HomeMy WebLinkAbout76-103REL~ar 8/19/76 RESOLUTION NO. 76- 103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REVERSING THE ACTION OF THE PLANNING COMMISSION ON VARIANCE APPLICATION NO. 76-35, APPROVING SAID VARIANCE APPLICATION, AND APPROVING APPEAL NO. 366 FILED THEREON BY PHYLLIS WHEELER WHEREAS, a public hearing was duly held before the City Council of the City of Santa Ana on August 16, 1976 on Appeal No. 366 filed by Phyllis Wheeler in opposition to the Planning Commission's denial of Variance Application No. 76-35; NOW, THEREFORE, BE IT RESOLVED, that based on such public hearing and the oral and documentary evidence submitted therein, the City Council of the City of Santa Ana does hereby reverse the action of the Planning Commission denying Variance Application No. 76-35, does hereby approve said variance application subject to conditions as hereafter set forth, and does hereby approve Appeal No. 366. BE IT FURTHER RESOLVED that the City Council hereby adopts as its findings of fact for approval of Variance Application No. 76-35 those "Finding of Fact, Variance Applica- tion No. 76-35" prepared and submitted by the Planning Commis- sion attached hereto, and that said variance application is approved on condition of compliance with all requirements set forth therein. BE IT FURTHER RESOLVED that said variance appli- cation is approved on the additional condition that this var- iance shall be submitted for review by this Council at the expiration of twelve months hereafter, at which time this Coun- cil may supplement or modify the conditions of approval or initiate revocation proceedings for noncompliance with such conditions. Diane Tasch ADDRESS & ZONING: 802 North French AP 6-045-08 R 3H HD II District SDM 7-5-g VA PURPOSE: To convert an existing house into an office in the R 3H HD II District. The General Plan indicates high density residential and this would be a further intrusion into the residential area with an office use. B. There is a great amount of land in the City that is zoned for office use that is presently undeveloped. DETAILS OF PROPOSAL: 1. Descrtpti'on of Proposal: The applicant proposes to convert an .existing residence to an office use as follows: office space: 945 sq.ft. reception and lobby: 7§7 sq.ft. secretarial: 196 sq.ft. kitchen: 168 sq.ft. · numerous storage closets parking provided: l0 standard offstreet parking stalls and 1 compact car space; parking required, 9 offstreet parking spaces Area Description: A. Property: Subject property has 80 feet of frontage on French Street and 125 feet of frontage on Eighth Street and contains approximately 10,000 sq.ft. B. Surrounding Development: Ce North: single family residence East: apartments, office building and single family residence South: single family residence West: apartments and single family residence Street System: French and Eighth Streets are both local streets. O. Comparable Applications or Circumstances: VA lOO1 in 1958 permitted the property at 801 North French to be used as an office. VA 76-35 Lovell L. and P. Diane Tasch E. Surrounding Zoning: See attached SDM. F. Present Use: single family residence General Plan Compatibility: The General Plan indicates High Density Residential for the area under consideration. 4. Reasons for Staff Reconeendation: A. The General Plan indicates High Density Residential and this would be a further intrusion into the residential area with an office use. B, There is a great amount of land in the City that is zoned for office use that is presently undeveloped. If the Con~ission approves' the application, the following:standard require- ments must be met: A, Planning: 1, 2, 3, 4, 13, 14 B. Public Works: l, 5, 10, 16, 2lc, d, 22c, 27, 28, 43 6. The following requirements must also be met: A. Planning 1) 2) A 6-foot high, 6-inch wide decorative block wall be constructed along the north and west property lines. Said wall shall not exceed 4 feet in height within 20 feet of any street right of way. Exterior of the bui!ding~shall be painted in a manner meeting the approval of the Planning Department, if needed. 3) Any signs on the office building shall meet with the requirements of the p {Professional) zone in the sign ordinance. Any modification to 5utldtng exterior design must maintain a resi- dential appearance and must meet with the approval of the Planning Department. B. Public Works Dedications: Street easement for a 15-foot radius Spandrel at the northwest corner of French and Eighth Streets. 2) Improvements.: a) French Street: Replace any poor sidewalk as required by the Department of Public Works and place sidewalk in the spandrel area at the]northwest corner of French and Eighth Streets.. NOTE: Minimum width drive approach is l0 feet in the flat. b) Replace curb return and sidewalk at the northwest corner of French and Eighth Streets to include a wheel chair ramp. NOTE: Curb returh radius to be determined at a later date. c) Eighth Street: Replace any poor sidwalk as required by the Department of Public Works. NOTE: Developer responsible if any relocation of "guy pole" re- quired for drive approach. d) Developer must remove street trees adjacent to the proposed drive approaches after written approval is obtained from the Parks Department. Standards l0 and 96 2) Floor plans incorporating the above codes shall be submitted to the Fire Department showing locations of portable fire ex- 'ttnguishers with 2A rated all-purpose extinguishers on each floor and automatic dry chemical fire extinguishers in the hoods and ducting over cooking areas. Police Department 1). A silent alarm system for burglary be installed. 2) All exterior doors be solid core in design. 3) Doors which have glass within 40 inches of the locking device · shall be equipped with a double cylinder deadbolt lock with a minimum one inch throw. 4) All exterior doors with glass 40 inches or more from the locking device may be equipped with a single or double cylinder deadbolt lock with a minimum one inch throw. s) Doors with exterior exposed hinge devices shall be equipped with devices to prevent the door from being removed by by-passing these hinges, subject to the approval of the Police Department. 6) All windows shall be secured with an auxiliary locking device and must meet with the approval of the Police Departm, ent. .7) 8) Exterior doors have lighting devices sufficient to illuminate the door and doorway and that such lighting be equipped with 60 watt incandescent light bulb. ~ The building be clearly 'identifted by street number address.
