Invocation was given by Reverend Garland Lacey of the Wilshire Presbyteriau Church. Each member of the City Council having received copies of the Minutes of August 19, 1957, reading of the Minutes was dispensed with and approved on motion of Counc~lm~u Hubbard, seconded by Gould and carried. Hearing This being the date set for hearing and no protests having been received, the Amendment J. Wayne Harrison Ordinance sm~-odm~nt application of J. Wayne Harrison was considered for the reclassification frc~ R-1 District to C-2 District of property situated on the west side of Cypress Avenue between Central Avenue and the Pacific Electric Railroad. On motion of Counc~lm~n Hall, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance amending Article IX of the Santa Aha Municipal Code creating changes in district boundaries, and amending Sheet No. 43 of the Districting Map to show the reclassification" Hearing Amendment No. 227 Initiated by Planning Commission - Ordinance was introduced, considered and placed on file for second reading. This being the date set for hearing and no protests having been received, the amend- merit application initiated by the Planning Co~t ssion was considered, proposing that propertY k~own as the Croddyland No. 2 (excluding that portion east of the new Fair- view Road) and the Segerstrom No. 3 annexations be reclassified from the R-1 Distric to the M-1 District. Said property is situated east of Harbor Boulevard, north of Huntzinger Avenue, south of Harvard and appro×~tely lll5 feet west of the Old Newport Road and consists of a total of approximately 297.6 acres. On motion of Councilman Hubbard, seconded by Gould and carried, the following Ordinance entitled "Ordinance amending Article IX of the Santa Aha Municipal Code creating changes in district boundaries, amending Sheets No. 5~, 61, 62 and 65, and adding Sheets No. 66 and 68 of the Districting Map to show the reclassification" was introduced, considered and placed on file for second reading. 31.5 Hearing Amendment Margaret L. Rodger Howell requesting that action on the matter be postponed until the next Ngw~l--w meeting of the City Council. J.K.Johnston and Tom Cox spoke on behalf of the protestants. On motion of Councilman Hubbard, seconded by Gould and carried, the hearing was continued until September 16, 1957. This being the date set for hearing on the amem8ment application of Ray B. Price for reclassification of property situated east of McClay Street, approximately 990 feet south of McFadden Street, with a frontage of approximately 265 feet on McClay from R-1 to M-1 District, Street and a depth of 1616.5 fee~_~ consisting of approximetely 12 acres, it was moved by Couneflman Hubbard, seconded by Gould and carried, that the hearing be con- tinued until September 16, 1957. This being the date set for hearing on the amendment application of Margaret L. for reclassification of property situated south of Hobart Street and w~st of the James Madison School, and north of the easterly extension of Edinger Street, at a depth of approximately 300 feet west of the west side of the School property, known as Parcel No. l, from the R-1 District to the R-3 District, and reclassification of property situated west of Standard Avenue, north of St. Andrews Place, fronting on Standard Avenue and c~encing at a point south of the intersection of Standard Avenue and the easterly extension of Edinger, known as Parcel No. 2, from the R-1 District to C-2 District, it was moved by Counci!m~ Hubbard, seconded by Gould and carried, that the hearing be continued until September 16, 1957. This being the date set for hearing on the amendment application of Antoue Borchard for reclassification of property situated south of Delhi Road, west of Bristol Street and 250 feet north of Talbert Road with a depth of approxfm~tely 1700 feet west of Bristol Street, from the R-1 District to the M-1 District, Opinion No. 200 of the City Attorney dated August 2~, 1957 was read reference function of Plan~lng Corem1 ssion and City Council in Zone Change. On motion of Councilman Hall, seconde~ by Hubbard and carried, Opinion No. 200 was received and filed. Approximately seventeen persons stood in protest against the reclassification of the property. A. L. Oliver, 215 East Delhi Road objected to the zoning stating it is the wrong side of town for industry and it will bring smog and foul air over the City, and there is plenty of land in the southeast part of town which is available for indust~ ~lso, the people were informed the Revere Copper Company plant would be a modern b,,~!ding but it looks like a hay barn, but was of the belief that the Electro-Data building would be an asset to the community and had no objection to the constructioz Mrs. Dean Wright, 2~3 South Shelton asked various questions reference the rezoning of the property and inquired if the property had been posted for the annexation. Her questions were answered by the Mayor. E. Bi, w-bower, 920 South Cedar, said he owns property