RESOLUTION NO. 78-47
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA
ESTABLISHING UNDERGROUND UTILITY DISTRICT NO.
15
WHEREAS, by Minute Order dated April 3, 1978, a
public hearing was called for May 1, 1978, at the hour of
7:30 p.m., at the Council Chambers of the City Hall, 22
Civic Center Plaza, Santa Aha, California, to ascertain
whether the public necessity, health, safety, or welfare
requires the removal of poles, overhead wires and associated
overhead structures, and the underground installation of
wires and facilities for supplying electrical communication
or similar or associated service, for the formation of the
Underground Utility District No. 15 within that certain area
of the City described as follows: said certain area being
bounded southerly by a line 70 feet south of the centerline
of Fourth Street, bounded northerly by a line 70 feet north
of the centerline of Fourth Street, bounded easterly by the
west line of Tustin Avenue and bounded westerly by the east
line of Santa Ana Freeway, as shown on the attached EXHIBIT
"A"; and
WHEREAS, notice of such hearing has been given to
all affected property owners as such are shown on the last
equalized assessment roll and to all utilities concerned in
the manner and within the time required by law; and
WHEREAS, such hearing has been duly and regularly
held, and all persons interested have been given an oppor-
tunity to be heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Santa Ana:
1. Pursuant to Santa Aha Municipal Code Sections 37-1
through 37-13, inclusive, the above-described area is hereby
declared an Underground Utility District, and is designated
as Underground utility District No. 15 of the City of Santa
Ana. Attached hereto, marked EXHIBIT "A", and hereby incor-
porated as a part of this Resolution, is a map delineating
the boundaries of said District.
2. The City Council does hereby fix December 31, 1978
as the date on which affected property owners must be ready
to receive underground service, and does hereby order the
removal of all poles, overhead wires and associated overhead
structures and the underground installation of wires and
facilities for supplying electric, communication, or similar
or associated service within Underground Utility District
No. 15 on or before January 31, 1979.
3. The Clerk of the Council is hereby instructed to
notify all affected utilities and all persons owning real
property within Underground Utility District No. 15 of the
adoption of this Resolution within ten (10) days after the
date of such adoption. Said Clerk of the Council shall
further notify said property owners of the necessity that,
if they or any person occupying such property desire to
continue to receive electric, communication or similar or
associated service, they or such occupant shall, by the date
fixed in this Resolution, provide all necessary facility
changes on their premises so as to receive such service from

the lines of the supplying utility or utilities at a new
location, subject to applicable rules, regulations and
tariffs of the respective utility or utilities on file with
the Public Utilities Cox~nission of the State of California.
Such notification shall be made by mailing a copy of this
resolution, together with a copy of said Santa Ana Municipal
Code Sections 37-1 through 37-13, inclusive, to all affected
property owners as such are shown on the last equalized
assessment roll and to the affected utilities.
4. The City Council of the City of Santa Ana hereby
finds and determines that the Underground utility District
herein created is in the general public interest, in that
the undergrounding to be accomplished will avoid or eliminate
an unusually heavy concentration of overhead distribution
facilities, reduce hazards associated therewith and enhance
the aesthetic qualities of the City.
5. The City Council hereby determines, pursuant to
California Streets and Highways Code, Section 5896.5(b),
that Southern California Edison Company, the public utility
compan~ has voluntarily agreed to pay over 50 percent of all
costs of conversion, excluding costs of users' connection to
underground electric or communications facilities.
