Invocation was given by Reverend Robert Mays of the Church of the Brethren.
Each member of the City Council having received copies of the Minutes of
October % and October 14, 1957~ reading of the Minutes was dispensed with
and approved on motion of Councilman Hubbard, seconded by Hall and carried.
Overtime payment
to Police Officers
Council~n Gould stated that, Whereas, it has come to the attention of the City
Council that oert~in of the members of the Police Department have claimed certain
accumulated overtime hours and
Whereas, the City Council does hereby acquiesce in the present policy of the
Department in not permitting more than forty hours accumulated time off privilege
during service with the Depa~-~ment since January l, 1957,
Therefore, in order to clear the record of a~l questioned claims and to provide an
equitable and fair settlement of these claims for overtime and to compromise the
same, it was moved by Councilman Gould, seconded by Hubbard and carried, that all
overtime recorded as "compensatory time off" be paid in cash on or before November
15, 1957, to the officers presently on duty with the Department from August 20, 1951
to date, at the rate of pay that the officer would have received for the hours when
worked; that the City Ma~ager be directed to pay the same, not to exceed
and that the funds necessary to accomplish this purpose be transferred from the
Unappropriated City Council Fund to the appropriate Police Fund or Funds.

On rec~maendation of the Manager and on motion of Councilman GOuld, seconded by
Markel and carried, action was continued until the next regular meeting on the award
of bid for the construction of pavement, curb and gutter, on uncompleted portions
of Wilshire Avenue from Bristol Street to Olive Street and Russell Avenue from
Rosewood Avenue to Lowell Street, Project C-22.

This being the date set for the continued hearing of protests on annexation to the
City of certain m~nf~habited territory designated "Fairview and Raitt S. W. Annex",
r~quest was read from Hitoshi Nitta and Jay Brooks for postponement of action for
approximately sixty days, and on motion of Councilman Markel, seconded by Gould and
carried, the hearing was continued until December 16, 1957.
This being the date set for hearing on the amendment application of ~{ugh T. Walker
for reclassification of property situated on the north side of McFadden Street,
beginning at a point 778 feet east of the northeast corner of Halladay and McFadden
Streets, with a frontage of 397.68 feet on McFadden Street and a depth of lll4.10
feet, from the R-1 to the R-3 District, eight persons stood in protest. Mr. Riple~
854 East Wisteria Place, stated there should be a buffer zone for the R-1 District
fronting on their property and buffer zones for the R-2 District to proposed
Standard Avenue and R-3 District on the east side of Standard Avenue; also proteste(
the original application but stated if the applicant confo~ns to the recommendation
of the Planning Commission the property owners would not object. Mr~ John K.
Johnson, 854 McFadden Street, on behalf of a group of property owners, stated they
are in accord with the recommendation of the Commission but objected to four units
on one lot. Attorney James Turner, representing the applicant, said the plan, as
recommended by the Commission, is not feasible to the applicant; the apartments
will be one bedroom apartments rented to families without children and with a four-
lane street there will be no traffic problems. On motion of Councilman Gould,
seconded by Hall and carried, the recommendation of the Commission was approved and
the following Ordinance entitled:

was introduced, considered and passed to second reading.

This being the date set for hearing on the amendment application of Ralph J. Mitche~
for reclassification of property situated at the southwest corner of the intersecti~
of Chestnut and Lyon Streets, extending south from Chestnut Street 536 feet and
extending westerly from Lyon Street 240 feet, from the R-1 to C-2 District, the
Clerk read communication from Elmer F. and Mary M. Thompson protesting the rezoning
and on motion of Councilman Gould, seconded by Hubbard and carried, the communicatic
was received and filed. Attorney J. R. Moore, representing Colonel Lester Harris,
stated his client lives immediately to the south of the property under consideratioi
Also, any bedroom windows would be 12 to 14 feet from the commercial zone and there
is no commercial property on Lyon Street, and he understood that it has been the
policy not to have C-2 property abutting R-1 property. Attorney Fred Johnston,
representing the applicant, requested consideration of the letter from Santa Ana
Lodge No. 794 B. P. 0. E., favoring the reclassification, and on motion of Councilm~
Hubbard, seconded by Hall and carried, the con~unication was received and filed.
Attorney Johnston stated that aerial photographs have been filed showing the result
of the increase in commercial use. Hearing declared closed. It was moved by
Councilman Gould, seconded by Hubbard and carried, that the hearing be reopened.
Novel James stated the Electrical Company is progressing to the point of purchasing
the property. It was moved by Counc~lms~ Hull, seconded by Hubbard and carried,
that the property as outlined in the map be rezoned from R-1 to C-2 District, 'and
the following Ordinance entitled:

On motion of Councilman Hall, seconded by Hubbard and carried~ the recon~nendation of
the Pl~ing Commission was approved and the variance of Vahan and Arpine Apellan
granted to permit the construction of two duplexes on property at 1702 South Flower
Street, in the R-1 District, subject to four conditions of the Commission.
On motion of Councilman Hubbard, seconded by Markel and carried~ the recommendation
of the Planning Commission was approved and the variance of the Latin ~merican
Assemblies of G~d was granted, to permit construction of a Church and Sunday
School on property situated on the north side of Willits Street, beginning at a
point ll~ fe~t east of the northeast corner of the intersection of Nottingham
Avenue and Willits Street, thence extending 330 feet east on Willits Street, and
north for a depth of 316.41 feet, in an R-1 District, subject to conditions of the
Commission and the Department of Public Works. The representative of the Church
requested permission to postpone construction of required street improvements for
approximately one y~ar, due to lack of funds,and it was suggested that he investigat~
the possibility of filing a bond covering the costs.

