HomeMy WebLinkAbout78-086KLG:adg 7/6/78 RESOLUTION NO. 78-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA DECLARING THE RESULTS OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON JUNE 6, 1978 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That a special municipal election was duly and regularly held in the City of Santa Ana, California on the 6th day of June, 1978, at which election there were submitted to the qualified voters of said city the following proposi- tions to wit: PROPOSITION K - CHARTER LANGUAGE: Shall the Charter be amended to bring Charter provisions into conformance with State law and to revise regulation of political activities, including: Deleting provisions which are now controlled by State law and extending provisions to in- clude all powers granted by State law; Making the competitive bidding requirements of the City similar to those set by State law; Prohibiting gifts to City personnel from financially interested persons? PROPOSITION L - BOARDS & COMMISSIONS: Shall the Charter be amended to modify provisions for service on the City's Boards & Commissions, including: Giving Council the authority to regulate use of subpoena power by Boards & Commissions; Eliminating the prohibition against Personnel Board Members holding public office or employ- ment or being candidates for public or political office and the prohibition against eligibility for employment by the City for a period of one year after completion of service as a Personnel Board Member? PROPOSITION M - PERSONNEL PROCEDURES: Shall the Charter be amended to revise rules for selection and pro- motion of City Personnel, including: Allowing the City Council more flexibility in setting rules for employee selection, promotion and probationary periods; Providing for employment of officers of other cities or special districts merge with Santa Ana? and employees if they PROPOSITION N - CITY EMPLOYEES: Shall the Charter be amended to revise regulations affecting City employee~ in- cluding: RESOLUTION NO. 78-86 PAGE TWO Providing that any officer or employee of the City who engages in any strike, sickout, or other stoppage of work shall be subject to suspension, demotion or dismissal without right of appeal; Revising suspension and demotion procedure for employees and studying new requirements for notice of charges and written decision; Revising requirements for providing an employee retirement plan and guidelines for employee lay- offs? PROPOSITION 0 - CITY ORGANIZATION: Shall the Char- ter be amended to allow the City Council more flexibility in making administrative decisions and to set new rules for holding City elections, including: Revising the procedure to fill Council vacancies and allowing Council to call City elections by resolution; Allowing the Council to amend the effective dates of the fiscal year and permitting a majority rather than a two-thirds of the Council to amend the budget; Expanding Council authority to provide for City staff organization and contract for professional services on personnel matters? PROPOSITION P - CITY ORDINANCES: Shall the Charter be amended to revise City ordinance procedures, including: Requiring pending ordinances or resolutions to be made available for public inspection at Council meetings instead of reading them in full; Requiring newspaper publication of the title ex- planation before the final adoption instead of the entire ordinance upon adoption; Specifying requirements for adopting City ordin- ances and their effective dates? 2. That the returns of said election have been duly and regularly canvassed as provided by law, and all absentee ballots returned, if any, have been canvassed as provided by law, with said certification of canvass attached hereto as "Exhibit A" and made a part hereof as if set forth at length herein. 3. That the votes cast in the precincts established for said election upon said propositions, and for and against said proposition, and the total votes cast at said election for and against said propositions and upon said propositions are set forth in said "Exhibit A". 4. That the votes of a majority of all of the voters voting at said election upon Proposition K were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. That the votes of less than a majority of all of the voters voting at said election upon Proposition L were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have failed to carry at said election. 6. That the votes of less than a majority of all of the voters voting at said election upon Proposition M were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have failed to carry at said election. 7. That the votes of a majority of all of the voters voting at said election upon Proposition N were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. 8. That the votes of less than a majority of all of the voters voting at said election upon Proposition 0 were cast in favor of the adoption of said proposition, and said prop- osition is hereby declared to have failed to carry at said election. 9. That the votes of a majority of all of the voters voting at said election upon Proposition P were cast in favor of the adoption of said proposition, and said proposition is hereby declared to have been carried at said election. 10. That the Clerk of the Council is hereby directed to enter this resolution in full in the minutes of this City Council, which entry shall constitute the statement of the Clerk of the Council of the results of said election.
