RESOLUTION OF THE CITY COUNCIL OVERRULING
AND DENYING PROTESTS AND MAKING CERTAIN
FINDINGS.
CITY OF SANTA ANA
WHEREAS, this City Council has held and conducted a
Public Hearing on the confirmation of the assessments and acceptance
of the works of improvements in a special assessment district with
the terms and proceedings being conducted pursuant to the provisions
of the "Improvement Act of 1911", being Division 7 of the Streets
and Highways Code of the State of Califgrnia; said specia! assess-
ment district known and designated as
ASSESSMENT DISTRICT NO. 240
(hereinafter referred to as the "Assessment District"); and,
VYHEREAS, certain owners of property liable to be assessed
for certain works of improvements have filed written protests or
objections and delivered the same to the City Clerk not later than
the hour set for the hearing thereon and said protests have been
presented to the City Council for their consideration and this
Council has proceeded to hear the same and is now ready to proceed
with the confirmation of the assessments and acceptance of the
works of improvements.

THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL
CITY OF SANTA ANA
CALIFORNIA, AS FOLLOWg:
SECTION 1. That the above recitals are all true and
correct.
SECTION 2. That all protests and objections of every
kind and nature be, and the same hereby are, overruled and denied.
SECTION 3. That it is hereby further determined that
all properties within the boundaries of the Assessment District do
receive a local and direct benefit from the works of improvements
and that the assessable costs and expenses have been apportioned
and spread against the properties within the Assessment District
in direct proportion to benefits received thereto.
SECTION 4. That the Engineer's method and formula of
assessment spread is equitable and hereby approved by this City
Council as being a correct and proper apportionment and distri-
bution of all assessable costs in relation to the benefits re-
ceived from the works of improvements constructed under these
proceedings.
