to single businesses, having common ownership, control, and management, and often single kitchen locations; and WHEREAS, in the opinion of this Council such facilities effectively evade the stated policy of the Legislature to dis- burse patients of such homes in order to provide so far as possible, normal residential surroundings to such patients, and therefore, amount to a re-institutionalization of such patients to the detriment of such patients, the neighborhoods in which such facilities are located, and the City as a whole. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana, as follows: 1. That this Council expresses to the Legislature its concern over the manner in which state-authorized, certified, or licensed family care homes and group homes are allowed to operate, as specified above. 2. That this Council does hereby urge the Legislature to amend Section 5116 of the Welfare and Institutions Code, and other law as deemed applicable by the Legislature, so as to re- quire disbursement of such homes throughout residential neighbor- hoods, and eliminate concentration thereof on adjacent parcels of residential property. 3. That a sample draft of such amendment is attached hereto as "Exhibit A" and is urged upon the Legislature for adoption as a means to bring an end to the harmful concentra- tions of such homes in the City.
