HomeMy WebLinkAbout77-125DF:nr 11-1-77 RESOLUTION NO. 77-125 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA CONSENTING TO THE TRANSFER OF TERRITORY LOCATED GENERALLY NORTH OF EDINGER AVENUE EAST OF THE NEW- PORT FREEWAY FROM THE CORPORATE CITY LIMITS OF THE CITY OF SANTA ANA TO THE CITY OF TUSTIN WHEREAS, Mutual Liquid Gas and Equipment Company, a California Corporation, hereinafter referred to as "Company," is the owner of record of that certain real property fronting on the north side of Edinger Avenue immediately east of the Newport Freeway and identified as Assessor's Parcel Number 402-101-29, which real property lies within the corporate limits of the City of Santa Ana; and WHEREAS, said real property consists of approxi- mately one-third (1/3) acre and is part of 48,243 square feet used by Company in the operation of its business at that location, the remainder of which lies within the City of Tustin and is identified as Assessor's Parcel Number 402- 101-28; and WHEREAS, the subject real property which lies within the City of Santa Ana is separated from other portions of the City of Santa Ana by the Newport Freeway, and lies within the sphere of influence of the City of Tustin, as determined by the Local Agency Formation Commission of the County of orange; and WHEREAS, fire and police service from the City of Santa Ana are not readily available to occupiers of said real property in the City of Santa Aha; and WHEREAS, the assessed valuation of the parcel which lies within the corporate limits of the City of Santa Ana is $6,310, which presently generates property tax revenue to the City of Santa Ana of $90.86 annually, and WHEREAS, Title 4, Division 2, Article 4.5 of the Government Code of the State of California (Section 35270 et seq.) provides for the transfer of territory from one city to a contiguous city in the same county, which Article re- quires a resolution of consent to the transfer adopted by the legislative body of the city in which the territory is situated to be filed with the board of supervisors of the county in which the two cities are situated along with a resolution of consent to the transfer adopted by the legisla- tive body of the city to which it is proposed to transfer the territory. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: that said Council hereby consents to the transfer to the City of Tustin of so much of that certain real property as lies within the City of Santa Ana, which said real property is more fully described as: That portion of the land allotted to Frederick W. Koll, as described in the Final Decree of Partition of the Rancho Santiago de Santa Aha, which was entered September 12, 1868 in Book "B", page 410 of Judgments of the District Court of the 17th Judicial District in and for Los Angeles County, California, and that por tion of the Westerly half of Tustin Avenue, RESOLUTION NO. 77-125 PAGE TWO 50.00 feet wide, vacated and abandoned by resolution of the California Highway Com- mission (ABD - 65), a certified copy of which was recorded December 2, 1965 in Book 7760, page 578 of Official Records in the office of the County Recorder of Orange County, included within the following des- cribed lines: Beginning at the intersection of the center line of Tustin Avenue, 50.00 feet wide, with the Northwesterly line of Newport Boulevard, 60.00 feet wide, as said intersection is shown on map of Parcel 5 of the Highway Right of Way relinquished to the County of Orange (Rel-339) by resolution of the California Highway Commis- sion, a certified copy of which resolution is recorded February 3, 1966 in Book 1830, page 614 of Official Records, in the office of the County Recorder of said Orange County, said map is filed in Book No. 2, page 45 of the State Highway Maps, in said office; thence along said Northwesterly line S 40° 39' 12" W, 116.46 feet; thence S 84° 33' 46" W, 28.82 feet to a non-tangent curve concave Southwesterly and having a radius of 1050.00 feet; thence Northwesterly along said curve from a tangent which bears N 52° 04' 31" W, through an angle of 6° 26' 19", an arc distance of 117.99 feet; thence N 20° 27' 16" E, 329.67 feet to the most Westerly corner of that certain parcel of land described in Director's Deed D-A4357 recorded April 2, 1968 in Book 8560, page 419 of Official Records, in the office of the County Recorder of Orange County; thence along the Southwesterly line of said certain parcel, $ 49° 21' 30" E, 119.26 feet to said center line of Tustin Avenue; thence along said center line S 01~ 09' 30" W, 207.30 feet to said point of beginning. There shall be no abutter's rights of access appurtenant to the above-described real property in and to the adjacent State freeway.
