RESOLUTION NO. 78-84
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA AFFIRMING THE DECISION
OF THE PLANNING COMMISSION APPROVING
VARIANCE APPLICATION NO. 78-21
Wq{EREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on July 11, 1978, on
the action taken by the Planning Commission in approving
Variance No. 78-21, to allow retail sales of beer and wine
in an existing restaurant at 1700 East Garry Avenue in the
LM District; and
WHEREAS, prior to taking action on said variance
this Council has reviewed and considered the information
contained in Negative Declaration No. 78-66 for the subject
property, and, on the basis thereof, finds that the project
will not have a significant effect upon the environment,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and on the
oral and documentary evidence submittedtherein, the City
Council does hereby affirm the action of the Planning Commission
in approving Variance No. 78-21.
2. That the City Council hereby adopts as its
findings of fact for approval of Variance No. 78-21 that
certain report entitled "Variance Application 78-21" prepared
and submitted by the Planning Commission, on file with the
Clerk of the Council, and incorporated by reference herein
as though fully set forth.
3. The said variance is approved subject to the
condition that it shall be reviewed by the City Council in
two years time and shall terminate unless finally approved
by the City Council at such time subject to such revised or
additional conditions as the Council may then impose.
