HomeMy WebLinkAbout78-063DMF: adg 5/24/78 RESOLUTION NO. 78-63 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANAt APPROVING THE ORANGE COUNTY SAFER OFF-SYSTEM ROADS PROGRAM AND THE METHOD OF DISTRIBUTION OF FUNDS. WHEREAS, in accordance with Section 219 of Title 23, United States Code (Safer Off-System Roads), and Chapter 12 Section 2520 et seq., of the California Streets and Highways Code, certain federal funds will become available to the County of Orange ("County") "for the construction, reconstruc- tion and improvement of any off-system road including, but not limited to, the correction of safety hazards, the replace- ment of bridges, the elimination of high hazard locations and roadside obstacles..." on any toll-free public roads; and WHEREAS, Chapter 12, Section 2530, of the Streets and Highways Code specifies that the funds are to be appor- tioned to County and County shall enter into agreements with the cities in the County concerning the distribution of the funds among the cities and County, said agreement to be placed on file with the California Department of Transpor- tation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. The City Council approves the distribution of any federal funds that may become available to Orange County for the Safer Off-System Roads Program as described in Section 219 of Title 23, United States Code, among the cities and the County based on the allocation formula of a base amount of Two Thousand Five Hundred Dollars ($2,500) to each eligible agency, the remaining funds to be allocated on the ratio of the population of each agency to the total County population. 2. The City Council approves the determination of eligibility for participation as described herein. 3. The City Council approves the use of population figures based on the most recent County wide census or as may be determined by the Board of Supervisors. 4. The City Council agrees that if any local agency decides not to participate in this program for any of the fol- lowing reasons, said agency and its population shall automatic- ally be excluded from the computations for distribution: a. Failure to agree on distribution of funds. Failure to claim funds in time specified. c. Failure to submit plans, specifications and estimate of costs to the California Department of Transportation by September 15 of the Federal Fiscal Year in which the funds expire. 5. The City Council approves any change, by mutual agreement and with the approval of the California Department of Transportation, of said apportionment formula of Safer Off- System Road Funds. The City Council agrees that the City of Santa Ana shall be responsible for compliance with the California Environmental Qualit~ Act or the National Environmental Policy Act, whichever is applicable, as to the use of any improvements effected by the use of funds that the City of Santa Aha receives under the Safer Off-System Roads Program. 7. The City of Santa Ana shall independently process projects under the Safer Off-System Roads Progra/~ and shall apply for City's reimbursement from federal funds. 8. The City of Santa Ana shall inform the tech- nical staff of County's Arterial Highway Financing Program of the status and progress of their projects on a semi- annual basis or as may be required to insure progress of the Safer Off-System Roads Program in the County.
