L~re sent: Councilmen Absent: Councilmen Royal E. Hubbard, Stenley C. Gould, Jr., A.A.Hall, J. Ogden Markel, Dele H. Eeinly None The Pledge of Allegiance was given. Invocation was given by Reverend Robert P. Shuler, Jr., of the First Methodist Church. Each member of the City Council having received copies of the Minutes of September 3rd, 1957, reading of the Minutes was dispensed with and approved on motion of Councilmen Hubbard, seconded by Gould and carried.. Opening of bids Vehicle Parking District No. 1 This being the time and place fixed for the opening of bids on eighteen bonds in the total amount of $58,491.28 of Vehicle Parking District No. l, on motion of Councilman Hubbard, seconded by Meal and carried, the Clerk was authorized to open the bids ,and the following bids received purs~Bt to the notice of sale were publicly opened, examtued and read: Opening of bids Library Bonds, 1957 First California Company: Proposal, in terms of a net bid for the bonds is $60,026.13. April 24, 1957 and bear interest at the rate of 6% per annum. the sum of $1,800.78 accompanied bid. Bonds are dated Cashier's check in Taylor and Company: Propose to pay $$8,491.28 which is the par value thereof, for bonds bearing interest at the rate of 6% per annum, plus accrued interest to the date of delivery, plus a premium of $777.93. This being the date set for hearing protests on ~nnexation to the City of certain uninhabited territory designated "~! 1 ivan and Willits West of Annex", and there being no protests, on motion of Cou~ctlma~ Hubbard, seconded by Markel and carried, the following Ordinance entitled: "Ordinance declaring the ~nnexation of that certain territory designated 'Sullivan and Willits West of Annex'" was introduced, considered and placed on file for second reading. This being the date set for hearing protests on annexation to the City of certain uninhabited territory designated "Fairview and Raitt S. W. Annex", on motion of Councilman Hubbard, seconded by Markel and carried, the hearing was continued until October 2.1, 1957. This being the date set for the continued hearing on amendment application of Margaret L. )~al~ for reclassification from R-1 to C-1-PK D~strict, of property situated on the southwest corner of the intersection of McFadden Street and Standard Avenue, with a frontage of 175.5 feet on McFadden Street and 3~3 feet on Standard Avenue, J.K.Johnston, on behalf of approximately fifty-two persons, stated a petitio~ was presented to the Planning Conw, i ssion containing approximately fifty signatures protesting the rezoning. On motion of Counc~!m~u Gould, seconded by Hubbard and carried, the petition was received and filed. Mr. Johnston stated the property was zoned for residences only at the time of purchase of the original lots and it should so remain; there is no need for one parcel of property to be rezoned for one who doe not even reside in the vicinity of the proposed rezon!ng. Also, the corner will be a ma intersection for children who will attend the new school directly to the sout~ of and will create a more hazardous traffic condition as well as devaluation/properties The Mayor requested the protestants who had not signed the petition to stand. Two persons stood in protest. Bert Rys~m~-~ Mrs. Glen Graves, Mrs. Eenneth Turtenw~ld and Mrs. Rose Fenster objected to the rezoning as the location of a business will incur more traffic problems, the close proximity of a business to their homes is undesirable and the property should remain R-1 District. Attorney Rodger Howell, representing the applicant, stated he was not aware there would be such strong opposition to a commercial use. The plans are to erect a service station on the property as it is an odd size lot making it undesirable for residential purposes. Edward L. N-~ 1 stated he had been misquoted at the Planning Coemaission hearin~ and is interested in the safety of ,1 ] children; there are no residences facing Standard Avenue which is a cul-de-sac street. Also, there are no sidewalks and agreed to meet all requirements of sidewalks. On motion of Councilman Gould, seconded by Markel and carried, the amendment application of Margaret L. Hall was denied and the applicant granted permission to file a variance. This ~eing the date set for the continued hearing on the amendment application of Ray B Price for reclassification of property situated east of McClay Street, approx ~m8tely 990 feet south of McFadden Street, with a frontage of approximately 265 feet on McClay Street and a depth of 1616.5 feet, from the 1t-1 District to the M-1 District; no protests were received. On motion of Counc~lm~n Markel, seconded by Gould and carried, the amendment application was denied. 32 5 Continued hearing Amendment Margaret L. Hall Ordinance Record of Survey Pacific Southwest Realty Co. Reso. No. 57-239 Accept Grant Deed Pacific Southwest Realty Co. Reso. No. 57-240 Awarding Bonds Library Bonds, 1957 This being the date set for the continued hearing on the amenM~nt application of Margaret L. Na!? for reclassification of property situated south of Nobart Street and west of the J~s Madison School, and north of the easterly extension of Edinger Street, at a depth of appro~m, tely ~00 feet west of the west side of the School property, known as Parcel No. 1, from the R-1 District to the R-S District, and re- classification of property situated west of Standard Avenue, north of St. Andrews Place, fronting on Standard Avenue and commencing at a point south of the inter- section of Standard Avenue and the easterly extension of Edinger, known as Parcel No. 2, from the R-1 District to C-2 District; no protests were received. It was moved by Councilma~ Hall and seconded by Hubbard that the