A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA CLOSING
MORTIMER STREET AT CIVIC CENTER
DRIVE
WHEREAS, Section 21101 of the Vehicle Code of the State of California
authorizes the legislative body having jurisdiction over a city street to
close such street to vehicular traffic when in the opinion of the legislative
body such street is no longer needed for vehicular traffic; and
WHEREAS, Mortimer Street is a street within the jurisdiction of the City
Council of the City of Santa Ana; and
WHEREAS, on April 5, 1976 the City Council of the City of Santa Ana held
a public hearing on the question of whether Mortimer Street should be closed
at the intersection thereof with Civic Center Drive on the south side of Civic
Center Drive by construction of a permanent cul-de-sac on Mortimer Street at
such location; and
WHEREAS, at such hearing the Council heard and considered the reports and
recommendations of the administrative staff of the City of Santa Ana and the
evidence of all persons speaking for or against the proposed closure of Mortimer
Street;
NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa
Ana does hereby authorize and approve the construction of a permanent cul-de-sac,
such closure to be at its intersection with Civic Center Drive on the south side
thereof, such closure to be permanent unless ordered by resolution of this body
to be opened.
BE IT FURTHER RESOLVED: That the Director of Public Works shall erect or
cause to be erected appropriate signs giving notice of such street closure.
BE IT FURTHER RESOLVED: That by this Resolution the City of Santa Ana
does not surrender its title or any portion thereof in or to said street,
BE IT FURTHER RESOLVED: That the Council does hereby adopt the following
as its findings of fact upon which is based its determination to close Mortimer
Street as described hereinabove:
1. That the elimination of through traffic on Mortimer Street between
Santa Ana Boulevard and Civic Center Drive produces only minor inconvenience to
a limited number of motorists daily.
2. That the construction of a cul-de-sac on that portion of Mortimer Street
located between Santa Aha Boulevard and Civic Center Drive will eliminate use of
Mortimer Street by through traffic and decrease speeds and accidents increasing
the safety of the residents and pedestrians crossing the street;
3. That adjacent land owners have considered the impact of the cul-de-sac
to their property and indicated support for the concept.
4. That any property currently having driveway access to the closed
segment of Mortimer Street will be provided the same continued access to that
driveway.
5. That the closure will not have any significant detrimental effect
on the furnishing of police, fire and other municipal services to residents
on Mortimer Street;

6. That closure of Mortimer Street south of Civic Center Drive will
eliminate an undesirable five-legged intersection with Civic Center Drive and
French Street; and
7. That there is no necessity for continued vehicular traffic access
between Mortimer Street and Civic Center Drive from that portion of Mortimer
Street located immediately to the south thereof.
PASSED AND ADOPTED by the City Council of the City of Santa Ana at its
regular meeting held on the Sth day of April , 1976.
