RESOLUTION NO. 76-49
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA, AFFIRMING THE ACTION
OF THE PLANNING COMMISSION ON CONDITIONAL
USE PERMIT APPLICATION NO. 76-8, APPROVING
SAID CONDITIONAL USE PERMIT APPLICATION
AND DENYING APPEAL NO. 362 FILED THEREON

WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Aha on May 3, 1976, on Appeal
No. 362 filed by Ira F. McDaniel in opposition to the Planning
Commission's approval of Conditional Use Permit Application
No. 76-8.
NOW, THEREFORE, BE IT RESOLVED, that based on such
public hearing and the oral and documentary evidence submitted
therein, the City Council of the City of Santa Ana does hereby
affirm the action of the Planning Commission approving Condi-
tional Use Permit Application No. 76-8 and does hereby approve
said Conditional Use Permit Application No. 76-8 and does here-
by deny Appeal No. 362 filed thereon in opposition to the
Planning Commission's action.
BE IT FURTHER RESOLVED, that the City Council hereby
adopts as its finding of fact for approval of Conditional Use
Permit Application No. 76-8, those "Finding of Fact, Conditional
Use Permit 76-8" prepared and submitted by the Planning Commis-
sion, attached hereto and incorporated herein as though fully
set forth.
PASSED AND ADOPTED by the City Council of the City of
Santa Ana at its re§ula~ meeting held on the l'Tth
day of Hay , 1976.

REASON FOR ACTION:
That the granting of this conditional use permit with all attached conditions
will not be detrimental to the public welfare or surrounding property and
further it will not adversely effect the General Plan of the City.
DETAILS OF PROPOSAL:
1. Description of Proposal:
The applicant proposes to construct detached single family residences on
6,000 sq.ft, lots that all have frontage on a public street {standard single
family residence tract). Total lots involved in the project are 85. The
unit sizes are proposed to range between 1300 sq.ft, and 1750 sq.ft.
2. Area Description:
Property:
A rectangular Shaped parcel with 658 feet of frontage on Raitt Street,
a depth of 1,123 feet and a total area of approximately 16.96 acres.

The General Plan designates this area for low density residential.
Reasons for Staff Recommendation:
A. The proposal meet~ the intent and purpose of the R 1 Single Family ' Residential District.
B. The proposal will not be detrimental to the General Plan or detri-
mental to existing and proposed 'uses in the area.
If the Commission approves the application, the following standard require-
merits must be met:
A. Planning: 2, 3, 14
B. Public Works: File a tract map with the City and comply with all
Council approved conditions.
NOTE: Tentative Tract Map No. 9046 is in process.
The following requirements must also be met:
A. The entire subdivision shall have a 6-foot high decorative concrete
block wall, measured from highest finished grade.
B. That the Raitt Street entrance way into the subdivision be decorative
in design gnd meet with the approval of the Planning Director.
C. Architectural elevations shall be submitted to and approved by the
Planning Director prior to the issuance of building permits.
D. That each lot within the subdivision contain a minimum of twenty-four
(24) inch box tree to be placed in the front yard setback area.
E. Plot plan shall meet with the approval of the Planning Department prior
to issuance of building permits.
Police Department:
F. All exterior doors are to be solid core in design.
G. Those doors which have'glass within 40 inches of the locking device
shall be equipped with a double cylinder deadbolt lock with a minimum
one inch throw.
All exterior doors with glass 40 inches or more from the locking
device may be equipped with a single or double cylinder deadbolt
lock with a minimum of one inch throw.
I. Glas~ sliding doors are to be so secured that they cannot be merely
lifted out of the track.
J. Sliding Windows are to be so constructed to restrict them from being
moved and prevent being lifted out of the track.

All exterior doors of the residence shall be equipped with a lighting
device Which would illuminate the door 'and doorway and capable of
illuminating the door and doorway with the equivalent of a 60 watt
incandescent light bulb.
L. Overhead garage doors are to be secured with two hasps placed on the
exterior side of the door on opposing edges.
Garage side doors shall be solid core in construction and be equipped
with a deadbolt locking device with a minimum one inch throw. If said
door has glass within 40 inches of the locking device, it shall be
equipped with a double cylinder deadbolt lock with a minimum of a
one inch throw.