in the area and is in favor of the industry and it will bring decent wages to the factory workers. Jack Diamond, 2128 South Van Ness Avenue stated the Revere plant is a disgrace to the City and congratulated Counc!lm~ ~arkel on his efforts to keep Electro-Data from locating in the southwest section of the City. Novel J~m~s, Industrial Coordinator, gave facts and figures on how the multi-million dollar plant can help Santa Aha by keeping the tax rate down. A.C. Misslldiue gave his opinions on the location of the plant. Frank Gelinas, Secretary-~n-ger of the Chamber of Commerce stated the City ca~ot affor~ not to have the plant in this district. Numerous persons gave their reasons why they objected to the establishment of the Electro-Data plant and other persons gave~ reasons why they favored the industry. On motion of CounciLman Hubbard, seconded by Ha! ! and carried, the hearing was continued until October 7, 1957. ~his being the date set for the continued hearing on the adoption of the proposed Civil Service Rules and Regulations, no protests w~re received and on motion of Counc~ lm~ Hubbard, seconded by Markel and carried, the following Ordinance entitle "Ordinance No. NS-277 repealing Chapter 2 of Article II of the Santa Aha Municipal Code, and adopting by reference Civil Service Rules and Regulations to carry out the intent a~ purpose of the Civil Service provisions of the Charter of the City of Santa Aha" was considered and passed by the following vote: Royal E. On recommendation of the Acting City Manager and on motion of Councilman Markel, seconded by Gould and carried, the bid of Sully-Miller Contracting Company was accepted and the other bid rejected. A tabulation of bids was presented by the Acting City Manager for the widening and resurfacing of South Main Street from Walnut Street to First Street, Project Nc.lOC as follows: Sully-Miller Contracting Company Total $11,803.40 Certified check $1250.00. William Risko, 915 West Berkeley Street presented a petition signed by approximately fifty persons protesting the variance and stated the property should remain as R-1 District. Two persons stood in protest. On motion of 001A~ctlm~n Gould, seconded by Nubbard and carried, the recommendation of the p]anntng Cr~m, tssion was approved and the variance of ~ain & Washington, Inc., granted to pemit the construction of a building consisting of 6,750 sq,,~e feet on property at 1318 North Main Street, to be used by the Goodyear Tire & Rubber Company for a retail outlet store for the sale of their products, including the recapping of tires, subject to conditions of the Depa~aent of Public Works and the Cc~mission. On motion of Councilman Hubbard, seconded by Gould and carried, the rec~ndation of the Planning 0o-,,1 ssion was approved and the variance of Mrs. Anita Gal ]egos granted to permit the construction of two duplexes on property located at the south- west corner of Delhi Road and Evergreen Street, in an R-1 District, subject to con- ditions of the Co~nission and the Department of Public Works. C~ication was read from the p~anntug C~m~ission rec,.~.,~nding denial of variance application of J~m~s E. Serven to permit conversion of existing accessory b,,t~ding on property located at 319 East Harwood Place, presently used as a gun shop, into a single-f~m~]y dwelling, decreasing the rear-yard requirements to five feet, in an R-1 District. On motion of Councflm~n Gould, seconded by Hubbard and carried, action on the variance was continued until September 16, 1957. C~*w~unication was read fr~n the Planning C~ission recommending denial of variance application of Edward J. and Velm~ V. Naffziger to permit construction of a duplex on property at 22~0 South Flower Street, in the R-1 Zone. A protest petition signed by approximately twenty-three persons and protests of Mrs. S.L.Beall and Mr. and Mrs. L.J.Ferrier were read and on motion of Councilman Hubbard, seconded by Markel and carried, the protests were received and filed. On motion of CO~IlCtlman Hubbard, seconded by M~rkel and carried, the recommendation of the Planning C~mmiss~ was approved and the variance denied. Cc~m~unication was read from the Planning Co,.,tssion recommending denial of variance application of Mr. and Mrs. Jerry ~aHn to permit construction of a two-story, eight- unit apartment building on property on the northeast corner of South Flower Street and West St. Gertrude Place, consisting of two vacant lots, with 98 foot frontage on Flower Street and 137 foot frontage on St. Gertrude Place, in an R-1 District. Four persons stood in protest. Charles E. Appleton, owner of one-half of the property spoke in favor of the variance. On motion of Counct 1man Gould, seconded by Markel and carried, the recommendation of the Planning C~mm~ ssion was approved and the variance denied. Communication was read frmm the P~nning C~mmission recommending denial of variance application of Bernard and Rebecca Resnicoff to pemit construction of two duplexes, one bedroom each, on property