RESOLUTION NO. 78-141
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA AFFIRMING THE DECISION OF THE
PLANNING COMMISSION GRANTING VARIANCE APPLICATION
NO. 78-40 AND DENYING APPEAL NO. 395
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Ana on October 16, 1978,
on the action taken by the Planning Commission in denying
Variance Application No. 78-40, which application seeks to
allow the expansion and reconstruction of an existing vehicle
dismantling yard at 3117 - 3125 West Fifth Street in the C2
and R2 Use Districts; and
WHEREAS, prior to taking action on said Variance
Application, this Council has reviewed and considered the
Negative Declaration for the project, including Initial
Study No. IS 78-150;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing~and on the
oral and documentary evidence submitted therein, the City
Council does hereby affirm the action of the Planning Commission
in granting Variance Application No. 78-40, and deny Appeal
No. 395.
2. That the City Council hereby adopts as its
findings of fact for approval of Variance Application No.
78-40 that certain "Finding of Fact, Variance Application
No. 78-40," prepared and submitted by the Planning Commission,
on file in the Office of the Clerk of the Council, and
incorporated by reference herein as though fully set forth.
3. For the reasons set forth in the Negative
Declaration prepared for this project, the Council approves
and adopts the said Negative Declaration and its finding
that the project will not have a significant effect on the
environment.
