HomeMy WebLinkAbout76-071REL:rs 7-12-76 RESOLUTION NO. 76- 71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA MODIFYING THE ACTION OF THE PLANNING COMMISSION ON CONDITIONAL USE PERMIT APPLICATION NO. 76-6, APPROVING SAID CONDITIONAL USE PERMIT APPLICATION, AND APPROVING APPEAL NO. 365 FILED THEREON BY PACIFIC OUTDOOR ADVERTISING CO. WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on July 6, 1976 on Appeal No. 365 filed by Pacific Outdoor Advertising Co. in opposition to certain conditions imposed by the Planning Commission upon its approval of Conditonal Use Permit Application No. 76-6. NOW, THEREFORE, BE IT RESOLVED, that based on such public hearing and the oral and documentary evidence submitted therein, the City Council of the City of Santa Ana does hereby approve said Appeal No. 365, approve Conditional Use Permit Application No. 76-6, and modify the action of the Planning Commission thereon by deleting from the conditions of said approval all those condi- tions requiring dedication of right-of-way to the City of Santa ana. BE IT FURTHER RESOLVED, that the City Council hereby adopts as its finding of fact for approval of Conditional Use Permit Application No. 76-6 those "Finding of Fact, Conditional Use Permit No. CUP 76-6" prepared and submitted by the Planning Commission, with the exception that section 7, B, 2, subsections a, b and c, are hereby deleted therefrom. STAFF RECOMMENDATION: Denial COMMISSION ACTION AND VOTE: Approved 6/14/76 AYES: NOES: ABSENT: Commissioners Gosse, Acosta, Ankrum, Yates Commissioners O'Dell, Griset, Winters Commissioners, None REASON FOR ACTION: That the granting of this variance with all attached conditions will not be detrimental to the public welfare or surrounding property and further it will not adversely affect the General Plan of the City. DETAILS OF PROPOSAL: 1. Description of 'Proposal: The applicant proposes to erect three 12'3" x 24L (294 sq.ft.) free- standing off-premise advertising signs on three adjoining vacant parcels of property in the M 1 District. The bottom of thesigns will be 23 feet above grade, and the total height will be 35'3" above grade. The three signs are separated by a distance of 500 feet and 800 feet respectively. All three signs are located 50 feet east of the centerline of Grand Avenue, which in effect places them immediately adjacent to the ultimate right of way for Grand Avenue. The signs will be visible to both north and south bound traffic on Grand Avenue. 2. Area Description: A. Property: Three parcels as follows: Parcel l: 538 feet of frontage on Grand Avenue, a depth of 1,590 feet and an area of approximately 19.6 acres. Parcel 2: 559 feet of frontage on Grand Avenue, a depth of 1,590 feet and an area of approximately 20.4 acres. Parcel 3: 385 feet of frontage on Grand Avenue, a depth of 1,593 feet and an area of approximately 18.8 acres. B. Comparable Applications or Circumstances: Conditional use permit 75-2, llO S. Harbor Boulevard, to permit the establishment of an off-premise advertising sign in the C 2 District was denied by the Planning Commission on 4/15/75 and by the City Council on 5/12/75. E. Surrounding Zoning: See attached SDM. F. Present Use: vacant pPoperty 3. General Plan Compatibility: The General Plan indicates industrial at this location. 4. Staff Evaluation: In evaluating the proposal under consideration, staff took into consid- eration the following: (1) the City of Santa Ana's General Plan, in- cluding the newly adopted Scenic Corridors Element; (2) the designation of Grand Avenue as an arterial street providing two entrance points into the City; (3) the recently adopted ordinance amendment NS-1301 pertaining to yard, landscaping and offstreet parking requirements in the industrial use districts; (4) Section 41-638 of the Santa Ana Zoning Ordinance setting "Standards for granting applications for minor exceptions, vari- ances and conditional use permits and appeals." There are approximately seven off-premise advertising signs along Grand Avenue between Fairhaven Avenue and Dyer Road at present. The total length of Grand Avenue between Fairhaven Avenue and Dyer Road is approximately 4.5 miles. Therefore, at present, there are approximately 1.5 off-premise advertising signs per mile along Grand Avenue, which would appear to be more than adequate to serve the advertising needs of the area. The Scenic Corridors Element Df the City's General Plan identifies Grand Avenue as an arterial providing two entrance points into the City. In discussi.ng the entrance point concept, the Scenic Corridors Plan states that, "An.entrance point or entryway into the City may constitute a con- tinuous treatment along the street or entry point, not merely a single sign." To begin to clutter an arterial street designated as an entryway'into the City with numerous off-premise advertising signs would be a detriment to the City's image. The recently adopted ordinance amendment NS-1301 provided for additional landscaping requirements and for compact parking stalls in the industrial use districts. In discussing the landscape