RESOLUTION NO. 7Y- 1
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA REVERSING THE ACTION OF THE
PLANNING COMMISSION ON VARIANCE APPLICATION
NO. 76-58 AND DENYING SAID VARIANCE APPLICATION
NO. 76-58.
WHEREAS, a public hearing was duly held before
the City Council of the City of Santa Ana on December 20,
1976, on the Negative Declaration and Variance Application
No. 76-58 filed by F. Beldon Fields to permit group housing
quarters for juvenile offenders in an existing motel at 1101
West Santa Ana Boulevard in the CD District, and
WHEREAS, the Planning Commission approved such
variance application on November 8, 1976,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana:
1. That based on such public hearing and oral
and documentary evidence submitted therein, the City Council
does hereby reverse the action of the Planning Commission
approving said Variance Application No. 76-58 and does hereby
deny said Variance Application No. 76-58.
2. That the City Council hereby adopts as its
findings of fact for denial of Variance Application No. 76-
58 the Reasons for the Staff Recommendation set forth in
paragraph 4 of the "Finding of Fact, Variance Application
No. 76-58," prepared and submitted by the Planning Commission,
on file in the Office of the Clerk of the Council and incor-
porated herein by reference as though fully set forth.

REASON FOR ACTION:
That the granting of this variance with all attached conditions will
not be detrimental to the public welfare or surrounding property and
further it will not adversely effect the General Plan of the City.
DETAILS OF PROPOSAL:
1. Description of Proposal:
The purpose of this facility would be to provide room and board and to
offer a rehabilitation program for adolescents, ages 12 through 17.
According to the applicant, the facility would service Santa Aha only.'
The applicant has stated that the program would be for youths who are
in trouble but who are not guilty of any repeated or serious criminal
behavior. Included would be those who are runaways and youths with home
or school-related problems. Counseling would be provided for youths who
may be referred from the Police Department, schools, parents, the Probation
Department and self-referrals, according to the applicant.
The facility would have a permanent staff of four (4) people, one who
would live on the premises. A maximum of thirty (30) youths would be
housed on the premises. Living units, a total of eight, would be on the
second floor and one of these would be occupied by a staff member. All
access to these units is from an exterior door. Floor areas of the units
areas follows:
1 at 261 sq.ft.
1 at 304 sq.ft.
4 at 316 sq.ft.
1 at 346 sq.ft.
1 at 451 sq.ft.
The applicant proposes making the following changes to the motel and site:
Six existing carports would be converted to a dining room and recrea-
tion room, each with an area of 567 sq.ft. Four new open parking
spaces would be provided along the rear property line~

Two existing living units at the front of the building would be
converted for office space. Additional office space wouldbe
constructed in the front entrance drive off of Santa Ana Blvd.
NOTE: The above construction would limit vehicular access to
, an existing driveway off of Shelton Street.

A landscape planter, approximately 28' x 52', would be constructed
on the east side of the property which is now paved area.
2. Area Description:
A. Property: 60' x 125', or 7,500 sq.ft., located at the northwest
corner of Santa Ana Blvd. and Shelton Street.

3. General Plan Compatibility:
The General Plan designates the area as a multi-use corridor.
4. Reasons for Staff R~commendation:
A. Staff feels the existing motel, already a nonconforming use in this
..... CD District, is inappropriate for this type of facility, both because
£ ~ of the structure and its location.

The plot plan as submitted with this application is unacceptable to
the licensing agency, the State Department of Health. Also, this
department has a number of requirements with regard to the program,
details of which were requested by them early in the year but have
never been submitted. The Police and Probation Departments have
stated that the State's requirements would have to be met if they
were to refer youths to the facility.

The integrity of this corridor into the City and Civic Center should
be preserved by encouraging official, public and related uses of
properties within the corridor.
If the Commission approves the application, the following standard require-
ments must be met:

6. The following requirements must also be met:
A. Planning
l) That the facility take in only permanent residents of Santa Ana.
2)
That all requirements of the State Department of Health be
complied with and a license secured from that department prior
to occupancy.
3)
That prior to any building permits for new construction, detailed
elevations showing both the existing building and new additions
be submitted to the Planning Commission for approval.
4)
'This variance shall terminate at the end of a one year period, at
which time the Planning Department shall review the subject premises
to determine if the required conditions of the variance have been
met and to determine whether or not any problems have arisen due to
this operation. The Planning Department shall thereafter report to
the Planning Commission, which may grant extensions for a periou of
time of one year under the same conditions or under different condi-

tions without the necessity of filing an additional application.
Any additional extensions of this variance, however, shall be
subject to this same condition.
B. Public Works
l) Submit a revised plan showing no new construction with 52 feet of
the survey center line of Santa Ana Boulevard.
Dedication: Provide an irrevocable offer of dedication on Santa Aha
Blvd. for a distance of 52 feet from survey center line to ultimate
property line. Said offer to become effective at the time the
buildings are removed.
3) Improvements: Shelton Street. ~
a) Construct curb and gutter to close existing drive approach at
north end of the property.
b) Construct sidewalk between curb and existing sidewalk.
c) Remove and replace approximately 25 linear feet of existing
sidewalk at the north end of the property.
d) Replace sidewalk landing at curb return.
4) Improvements: Santa Ana Blvd.
a) Close existing drive to City standards if revised plan to be
submitted reflects an on-site blockage.
C. Fire Department
l) Submit plans to the Fire Department showing the following:
a) Automatic dry chemical fire extinguishing system in the hood
and duction oven in the cooking facility.
b)
Portable fire extinguishers with a 2A:IOB:C rating to be
located and hung no more than five feet off the floor level
on each floor and travel distance to reach no more than
75 feet.
c) Provide approved "smoke" detectors in each living unit and
work space. Plans show 15 areas.
D. Police Department
l)
All exterior doors, with the exception of glass sliding, shall be
solid core in design and be equipped with a quick-release deadbolt
with a minimum one-inch throw and rotating, tapered cylinder guards.
The strike plate shall be at least four inches in height and
attached with a minimum three-inch screws.
a) Door viewers capable of 180-degree panoramic view shall be
installed on solid core exterior doors.
2)
Glass sliding doors shall be constructed to restrict them from
being lifted out of the track when in a closed position and shall
be secured with a lock or an auxiliary locking device approved
by the Police Department.
3)

being lifted out of the track when in a closed position and shall
be secured with a lock or an auxiliary locking device approved by
the Police Department.

All windows shall be secured with a lock or an auxiliary locking
device which must meet with the approval of the Police Department.
Buildings shall be clearly identified by street number address.
Each building within the complex shall be identified with numbers
and/or letters. These numbers and/or letters shall be a minimum
of four inches in height, be of contrasting color to the background,
and must be visible from traveled access areas.
Shrubbery, walls and storage areas shall be designed so as to
prevent individuals from easily concealing themselves.

project and hereby finds that the proposed project cannot, or
will not, have a significant effect on the environment.
