RESOLUTION NO. 77~$1
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AFFIRMING THE DECISION OF THE
PLANNING COMMISSION ON CONDITIONAL USE PER-
MIT NO. 77-8 AND APPROVING SAID CONDITIONAL
USE PERMIT.
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on July 18, 1977, on
the action taken by the Planning Commission in approving
Conditional Use Permit No. 77-8; and
WHEREAS, prior to taking action on said Variance
Application this Council has reviewed and considered the in-
formation contained in Negative Declaration No. 77-89 for the
subject property and, on the basis thereof, finds that the
project will not have a significant effect upon the environ-
ment,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the oral
and documentary evidence submitted therein, the City Council
does hereby affirm the action of the Planning Commission on
Conditional Use Permit No. 77-8 and does hereby approve said
Conditional Use Permit.
2. That the City Council hereby adopts as its find-
ings of fact for approval of the Negative Declaration and Con-
ditional Use Permit No. 77-8 that certain "Finding of Fact,
Conditional Use Permit No. 77-8," prepared and submitted by
the Planning Commission, on file in the office of the Clerk of
the Council and incorporated by reference herein as though
fully set forth.
3. That the City Council approves said Conditional
Use Permit No. 77-8 subject to the conditions and requirements
set forth in the "Finding of Fact, Conditional Use Permit
No. 77-8," and subject to the additional conditions that
(a) parking be provided as required under Conditional Use Per-
mit No. 71-19, and (b) that this Conditional Use Permit is
granted for a term of one year from the date of this approval,
at which time this Conditional Use Permit shall terminate;
however, the Planning Commission may annually grant extensions
of one year each under the same or different conditions (how-
ever, no less restrictive) without the necessity of filing an
additional application, in the event that the Planning Com-
mission determines each time that the conditions of the Con-
ditional Use Permit have been met and that the property con-
tinues to meet the standards for granting a Conditional Use
Permit. Any additional extensions of this Conditional Use Per-
mit, however, shall be subject to such annual review and subject
to approval by the City Council in the same manner as any Con-
ditional Use Permit.
