RESOLUTION NO. 77- 5
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AFFIRMING THE ACTION
OF THE PLANNING COMMISSION ON VARIANCE
APPLICATION NO. 76-69, DENYING SAID
VARIANCE APPLICATION AND DENYING THE
APPEAL NO. 374 FILED THEREON
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on December 20, 1976, on
Appeal No. 374 filed by David Bates in opposition to the Planning
Commission's denial of Variance Application No. 76-69;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana:
1. That based on such public hearing and oral and
documentary evidence submitted therein, the City Council does hereby
affirm the action of the Planning Commission on Variance Application
No. 76-69, deny said Variance Application and deny Appeal No. 374.
2. That the City Council hereby adopts as its find-
ings of fact for denial of Variance Application No. 76-69 that
"Finding of Fact, Variance Application No. 76-69" prepared and
submitted by the Planning Commission, on file in the office of
the Clerk of the Council and incorporated herein by reference as
though fully set forth.

VA PURPOSE:
To permit a board and care facility for approximately 30
mentally ill adults, waiving a portion of the required
parking, in the R 2 District.

REASON FOR ACTION:
1. The proposed facility would have a detrimental impact on the residential
character of the neighborhood.
The projected 30 residents would be an excessive number considering the
size of the.property and the facilities provided.
There are presently numerous board and care facilities within Santa Aha
to care for the needs of its citizens.
DETAILS OF PROPOSAL:
Description of Proposal:
The applicant proposes to establish a board and care .facility for approxi-
mately 30 mentally ill adults. The facility will be located on property
at g22and 926 N. Dewley Street and will contain, after improvements, the
following:
Buildings: six: four single family residences and two duplexes
Units: eight gg3 sq.ft, units: three 3-bedroom units, four
2-bedroom units, and one 1 bedroom unit
Parking: three single car garages and seven open parking spaces
for a total of ten parking spaces. The code requirement
for the proposed facility would be 15 parking spaces;
therefore, the applicant is requesting a waiver of five
parking spaces.
Open Space: 44% or 15,004 sq.ft, of open space
Recreation Facilities: The applicant proposes to'construct an arts
and crafts shop and a volleyball court on the property.
The facility will be operated by a Mr. Otis and Mrs. Juanita Stocker.
Mrs. Stacker presently operates a board and care facility at 625 S. Townsend
Street and is endorsed by the State of California Health and Welfare Agency.
Consultation with the Police Department has indicated that no abnormal pro-
blems have resulted from the facility at 625 S. Townsend Street.
The proposed facility at g22 and 926 N. Bewley Street will be geared towards
helping mentally ill patients become self-sufficient, well adjusted people.
A program involving training in daily skills such as cooking, money manage-
ment, cleaning and personal hygiene will be used. In addition, the resi-
dents will be enrolled in training or rehabilitation programs outside the
home.

Zn-house staff will constst~ of two I~l full time live-tn managers, one
(1) full time night supervisor, one full time cook and one (1) part
time recreation and activities director.
Area Description:

Property: A rectangular shaped parcel with 108 feet of frontage on
Bewley Street, a depth of 31S feet and a total area of approximately
34,020 sq.ft.
Surrounding Development:
North: 9 single family residential units
East: rest home across Bewley Street
South: apartments
West: commercial uses
C. Street System: Bewley Street is designated as a local street.
Comparable Applications or Circumstances: VA 72-83, llOl-121g N. Jackson,
to operate a board, room and care faciltty for ambulant adults was
approved by the Planntng Commission on 12/11/72, affirmed by the City
Council on 1/2/73.
E. Surrounding Zoning: See attached SOM.
F. Present Use: 8 units: 2 duplexes and 4 single family residences
3. General Plan Compatibility:
The General Plan indicates medium density residential.
4. Reasons for Staff Recommendation:
A. The proposed faciltty would have a detrimental impact on the
residential character of the neighborhood.
B. The projected 30 residents would be an excessive number considering
the size of the property and the facilities provided.
C. There are presently numerous board and care facilities within
Santa Aha to care for the needs of its citizens.
If the Commission approves the application, the following standard require-
ments must be met:
A. Planning: 1, 2, 3, 4, 14
B. Public Works: 8 a, 21 a, b, c, d, 27, 40, 41, 42
6. Tlte following requirements must also be met:
A. Planning.
l) That a 6-inch, 6-foot high block wall be constructed around the
perimeter of the project.
B. Public Works
1) Improvement Plans: Bewley Street (Plan 47-26 may be revised as
approved by the OEpartment of PUblic Works.)
2)
Improvements: Bewley Street with pavement to meet existing pavement,
curb and gutter 18 feet west of the center line, sidewalk and drive
approach.
NOTE: Close northerly drive approach to City standards.
NOTE: City has funds from adjacent property owner to the south
to partially defray cost of ornamental street light.

edges of the extertor of the door and/or a metal s11de bar or cane
bolts on the interior of the door when not otherwise controlled or
locked by electric pawer operation.
Shrubbery should be planted and trtmmed so that extertor doors and
wtndOWs a~e not htdden from vtew.
O. Ftre Oepartment
1) Ftre Dopartmant access shall be maintained around the structures
as per the Untform F~re Coda.
One on-site ftre hydrant shall be Installed as per Santa Ana
standards 403 and 423.
3) ~ approved ftre alam shall be provtded as per Tttle 19 and 24,
C.A.C.
4) Portable ftre extinguishers shall be provided as per Tttle 19, C.A.C.
NOTE:
Fire Dopartmant requtremant #1 would requtre a major revtston in the
plot plan in that a ~O-foot w~de drtve would be required around the
pertmtar of buildings 1, 2, 7 and 8. Zt would also e11mJnata two of
the open parktng spaces shown, thereby Increasing the parking matver
request to a total of seven Parktng spaces. It would also requtre that
the note under 6.B.(2) "Close northerly drtve approach to City standards"
be eliminated.
