RESOLUTION NO. 78-71
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AMENDING RESOLUTION NO. 77-79
TO FIX A SURCHARGE UPON WATER RATES AND STANDBY
SERVICE CHARGES IN A CERTAIN AREA OF THE CITY
OF SANTA ANA
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SANTAANA:
1. That Resolution No. 77-79 of this Council, adopted
on July 18, 1977, is hereby amended by adding thereto the
following section 5:
Section 5. That a surcharge of One
Dollar ($1.00) per month is to be levied
and collected for each water service towhichwater is
supplied by the city, or to which a standby
service is provided, pursuant to Section
31-21 of the Santa Ana Municipal Code, for
those services acquired by the City of Santa
Ana under and pursuant to that certain agree-
ment entitled "Water Systems Acquisition Agree-
ment'', form dated 4/21/78, as amended, provided
and excepting, however, that the surcharge levied
hereby shall not apply to any dwelling in Tract
1944, the owners of which installed a water sys-
tem under and pursuant to proceedings had and
taken under the Improvement Act of 1911 heretofore.
The surcharge levied hereby shall not be charged
beyond ten (10) years from and and after the
date when said surcharge is first levied.
2. This resolution shall be operative from and
after the date of closing that is referred in said "Water
Systems Acquisition Agreement", which said date determines,
or will determine, when and if the City of Santa Aha succeeds
to ownership of the water system that is the subject of said
agreement.