setback requirements, it was stated that: "Landscaped developments are attractive to potential indus- trial occupants and result in increased desirability of the property. This is reflected in higher property values and, hence, revenue to the City. The success, prestige and increased land values of the Irvine Industrial Complex over the past few year~ have been due in no small part to the well landscaped, park-like environment established throughout' the area, an environment created not by one building or one block but by the entire complex." As the proposed off-premise advertising signs are to be located in the southeast industrial area, which presently contains some of the newer and more attractive industrial and office complexes in the City, and as a large portion of the southeast industrial area is still undeveloped, it is staff's feeling that the proposed off-premis~ ~dYertising signs w~u!d be a detriment to and in conflict with the intended up-grading of the City's industrial areas as reflected in ordinance amendment NS-1301. CUP 76-6 Page 2 CUP 76-6 Santa Fe Land Improvement Company" The City's Sign Ordinance states that, u f-premise advertising signs and sign structures are not permitted and shall not be constructed or maintained in any use district other t~an in the C 2, C 3, M 1 and M 2 Districts with an approved conditional use permit." Section 41-638 of the Zoning Ordinance states that, "The Council, Planning Commission and Zoning Administrator may grant according to the procedure outlined in this chapter: (1) conditional use permits for specific uses located at a particular location when it shall be deemed: a) b) to be necessary or desirable to provide a service or facility which will contribute to the general well being of the neigh- borhood or the community; and that such use will not, under the circumstances of the par- ticular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity; and c) that the proposed use will comply with the regulations and conditions specified in this chapter for such use; and d) that granting of this conditional use permit will not adversely affect the General Plan of the City." It is the staff's feeling that the proposed project: a) is not a necessary or desirable service or facility which will contribute to the general well being of the neighborhood or the community~ There are presently seven off-premise advertising signs along Grand Avenue between Fairhaven Avenue and Dyer Road which would appear to be adequate to meet the advertising needs of the area; and b) it will have an adverse affect on the City's General Plan; and c) it would begin to create an undesirable visual image along Grand Avenue. 5. Reasons for Staff Recommendation: A. The proposed project will not contribute to the general welfare of the neighborhood or community. B. The proposed project would have an adveKse effect On the City's General Plan and specifically the Scenic Corridors Element. C. The proposed project would begin to crea~e an undesirable visual image along Grand Avenue. De The proposed project., in conjunction with CUP 76-7, would add five additional off-premise advertising signs along Grand Avenue between McFadden Avenue and St. Gertrude Place, a distance of approximately one mile. 6. If the Commission approves the application, the following standard require- ments must be met: A. Planning: l, 2, 14 B. Public Works: 5 7. The following requirements must also be met: A. Planning * 1) That the sign identified as number 2 on Exhibit A be deleted. * Condition added by the Planning Commission. CUP 76-6 Page 3 CUP 76-6 Santa Fe Land Improvement Company That this conditional use permit shall be subject to review at two-year intervals, at which time the Planning Department shall review the subject premises to determine if the required condi- tions of the conditional use permit have been met and to deter- mine whether or not any problems have arisen due to this opera- tion. The Planning Department may, after the review apply additional conditions. These conditions are subject to review and approval by the Planning Commission and ,City Council. 3) That the architectural design of subject off-premise advertising signs shall be subject to Planning Department review and approval. 4) That the proposed billboards be set back a minimum distance of 20 feet from the ultimate property line on Grand Avenue, in conformance with the recently approved ordinance amendment NS-1301. 5) That the off-premise advertising signs be removed prior to the issuance of any building permits on the subject property. B. Public Works 1) The billboards shall not be located within existing or proposed street right of way. 2) Dedications: a} Grand Avenue: Street easement for a width of 50 feet from centerline to property line. b) Lyon Street: Street easement for a width-of 30 feet from centerline to property line, or 60 feet from property line to property line or realignment, all as.approved by the Department of Public Works. c) Alley: Alley easement for alley corner cutoffs as approved by the Department of Public Works.
