HomeMy WebLinkAbout76-148GCH:Ps 12-14-76 RESOLUTION NO. 76-148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, DECLARING THE RESULTS OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON NOVEMBER 2, 1976. The City Council of the City of Santa Ana, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That a special municipal election was duly and regularly held in said City on the 2nd day of November, 1976, at which election there were submitted to the qualified voters of said City the following propositions, to wit: PROPOSITION P - CITY COUNCIL WARDS: Shall Sections 101.1, 101.2, 101.3, 400 and 401.1 of the Charter be amended to require council wards to be based population equality; to prohibit ward boundary changes within 120 days prior to council elections; to provide for inclusion of newly annexed or consolidated territory in the most contiguous ward pending reapportionment; to delete references to division of the city into less than seven wards; and to establish initial terms for council members from wards to be created in the future? PROPOSITION Q - CITY RIGHTS AND CITY COUNCIL ACTIONS: Shall Sections 102, 200, 417 and 609 of the Charter be amended to allow the Council to set a fiscal year for the City by ordinance; to state that the City has all rights, powers and privileges not in conflict with the Constitution or the Charter and that the absence of specifica- tions of such rights in the Charter is not a limita- tion on the City's rights; to provide for the immedi- ate effect of ordinances adopted pursuant to a state law providing for such immediate effect and for the immediate effect of appropriation ordinances; to require amendments to municipal code sections to set forth the entire section proposed to be amended; and to allow budget appropriation revisions by major- ity vote of the Council? PROPOSITION R - ELECTIONS: Shall Sections 1200, 1202 and 1203 of the Charter be amended to allow the City Council to provide for an election by resolution as well as by ordinance; to substitute the term "general law cities" for "cities of the sixth (6th) class"; and to limit the occasions on which special elections can be called to council vacancy elections, initiative, referendum and recall elections, charter amendment elections pursuant to petition, elections consolidated with state or county elections, or election dates approved by two-thirds of the Council? PROPOSITION S - COMPENSATION FOR COUNCIL MEMBERS: Shall Section 402 of the Charter be amended to in- crease the monthly compensation of council members from $125.00 to $300.00? PROPOSITION T - COMPENSATION OF MAYOR: Shall Section 402 of the Charter be amended to increase the monthly compensation the Mayor receives, over and above that which he receives as a councilman, from $75.00 to $200.00? That the returns of said election have been duly and regularly canvassed as provided by law, and all absentee ballots returned, if any, have been canvassed as provided by law, with said certification of canvass attached hereto as Exhibit A and made a part hereof as though set forth in full herein. Section 3. That the votes case in the precincts estab- lished for said election upon said propositions, and for and against said propositions, the absentee vote~ if any, cast upon said propositions and for and against said propositions, and the total votes cast at said election for and against said proposi- tions and upon said propositions are set forth in Exhibit B attached hereto and made a part hereof as though set forth herein in full. Section 4. That the votes of a majority of all the voters voting at said election upon Proposition P were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. Section 5. That the votes of less than a majority of all the voters voting at said election upon Proposition Q were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have failed to carry at said election. Section 6. That the votes of less than a majority of all the voters voting at said election upon Proposition R were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have failed to carry at said election. Section 7. That the votes of less than a majority of all the voters voting at said election upon Proposition S were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have failed to carry at said election. Section 8. That the votes of less than a majority of all the voters voting at said election upon Proposition T were cast in favor of the adoption of said proposition and said proposition is hereby declared to have failed to carry at said election. Section 9. That the Clerk of the Council is hereby directed to enter this resolution in full in the minutes of this City Council, which entry shall constitute the Clerk of the Council's statement of the results of the election.
