HomeMy WebLinkAbout76-061REL: nr 6-3-76 RESOLUTION NO. 76-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, AFFIRMING THE ACTION OF THE ZONING ADMINISTRATOR ON MINOR EXCEPTION APPLICATION NO. 76-6, APPROVING SAID MINOR EXCEPTION APPLICATION, AND DENYING APPEAL NO. 363 FILED THEREON BY LOIS L. TETLEY WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on June 7, 1976, on Appeal No. 363 filed by Lois L. Tetley in opposition to the Zoning Administrator's approval of Minor Exception Application No. 76-6. NOW, THEREFORE, BE IT RESOLVED, that based on such pub- lic hearing and the oral and documentary evidence submitted therein, the City Council does hereby affirm the action of the Zoning Adminis- trator approving Minor Exception Application No. 76-6, and does hereby approve said Minor Exception Application No. 76-6, and does hereby deny Appeal No. 363 filed thereon in opposition to the Zoning Administrator's action. BE IT FURTHER RESOLVED, that the City Council hereby adopts as its findings of fact for approval of Minor Exception Application No. 76-6, those "Finding of Fact, EX 76-6" prepared and submitted by the Zoning Administrator, attached hereto and incorporated herein as though fully set forth. Mahoney, representing the applicant 5/14/76 hearing REASON FOR ACTION: The purpose of the 6' high masonry wall is to buffer commericaly or professionallyusedproperty from residentially zoned property. While the adjacent property is zoned R 1, VA 67-8, approved 4/3/67, allowed it to be used for retail tire sales. This use still exists. The chance of this property being used for residential proposes in the futdre is remote as it fronts on one major arterial street and is very close to another. DETAILS OF PROPOSAL: I. Description of Proposal: The applicants propose a 4160 sq.ft, one and two story commercial building (liquor store) on the subject site which is located in the C 5 District. Since the adjacent property to the east is zoned R I the Code requires a 6' high masonry wall along the common property line. (Code Section 41-425 c) This application requests the required wall be waived, 2. Area Description: A. Property: Approximately 105' x 109' or 11,445 sq.ft, located at the northeast corner of Bristol Street and Warner Avenue. B. Street System: Bristol and Warner are planned arterial streets. Comparable Applica~ons or Circumstances: Surrounding Zoning: See attached SDM Present Use: Commercial building under construction. 3. The following standard reqirements must be met: A. Planning: 1, 2 14 B. Public Works: 16, 22c, d, 28, 41. 4. The following requirements must also be met: A. Public Works: I) Provide a cash deposit to the City to guarantee owner's responsibility for additional street improvements required for future street widening of Bristol Street to ultimate. 2) Improvements a)Warner Avenue - replace sidewalk were AC, repair drive, close part of drive appracho b) Bristol Street - close drive appraches, construct new drive approaches. NOTE: Construction of the above improvements are in process. B. Police Department I) That a silent alarm system for burglary be installed. 2) That a silent alarm for robbery be installed. 3) That the construction of the shelving should provide adequate visibility to passing patrol vehicles.