reclassification of property as indicated as Parcel No. 1 be denied and that the westerly portion of th~ School property be retained as R-1 District. Motion withdrawn. It was moved by Councilman Gould and seconded by N~I ~ that the hearing be continued until October 21st reference the rezoning of property indicated as Parcel No. 1. Motion withdra~ Attorney Rodger Howell requested permission to withdraw the amendment application as to the effect on property known as Parcel No. 1, Amendment No. 225, and on motioz of Councilman Nal 1, seconded by Hubbard and carried, the request for withdrawal of application pertaining to property known as Parcel No. 1 was approved. Edward L. ~11 agreed to extend Evergreen Street north to Edinger Street and Cedar Street north to Edinger Street and improve the same when improvements are made on the property. It was moved by Councilm~n G~uld, seconded by Hubbard and carried, that an Ordinance be passed to second reading for the reclassification of the portion of the property westerly of the northerly prolongation of the west curb line of Cedar Street to R-2 District; that portion lying between Cedar Street and Evergreen Street if the streets were extended, and Edinger Street be reclassified as R-B District; that the area between Everg~en Street and Standard Avenue, Edinger Street on the north and the property line on the south be rezoned to C-1 District. On motion of Counc~lm~n Gould, seconded by Hubbard and carried, the following Ord~ueBce entitled "Ordinance amending Article IX of the Santa Aha Municipal Code creating changes in district boundaries, and amending Sheet No. 56 of the Districting Map to show the reclassification'' was introduced, considered and passed to second reading. On motion of Councilman H~!, seconded by Markel and carried, the Record of Survey Map submitted by Pacific Southwest ~ealty Company on property located at the south. east corner of Bristol Street and Delhi Road, being one lot, was approved, check in the sma of $1~00.00 accepted as deposit for street and sidewalk improvements, an~ proper officials authorized to execute the agreement. The Council having unanimously waived the reading of the Resolution, on motion of Counc~ lmsn ~al 1, s~conded by Markel and carried, the following Resolution entitled: '~esolution No. 57-239 accepting Grant Deed" from Pacific Southwest Realty Company, for an easement for street purposes on property located at the southeast corner of Bristol Street and Delhi Road, being om lot, was considered and passed by the following vote: Ayes, Counci~men Royal E. After considering the various bids and the report thereon, it was moved by Counc~lm~n Markel, seconded by Hubbard Reso. No. 57-241 Awarding bonds Vehicle Parking District No. i Bonds and carried, the following Resolution entitled: "Resolution No. 57-240 of the City Council of the City of Santa Aha awarding $700,000 bonds of said City to the best bidder and rejecting all other bids" was considered and passed by the following vote: Ayes, Councilmen Noes, Councilmen Absent, Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., A. A. w~l 1, J. Ogden Markel, Dale H. Heinly None None, and Resolution No. 57-240 was declared adopted. The committee appointed to check and compute the bids on the bonds for which bids were opened previously durfng this meeting reported that the bid of Taylor & Compaz was ~,al ified, but not the best bid. A representative of Dempsey-Tegeler & Co. requested permission to withdraw their bid for an excusable mistake. It was movedill by Couscdlm-~ Hubbard.and seconded by Gould that the bid of Dempsey-Tegler & Co. Variance Vahan Apelian be accepted. The Mayor stated that the three bidder concurred in the award of the bid to First California Company and expressed their complete agreement that the bid should be so awarded. Ogden Markel Absent, Councilmen None Communication was read from the PlannfBg C0~!ssion recommending approval of varian applicatiun of Vahan and Arpine Apelian to permit the construction of two duplexes on property at 1702 South Flower Street, in the R-1 District, subject to condition~ William Risko, 915 West Berkeley Street, objected to the variance and stated a petition signed by approximately fifty persons was presented at the previous meetiz and the protest should be given consideration. B.L.Nofferhert, 901 West Berkeley Street said he would not have ~ objection if there was only one house on the front of the property and a duplex at the rear of the lot. Vernon L. Springer, 909 West Berkeley Street, also objected to the duplex and the men~er in which the property is mapped out for future construction. Webb Brown, representing the applicant, stated the duplexes will be approximately 100 feet ~o~ ~t~ garages would be on the rear of the lot. It was moved by Counci!m~n~d~ .~s conded by Hubbard, that the recummendation of the Planning Commission be approved and the variance granted subject to the conditions as set forth by the Coamaission. Hoeppner granted to permit construction of an addition to existing single-family dwelling on property at 438 South Baker Street, in an R-1 zone, decreasing the rear~ yard requirements 2 feet six inches. On motion of Councfl~an Hubbard, seconded by t;~11 and carried, the recommendation of the Planntng Con~ission was approved and the variance of Lyle W. Bryant granted to permit construction of four triplex units on property situated at 2201-2205 Kilson Drive, and 2202-2206 Hickory Street, in an R-1 Zone, subject to condition of the Planning Commission. On motion of Counc~m~n Gould~ seconded by Hubbard and carried, the letter and petition were received and filed. Two persons gave reasons why a Crossing Guard should be stationed at the intersection.
