HomeMy WebLinkAbout78-058REL/fm 4/24/78 RESOLUTION NO. 78-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING AND REGULATING FEES AND CHARGES FOR THE ADMINISTRATION AND ENFORCEMENT OF CHAPTER 8 OF THE SANTA ANA MUNICIPAL CODE WHEREAS, the City Council of the City of Santa Ana finds and determines that the fees and charges hereinafter set forth are established in amounts sufficient to provide revenue equal to the costs of administration and enforcement of the provisions of Chapter 8 of the Santa Ana Municipal Code, and are reasonably and fairly allocated on the basis of burdens imposed and benefits received by the persons required to pay such fees and charges; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Aha that fees and charges for permits, plan checks, inspections, and investigations pursuant to Chapter 8, "Buildings and Structures," of the Santa Aha Municipal Code are hereby established and regulated as follows: 1. GENERAL PROVISIONS (a) Unless otherwise provided, payment of fees and charges as established herein shall be made to the Director of Building Safety and Housing (hereafter "the Director") or his authorized representatives at the time of initial application or request for the permit or service for which a fee or charge is imposed. No permit shall be issued to any person, firm, or corporation unless all fees therefor have been paid in full. (b) Reinspection Fee. When any reinspection is required due to the negligence of the permit holder, his agent, or other respon- sible persons, or due to the failure of said parties to comply with previous correction instructions, a fee of ten dollars ($10.00) shall be charged by the Director prior to each such reinspection. (c) Special Investigation Fee A special investigation fee shall be charged by the Director for any investigation of a building, structure, work reports, certification, or any other related work requested by an owner or his authorized agent. Said fee shall be assessed in an amount sufficient to reimburse the City for the costs incurred but in no case shall be less than fifteen dollars ($15.00). (d) Violation Investigation Fee. Whenever any work for which a permit is required has been commenced without the authorization of such permit, an investigation may be required before a permit will be issued for such work. In addition to the regular permit fee and any penalty fee, an investigation fee shall be collected as follows: When the Permit Fee is: Investigation Fee $15.00 or less .............................. $10.00 More than $15.00 ............................ $25.00 -1- RESOLUTION NO. PAGE TWO 78-58 (e) Building Records Report Whenever a request for information regarding a structure necessitates a search of documents, records or plans and documentation by written report, a fee of $15.00 shall be charged for this service. (f) Departmental Approval for Business License. Whenever a Business License Tax Application requires processing of the "Department Approvals for Business License" form, a fee of ten dollars ($10.00) shall be paid to the Finance Director when the application is filed and deposited by him into Revenue Fund 411. (g) Demolition Permit. The fee for a permit to demolish a building or structure shall be fifteen dollars ($15.00). (h) Refunds Upon written request from the permittee, refunds of permit fees may be made to the permittee in an amount equal to eighty per cent (80%) of the permit fee paid; except that no permit fees shall be refunded under any of the following circumstances: (1) If the permit fee is ten dollars ($10.00) or less. (2) After one year has elapsed from the date of the issuance of the permit. (3) If any inspections have been performed by the Department of Building Safety and Housing. If a permit has been issued for a project located in an area outside of the jurisdiction of the City, one hundred per cent (100%) of the permit and plan check fee may be refunded. If a duplicate permit has been erroneously issued, one hundred percent (100%) of the duplicated permit and plan checking fee may be refunded. If a plan check fee has been paid and the plan is withdrawn by the applicant prior to the plan check, one hundred per cent (100%) of the plan check fee may be refunded. In no other case may any plan check fees be refunded. 2. BUILDING CODE FEES AND CHARGES (a) Building Permit Fees A fee for each building permit shall be paid as set forth hereinbelow. The determination of value or valuation shall be made by the Director or his authorized representatives. The valuation shall be the total value of all construction work for which the permit is issued, as well as all finish work, painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire-extinguishing systems and any other permanent work or permanent equipment. -2- RESOLUTION NO. 78-58 PAGE THREE TOTAL VALUATION FEE $1.00 to $1,000.00 $10.00 $1,001.00 to $2,000.00 $10.00 for the first $1,000.00 plus $1.00 for each additional $100.00 or fraction thereof, to and including $2,000. $2,001.00 to $25,000.00 $20.00 for the first $2,000.00 plus $4.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00. $25,001.00 to $50,000.00 $112.00 for the first $25,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $50,000.00. $50,001.00 to $100,000.00 $187.00 for the first $50,000.00 plus $2.