Communication was read from Attorney John D. Cochran on behalf of Dr. Jerome J.
Krueger for permission to change the shape of the medical office building to be
constructed at the southwest corner of Flower Street and Washington Avenue, in
order to provide for additional off street parking facilities; Variance No. 866
having been granted by Resolution 57-38. On motion of Councilman Markel, seconded
by Hubbard and carried, the request to amend Variance of Dr. Krueger was granted to
change the shape of the buildi~ and construction approved according to the plot
plan submitted.
Communication was read from the Planning Commission recommending denial of variance
application of John T. and Lula G. Allison to permit construction of a garage-duple~
(consisting of four garages with a one-bedroom duplex over them) on rear part of
lot situated at lll4 South Birch Street, in an R-1 District. Paul Eby, lll5 South
Ross Street, objected to the variance stating the area is a very desirable
District and should so remain; the construction of the garage-duplex would
materially downgrade the area and there would be three residences on the lot with
one ingress and egress to the garages. On motion of Councilman Hubbard, seconded
by Markel and carried, the recommendation of the Commission was approved and the
variance denied.
Communication was read from California Bank approving the rotation of the "General
Fund" of the City of Santa Ana to the three banks mentioned: First two years,
California Bank, next two years, Security-First National Bank of Los Angeles and the
next two years, Bank of ~merica. On motion of Councilman Hubbard, seconded by
Gould and carried, the communication was received and filed. It was moved by
Councilman Hubbard and seconded by Gould, that effective January l, 1958, the
demand account of the City of Santa Aha now on deposit with the First Western Bank
be rotated among the four banks of the City for two-year intervals and that said
banks shall have such accounts according to the following priority; the California
Bank, Santa Ana Branch, shall have the account from January l~ 1958 through Decembe~
31, 1959; the Security First National Bank of Los Angeles for the next two years an~
the Bank of America, National Trust and Savings Association, Santa Ana Branch, for
the following two years. After completion of the third two-year period~ the fund
shall be deposited with the First Western Bank for two years and thereafter rotation
in said order shall be continued until further order of the Council. Merle Boyle
Vice-President of First Western Bank, stated the Bank had not been notified in re-
gard to this matter and was not in accord with the rotation plan. The Gity accoun
have been handled for many years and felt that good service had been rendered.
Councilman Hall stated the rotation plan would involve an expenditure of approx-
imately $383.00 in the purchase of necessary forms, checks~ etc. and did not feel
the City funds should be distributed to the various banks. Counc~lm~n Gould amended
the motion, seconded by Hubbard and carried, that no such rotation shall be made to
any bank which does not have on deposit "time deposit" bearing same interest rates
as offered by other banks or is willing to accept time deposits at the same rate
offered by the other banks provided for in the rotation plan.

Communication was read from Attorney C. Arthur Nisson, Jr., on behalf of Murphy K.
Zlaket requesting the abandonment and vacation of a portion of the 14.75 foot alley

ision, north of 20th Street, and on motion of Councilman Hubbard, seconded by Hall
and carried, the request was referred to the Planning Co~ission for reconmmendation.

to the Council and Officials to attend the 34th annual American Municipal Congress

On motion of Councilman Hubbard, seconded by Hall and carried, the bond filed by
John A. Siegel et al, in the sum of $14,000.OO and filed for the improvements on
Fruit Street between Grand Avenue and the Freeway, in Tract No. 3226, was ordered
released and improvements accepted as completed.
On motion of Councilman Hubbard, seconded by Gould and carried, the plans and
specifications were approved for the paving of Delhi Road from Harbor Boulevard to
Fairview Road (existin4;), Project C-lO.
On motion of Councilman Hubbard, seconded by Markel and carried, the P~rchasi~
Agent was authorized to advertise for bids for the construction of street improve-

On motion of Councilman Hubbard, secon&ed by Hall and carried, the application of
Educational Committee of The Council of Churches of Santa Ana for permission to
solicit funds October 31, 1957, was granted.
On motion of Councilman Hubbard, seconded by Hall and carried, proper officials
were authorized to execute lease dated October 21, 1957 with Toastmasters Inter-
national for rental of additional rooms knowu as Nos. 138, 139, 140 and 141 at
1~04 ~est Eighth Street, at a rental of $69.00 per month.
On motion of Councilman Hubbard, seconded by Hall and carried, action was continued
until November 18~ 1957 on the lease with the Executors of the R. B. Newcom estate
for premises located at 309 West Fifth Street, presently occupied by the Children's

Radio KWIZ containing al ]eged information concerning misconduct of Assistant Chief
Police Forrest Duke and several other Police Officers. On motion of Councilman
Hubbard, seconded by Markel and carried, the con~munication was received and filed.
Chief Edward J. Allen said the writer has resorted to insinuations, half-truths
and untruths to blacken the name of the Department and this is not the first time
he has resorted to this type of surmise, inference and conjecture; Santa Ana must
rid itself of character assassins who through mediums of communication exercise
the power that intimidates decent people. Councilman Gould explained that he
had been out of town at the time of the incident and did not personally know about
the facts but had re~ived numerous telephone calls in regard to the mutter.
