A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA FIXING AND ESTABLISHING
THE COMPENSATION FOR THE OFFICE OF CLERK
OF THE COUNCIL OF THE CITY OF SANTA ANA,
EFFECTIVE JULY 1, 1976, AND REPEALING
RESOLUTIONS INCONSISTENT HEREWITH.
BE IT RESOLVED by the City Council of the City of Santa
1. That the Salary for the office of the Clerk of the
Council of the City of Santa Ana is hereby fixed and established
at $2,050.00 per month.
2. That said salary shall be paid in the same manner
and at the same times as other monthly salaries in the City
are paid, and shall take effect and be paid from and after July
1, 1976.
3. In addition to the salary hereinabove fixed and estab-
lished for said office, said officer shall receive, as additional
compensation, the following employee benefits:
(a) Deferred Compensation.
Effective January 1, 1977, said officer shall
receive as deferred compensation an amount equal to one
percent (1%) of his or her monthly salary. The amounts
contributed by the City under this provision shall be
subject to the terms and conditions of the City
of Santa Ana Deferred Compensation Plan, and subject
further to the conditions that:
i. Said officer shall not have any
vested right in the amounts contributed by the
City until termination of employment with
City;
ii. City will pay the total amount of
contributions plus any earnings thereon to said
officer upon termination, resignation, retire-
ment, dismissal or death.
(b) Health Insurance.
Effective July 1, 1976, the City will contribute
the following amounts toward the payment of the premiums
for said officer and dependents, if applicable, under
the existing health insurance program (or a new pro-
gram providing substantially similar coverage and
benefits):
i. if the officer aforesaid does not
have dependents included under the program,
one hundred percent (100%) of the premiums;
ii. if the officer aforesaid has depen-
dents included under the program, an amount
equal to ninety percent (90%) of the total

premium applicable to the "family plan" cover-
ing said officer and his or her dependents.
(c) Retirement Benefits.
Effective July 1, 1976, or as soon thereafter as
practicable, the City shall amend its contract with the
Public Employees' Retirement System of the State of
California (PERS) so as to improve the retirement program
for said officer by providing military service credit
benefits. Thereafter such officer will be permitted
to exercise the option to "buy-back" or have "bought-
back" on his or her behalf, his or her prior military
service, to the extent permitted and in accordance
with the terms and conditions of Section 20930.3 of
the California Government Code, with such officer being
obligated to "buy-back" all completed military service
occurring subsequent to the effective date of the City's
contract with PERS and the City being obligated to "buy-
back" on behalf of such officer military service occurr-
ing prior to the effective date of said contract.
(d) Option to Convert Termination Payment for
Unused Sick Leave to Health Insurance Benefits
Effective July 1, 1976, such officer shall have
the option to convert that lump sum payment for unused
sick leave benefits available to him or her pursuant to
the provisions of Section 9-169 of the Santa Ana Municipal
Code into an obligation on the part of the City to pay on
behalf of said officer and his or her dependents, if any,
all health insurance premiums for said officer and any
dependents necessary to cause said officer and any desig-
nated dependents to receive the full benefits available
under the health insurance program then maintained by
the City on behalf of its employees and their dependents;
provided, however, that the City's obligation to pay such
premiums shall terminate as soon as one of the following
events occurs:

The payment of said premiums for a period
(5) years beyond termination of employment;
ii. The payment of premiums, after termina-
ation of employment, in a sum equal to one hundred
fifty percent (150%) of the amount of the said
lump sum payment that the officer would have
received for unused sick leave benefits had this
option not been elected.
(e) Carry Over Benefits.
In addition to the benefits specified in
subparagraphs (a) through (d) hereinabove, said
officer shall receive any and all employee bene-
fits which he or she was entitled to receive on
June 30, 1976, by reason of prior action of the
Council, provided and excepting, however, that
the health insurance benefit shall be as provided
hereinabove, and not as it existed on June 30,
1976.

4. Resolution No. 75-140 of this Council, adopted
on September 15, 1975, and any and all other resolutions of
this Council inconsistent herewith, are hereby repealed.