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00. $100,001.00 to $500,000.00 $287.00 for the first $100,000.00 plus $1.50 for each additional $1,000.00 or fraction thereof, to and including $500,000.00. $500,001.00 and up $887.00 for the first $500,000.00 plus $1.00 for each additional $1,000.00 or fraction thereof. (b) Surcharges: In addition to the above stated fees, there shall be an additional surcharge of a percen- tage of the building permit fees as follows: PROJECT TYPE SURCHARGE Plans subject to the State of California Energy Conser- vation Law for residential or commercial buildings 20% Plans subject to the State of California Sound Control regu- lations for residential buildings 20% Plans subject to both the State of California Energy Conservation laws and Sound Control regulations 30% (c) Application Processing and Plan checking Fees An application processing and plan checking fee shall be paid to the Director at the time of submitting plans and specifications for checking. Said fees for buildings of Groups R Division 3 and M Occupancies shall be one-half (1/2) of the building permit fees, including surcharges. -3- RESOLUTION NO. 78-58 PAGE FOUR Fees for all other buildings shall be sixty- five percent (65%) of the building permit fees, including surcharges, as set forth in this Resolution. EXCEPTION: When repetitious models for Group R Division 3 Occupancies in a residential housing tract are submitted at one time, such fee shall be paid only for each different model, and one-half (1/2) of such fee for each repetition of the model plan. Where plans are incomplete or changed, so as to require additional plan checking, an additional fee shall be paid to the Director based upon the value of construction of the proposed change or redesign. In establishing said fee, no allowance for a decreased valuation shall be permitted due to the replacement, ommission and/or lessening of any member or portion of the building shown in the original plans. Said fee may be waived when in the opinion of the Director the additional fee is not warranted. No additional fees shall be charged for checking corrections required by the Director. 3. PLUMBING CODE FEES AND CHARGES (a) Plumbing Permit fees For issuing each permit $ 5.00 In addition For each plumbing fixture or trap or set of fixtures on one trap (includ- ing water, drainage, piping, and backflow protection therefor) 3.00 For each building sewer for the first one hundred (100) feet and the first building drain connection 5.00 For each additional building drain connection on the sewer 2.00 For each additional one hundred (100) feet of sewer or part thereof 2.00 For each cesspool 5.00 For each private sewage disposal system 10.00 For each water heater and/or vent 3.00 For each gas piping system of one (1) to five (5) outlets 3.00 For each gas piping system of six (6) or more outlets per outlet .60 For yard gas piping exceeding two hundred (200) feet of pipe, add for each additional one hundred (100) feet 3.00 -4- RESOLUTION NO. 78-58 PAGE FIVE For each industrial waste pre-treatment interceptor including its trap and vent, excepting kitchen type grease interceptors functioning as fixture traps 3.00 For installation, alteration or repair of water piping and/or water treating equipment 3.00 For repair or alteration of drainage or vent piping 2.00 For each lawn sprinkler system on any one meter including backflow devices therefor - Group I 3.00 Ail other occupancies - each building 3.00 For vacuum breakers or backflow protective devices on tanks, vats, etc., or for in- stallation on unprotected plumbing fix- tures including necessary water piping - one (1) to five (5) Over five (5), each additional 3.00 .60 For water service piping or building supply piping, each one hundred (100) feet or part thereof 3.00 For on-site water main piping or water service piping supplying on-site water meters. Each one hundred (100) feet or part thereof 3.00 For buried rainwater piping or storm drain piping. Each one hundred (100) feet or part thereof 3.00 (b) Plan Check Fees (1) Plans for all plumbing work are required. EXCEPTION: Residential structures and their accessory buildings shall be exempt when the plumbing permit fee does not exceed $15.00. (2) Isometric drawings shall accompany all applications for a plumbing permit. (3) When plans are required, the plan check fee shall be 50% of the plumbing permit fee. EXCEPTION: When repetitious models of a tract of residential structures and their accessory buildings are submitted at one time, such fee shall be paid only for each different model. (4) Plan check fee for alterations to approved plans - $12.00 per hour. Minimum charge per half hour, $6.00. -5- RESOLUTION NO. 78-58 PAGE SIX' 4. MECHANICAL CODE FEES AND CHARGES (a) Mechanical Permit Fee Schedule. Any person desiring a permit required by the Mechanical Code, shall, at the time of filing an application therefor, pay a fee as required by this section. For the issuance of each permit $ 5.00 For the installation or relocation of each forced-air or gravity type furnace or burner up to and inclu- ding ducts and vents attached to such appliance 10.00 More than 100,000 BTU to and in- cluding 500,000 BTU 10.00 More than 500,000 BTU to and in- cluding 1,000,000 BTU 10.00 More than 1,000,000 BTU to and in- cluding 2,000,000 BTU 15.00 More than 2,000,000 BTU 25.00 For the installation or relocation of each floor furnace including vent 10.00 For the installation or relocation of each suspended heater, recessed wall heater or floor mounted unit heater including vents 10.00 For the installation or relocation of each commercial or industrial type incinerator 20.00 For each appliance or piece of equip- ment regulated by the Mechanical Code, but not classed in other appliance cate- gories, or for which no other fee is listed. 4.00 Incidental gas piping 4.00 (b) Plan Check Fees (1) (2) (3) Plans for all mechanical work are required. The plan check fee shall be 50% of the mechanical permit fee. EXCEPTION: When repetitious models of a tract of residential structures and their accessory buildings are submitted at one time, such fee shall be paid only for each different model. ELECTRICAL CODE FEES AND CHARGES (a) Electrical Permit Fees The minimum fee for each permit shall be $15.00, including issuance. Fees in excess of said minimum shall be determined according to the following schedules: (1) For new construction and relocation on residential single family, multi-family, hotels, motels and all other R Occupancies: A Five dollar ($5.00) permit issuance fee. Whenever electrical plans are required by the Director, plan check fees shall be fifty percent (50%) of the electrical permit fee and shall be paid at the time of submitting plans. 6. EFFECTIVE DATE The fees and charges established by this resolu- tion shall become effective upon the effective dates of the ordinances adopting the 1976 editions of the Uniform Build- ing, Plumbing, and Mechanical Codes and the 1975 edition of the National Electrical Code for the corresponding permits and procedures undertaken pursuant to each such code respec- tively.
