HomeMy WebLinkAbout77-061KLG:adg 6/1/77 RESOLUTION NO. 77-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA STATING THE INTENTION OF SAID COUNCIL TO NEGOTIATE FOR AND TO PURCHASE, SUBJECT TO SATISFACTORY TERMS AND CONDITIONS, THOSE CERTAIN FACILITIES OF THE GARDEN GROVE WATER SYSTEM LOCATED WITHIN THE CITY OF SANTA ANA AND SERVING CUSTOMERS IN THE CITY OF SANTA ANA WHEREAS, the City of Garden Grove owns and operates within certain areas of the City of Santa Ana portiohs of its municipal water system; and WHEREAS, said portions of said water system within the City of Santa Ana serve customers of the City of Garden Grove who are residents of or taxpayers in the City of Santa Ana; and WHEREAS, the City of Garden Grove has imposed a fifty percent (50%) surcharge upon the rates paid for water by its customers who are outside the territorial limits of the City of Garden Grove; and WHEREAS, this Council is of the opinion that all residents and property owners within the territorial limits of the City of Santa Ana should pay rates for water purchased that are not different from the rates paid therefor by other cus- tomers within the City for comparable amounts of water. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana; 1. That this Council does hereby state its desire and intention to purchase said portions of the water system of the City of Garden Grove, and to incorporate the same into the municipal water system of the City of Santa Ana, provided and upon condition that satisfactory terms and conditions for said purchase can be negotiated with the City of Garden Grove. 2. This Council does hereby direct the City Manager and the Director of Public Works to undertake negotiations with representatives of the City of Garden Grove to determine the best available terms and conditions upon which this City might undertake the purchase of said portions of the water system of the City of Garden Grove.
