RESOLUTION NO. 77-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA MODIFYING THE ACTION OF THE
PLANNING COMMISSION ON VARIANCE APPLICATION
NO. 76-30, APPROVING SAID VARIANCE APPLICATION
AND DENYING APPEAL NO. 371 FILED THEREON
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Aha on February 22, 1977,
on Appeal No. 371 filed by Lyle Boyle, Robert Tompkins,
Hazel E. Welty, and Dennis Hayden in opposition to the Plan-
ning Commission's approval of Variance Application No. 76-30;
and
WHEREAS, this Council, prior to taking this action
has reviewed and considered the negative declaration prepared
for the proposed project, designated initial study number 76-51,
and does now find that said project will not have a significant
effect on the environment for the reasons set forth therein;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana as follows:
1. That based on such public hearing and the oral
and documentary evidence submitted therein, the City Council
does hereby deny Appeal No. 371, approve Variance Application
No. 76-30 subject to conditions as hereinafter set forth, and
modify the action of the Planning Commission on said variance
application by imposition of conditions in addition to the
conditions imposed by the Planning Commission.
2. That the City Council hereby adopts as its
findings of fact for approval of Variance Application No. 76-30
that "Finding of Fact, Variance Application No. 76-30," pre-
pared and submitted by the Planning Commission, on file in the
office of the Clerk of the Council and incorporated herein by
reference as though fully set forth, and does approve said
Variance Application upon the conditions set forth therein
and upon the following additional conditions:
(a) Development shall be according to alternate
Plan 1, on file in the office of the Clerk of the Council
and incorporated herein by this reference;
(b) A seven-foot high block wall shall be con-
structed along the westerly property line;
(c) Italian cypress trees shall be planted at
close intervals along the westerly property line.

REASON FOR ACTION:
That the granting of this variance with all attached conditions will
not be detrimental to the surrounding property or public welfare and further
it will not adversely effect the General Plan of the City.
DETAILS OF PROPOSAL:
1. Oescription of Proposal:
Background: The subject church was allowed in the R 1 District under
variance number 2gg, approved ll/13/S1. Conditions of approval included
the following: That there be no parking of automobiles within 50 feet
of the west property line and that this area be landscaped with screening
type plants. Further that there should be a driveway between said SO-foot
planting strip and the church buildings.
Proposal: The current proposal is to remove the 50-foot wide landscaping
strip required under the previous variance and utilize the area for angular
and perpendicular parking. A proposed landscape planter along the west
property line would vary in width from S feet to ll feet with cars over-
hanging the planter. The existing on-site parking spaces total 146, with
52 proposed under this application. This would make a total of lg8 spaces,
with 265 spaces required based upon the church seating capacity and the pre-
sent code requirement. The additional parking would still leave a shortage
of 67 spaces based on the current code requirement.
2. Area Description:
A, Property: Approximately 473' x 382', or 4 acres, located on the south
side of Seventeenth Street west of Flower Street.
Surrounding Development:
North: fire station, commercial uses, parking
East: produce market
South: vacant land
West: single family residences and commerolal uses
C. Street System: Seventeenth is a planned arterial street.
O. C~arable Applications or Circumstances: None in the area.

3. General Plan Compatibility:
The General Plan designates the area as a special study corridor.
4. Reasons for Staff Recommendation:

The church was constructed when parking requirements were more liberal.
The existing parking spaces amount to only a little over half of that
required under the present zoning code. Because of this, staff feels
some parking should be allowed in the 50-foot side landscaped area but
only if efforts are made to preserve as many of the existing trees as
is possible.

Staff is proposing a revised plot plan so that the westerly parking
area can be redesigned in order to retain some of the mature trees
which exist there.
If the Con~ission approves the application, the fbllowing standard require-
ments must be met:

NOTE: City will plant the trees alon~j Seventeenth Street when
widqning occurs.
6. The following requirements must also be met:

That a revised plot plan be submitted to and approved by the
Planning Department and that development be according to this
approved plot plan except for minor modifications approved by
the Planning Oepartment.
That the proposed parking area along the westerly property line
be redesigned as follows:
a) that all parking be angular;
b) that there be a landscape planter along the westerly
property line of sufficient width to accommodate
screening type planting.

l) On-site fire hydrants and water supply shall be required in
accordance with Uniform Fire Code, lg71, Article 13.301.
2) Fire Department access shall be required in accordance with
Uniform Fire Code, lg71 Edition, Article 13.301.
3) Interior of buildings shall be updated to conform to Title lg,
California Administrative Code, Public Safety,
4) Plans shall be submitted incorporating the above standards for
Fire Department approval.