at lll6 Cypress Avenue, in an R-2 District, but approved construction of one duplex on rear part of the lot, subject to certain conditions. On motion of CouncLlman Gould, seconded by Hubbard and carried, the rec~ndation of the Planning Cnmmission was approved and the variance denied. Cnmmunication was read from Glenn M. Layton of Layton Sof-Water Cc~pany requesting the amendment of Section 1009 of the 1955 Edition of the Uniform Pl~bing Code to ,11ow those engaged in the business of installing and servicing rental type water softeners to continue to operate as in the past, instead of being required to use Journeyman plambers to install water softeners. On motion of Counci]msn Gould, seconded by H-11 and carried, the matter was referred to the City Attorney and ..Director of Building Safety for the purpose of draft!nE an ~m-ndment to the 0rdinan¢ Co~Eunication was read frc~ Attorney Delbert L. Larsh setting forth twenty-five par cels of properties on North Bristol Street between Fifth Street and Washington Avenue and offering a compromise settlement price on each parcel. On motion of Counctlm~n Hall, seconded by GoUld and carried, the Attorney was instructed to open escrows on the particular properties for the settlement of the claims. Hubbard Absent, Councilmen None It was moved by Counc~]ma~ Markel, seconded by w,]l and carried, that the following policy be adopted by the City Council relative to City participation in connection with street improvements: "The City of Santa Aha will improve nine (9) feet each side of the center line of residential streets that side to property where ~11 the follow- conditions are met: 1. The street has been dedicated to the City and accepted by them prior to adoption of this policy. 2. The street was open and used as a public street prior to adoption of this policy. The property which sides to the street sh~l 1 have been split into parcels (by metes and bounds) or into lots by tracts prior to June 30, 1954, and is not subject to further subdividing in the future. This policy wfl ~ apply only to that portion of the street that sides onto the lots or parcels and will not apply to the front of lots or parcels. ~he front of the lot or parcel is defined as the narrowest dimension of the property on a public street. This policy will not apply to Assessment Districts. On motion of Councilman Hubbard, seconded by Gould and carried, the Mayor was authoz tsed to execute agreement with Brynley B. Neinly None 0n motion of Councilman Hubbard, seconded by Gould and carried, the following communications w~re received and filed: From the State of California giving notification of termination of Lease No. 32~2 dated September 28, 1954, that the premises at 625 Cypress Avenue will be vacated on or before September 30, 1957, From the Metropolitan Water District of Southern California enclosing a tabulation showing the assessed valuations, percentage participation, and vote entitlement of constituent municipalities of the District as of August 20, 1957, From the Metropolitan Water District of Southern California submitting a certified copy of Besolution 5039 adopted by the Board of Directors, levying a tax for the fiscal year 1957-58 upon taxable property taxable by the District and including taxable property lying within the City, and From the State Division of Highways requesting the Department of Public Works to undertak~ a study to provide a basis for an over-a~ 1 plan of freeways and express- ways in the State, which plan will not be limited to State Highways. Communication was read from L.J.Nolmberg, 618 Cypress Avenue,~ calling attention to the deplorable and 8~ngerous condition of the sidewalk in front of 1659 East First Street. The Acting City Manager reported that the condition has been corrected and on motion of Co11~cflm-~ Hubbard, seconded by Gould and carried, the c~unicatJ was received and filed. Coemmmication was read frc~ Harry G. and Lillian K. Jeffers, 131 North Lyon Street on behalf of all the neighbors in the district, protesting against Case-Swmyne Company, Inc., using p,!m Street to stack cans and run tow-motors in and out for loading and ,reloading every five to ten minutes to 2:00 A.M. and 3:00 A.M., racing motors and blowing horns. On motion of Counci!m~n Hubbard, secoDxled by Fa11 and carried, the matter was referred to the Mayor for the purpose of directing a lette~ to Case-Swayne Co. Inc. c~]ling attention to the complaints of residents in the area protesting the use of p, lm Street in con~ction with the plant operation a~i the attendant noises of trucks, automobiles and personnel leaving the premises. Commmmication was read from Daniel R. Casper requesting the return of the Loyalty Oath which he signed when employed by the Park Department and objecting to the word "defend" in the oath. On motion of Counci]m,- Hubbard, seconded by Gould and car- ried, the Manager was directed to advise Mr. Casper that the loyalty oath is a par~ of the official files of the City and c,nnot be returned.
