HomeMy WebLinkAbout79-068EJC:adg 5/3/79 RESOLUTION NO. 79-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REQUESTING THE STATE LEGISLATURE TO AMEND SECTION 3202 OF THE LABOR CODE OF THE STATE OF CALIFORNIA RELATING TO WORKERS' COMPENSATION WHEREAS, the Santa Ana City Council is concerned about the increasing costs to employers for industrial injury and disability retirements; and WHEREAS, the Santa Ana City Council believes that the primary reason for such rising costs is the mandate provided in Section 3202 of the Labor Code that the courts liberally construe the Workers' Compensation Insurance and Safety in Em~ployment provisions of the Labor Code with the purpose of extending their benefits for the protection of persons injured in the course of their employment; and WHEREAS, Assemblyman Paul Bannai (Gardena) has proposed legislation in an attempt to amend Section 3202 of the Labor Code by substituting the words "fair and equitably" for the word "liberally;" and WHEREAS, the City Council of the City of Seal Beach, by its Resolution No. 2866, has requested the State Legislature to take action in an effort to halt rising costs associated with workers' compensation benefits beyond the original purpose and intent of the law; and WHEREAS, such proposals are believed by the Santa Ana City Council to be necessary in an effort to reduce high costs which have been and are occurring in the areas of industrial injury and disability retirement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That the California State Legislature is requested to pass legislation amending Section 3202 of the Labor Code of the State of California to provide for "fair and equitable" construction of the Workers' Compensation Insurance law and the Safety in Employment law rather than "liberal" construction. 2. That the this Resolution to the County.
