RESOLUTION NO. 79-78
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA ANA VACATING A PORTION OF
MARTHA LANE WEST OF BRISTOL STREET AND
A PORTION OF PACIFIC AVENUE NORTH OF
WASHINGTON AVENUE IN THE CITY OF SANTA ANA.
WHEREAS, this Council heretofore adopted on May 7,
1979, Resolution NO. 79-69 , where it declared its intention
to vacate pursuant to and in accordance with Section 8322 of
the Streets and Highways Code of the State of California, a
portion of Martha Lane west of Bristol Street and a portion
of Pacific Avenue north of Washington Avenue, said streets
being specifically described in said Resolution and reference
being made in said Resolution to a certain map on file in
the office of the Clerk of the Council for full particulars
as to such proposed vacation; and
WHEREAS, said Resolution gave notice that on May
21, 1979, at 7:30 p.m. or as soon thereafter as the matter
could be heard, in the Council Chambers of the City of Santa
Ana, 20 Civic Center Plaza, Santa Ana, California, this
Council would hear any and all persons interested in or
objecting to said proposed vacation of the said portion of
said streets; and
WHEREAS, this Council finds that said Resolution
has been published in the manner prescribed by law for the
publishing of ordinances of the City; and
WHEREAS, Council further finds that notices of
said proposed street vacation stating the purposes of said
Resolution and time and place set for hearing were posted as
directed by the Council and required by law; and
WHEREAS, this Council at the time and place set
for hearing has heard any and all persons interested in or
objecting to said proposed vacating of said portion of said
alley and has received and considered all evidence submitted;
and
WHEREAS, this Council finds from all the evidence
submitted that the said streets described in the above-
mentioned Resolution, and described more fully in "Exhibit
A" attached hereto, is unnecessary for present or prospective
public street purposes, based upon the following findings of
fact:
1. Ail real property adjacent to the subject
streets has been acquired by the Rancho Santiago
Community College District for the purpose of
expansion of the Santa Ana College campus.
2. The subject streets are incompatible with the
campus expansion as proposed and serve no useful
purpose to any other property owner or to the
public.
WHEREAS, pursuant to the provisions of ~ 2381 of
the Streets and Highways Code of the State of California,
the City Council does hereby find and determine that none of
said Streets, nor parts thereof, are useful as non-motorized
transportation facilities; and

WHEREAS, based upon the findings contained in
Initial Study No. 79-34, on file with the Planning Director
of the City of Santa Ana, the City Council hereby approves
the finding of the Negative Declaration issued thereon that
the said vacation will not have a significant effect on the
environment.
NOW, THEREFORE, the City Council of the City of
Santa Aha does hereby order that a portion of Martha Lane
west of Bristol Street and a portion of Pacific Avenue north
of Washington Avenue, in the City of Santa Ana, more fully
described in "Exhibit A" attached hereto and made a part
hereof by this reference, is hereby vacated.
The Clerk of the Council is hereby directed to
cause a certified copy hereof, attested by her under seal,
to be recorded forthwith in the Office of the Recorder of
Orange County.

Legal Description
All those certain portions of~rtha Lane (formerly ~rtha Street), 60 feet
wide, end Pacific Avenue, 60 feet wide, in the City of Santa Aha, County of
Orenge, Coltfornta, es shown on that certain map of Tract No. 758 recorded
in Book 23, page 26 of Miscellaneous Maps, in the office of the County Recorder
of Orange County, Cmlifornia, together with the Southerly 6 feet of Lots 1
through lg ~nclustve, of said Tract No. 758 as dedicated to the City of Santa
/ma for street purposes by Deed recorded September lg, lg2g in Book 309, page 368,
official records of said County together with a spandrel shaped parcel of land
bounded on the South by the North line of the South 6.00 feet of said Lot l,
bounded on the East by the West line of the East 20.00 feet of said Lot l,
and bounded on the Northwest by the arc of a curve concave Northwesterly,
having a radius of 25.00 feet end being tangent to said Southerly and Easterly
boundaries.
RESERVING and EXCEPTING therefrom that portion lying Easterly of a line parallel
mhd distant 60.00 feet Westerly, measured at right angles, from the ceoterline
of Bristol Street as shown on said map of Tract No. 758.
Also RESERVING and EXCEPTING therefrom that portion lying Southerly of a line
parallel end distant 40.00 feet Northerly, measured at right angles, from the
centerltne of Washington Avenue as shown on said map of Tract No. 758.
Also RESERVING and EXCEPTING therefrom the permanent easement and right at
any time, or from time to time, to construct, maintain, operate, replace,
re, ye, renew and enlarge lines of pipe, conduits, cables, wires, poles, end
other convenient structures, equipment and fixtures for the transportation or
distribution of electric ener(~y and incidental purposes, including access and
the right to keep the property free from all tnflan~nable materials and wood
growth, and otherwise protect the same from all hazards, in, upon, over, across
and under a strip of land lO.O feet in width the centerltne of v~nich is described
as the East line of said Pacific Avenue.
Also RESERVING and EXCEPTING therefrom the permanent easement and right at
any time, or from time to time, to construct, maintain, operate, replace, remove
and renew sanitary sewers and appurtenant structures pursuant to existing frenchteses
or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove,
renew and enlarge lines of pipe, and other convenient structures, equipment and
fixtures for the transportation or distribution of water and incidental purposes,
Including access end the right to keep the property free from tnflan~nable materials
and wood growth, end otherwise protect the same from ell hazards, end for any other
municipal purposes, in, upon, over end under said Pacific Avenue, 60 feet wide.
