RESOLUTION NO. 79-105
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA ANA AUTHORIZING
LOANS OF COMMUNITY DEVELOPMENT BLOCK
GRANT FUNDS RECEIVED FROM THE UNITED
STATES DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT TO CERTAIN QUALIFIED
PROPERTY OWNERS FOR THE PURPOSE OF
PAYING ALL OR A PORTION OF THE PROPERTY
OWNERS' SHARES OF SPECIAL ASSESSMENTS
WHEREAS, federal regulations (24 CFR 570.200(f))
provide that Community Development Block Grant ("CDBG")
funds received from the United States Department of Housing
and Urban Development ("HUD") may be used to pay the share
of costs of public improvement of property owned or occupied
by low- and moderate-income households in a special assess-
ment district; and
WHEREAS, CDBG funds in the amount of $64,000 were
approved by the City Council in the fourth year CDBG budget
for loans to needy low- and moderate-income property owners
in special assessment districts to pay their share of costs
of public improvements in said districts; and
WHEREAS, Assessment District 241 was created in
the City of Santa Ana in accordance with the "Improvement
Act of 1911," California Streets and Highways Code Section
5000 e__t seq. by Resolutions 78-15 and 78-16; and
WHEREAS, the City Council passed Resolution 79-93
confirming assessments in Assessment District 241 pursuant
to the Improvement Act of 1911 on June 4, 1979; and
WHEREAS, Section 5129 of the California Streets
and Highways Code permits use of federal funds for the
payment of assessments levied, on lands owned and occupied
by low- and moderate-income households, by legislative
bodies in special assessment districts created under the
Improvement Act of 1911; and
WHEREAS, the City of Santa Ana desires to lend
Community Development Block Grant funds received from HUD to
pay all or a portion of special assessments on properties
owned and occupied by certain qualified low-income households
in Assessment District 241 in amounts not greater than
$800.00 for each benefited property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA, that loans using Community Develop-
ment Block Grant funds to pay all or a portion of the share
of costs of public improvements benefiting properties owned
and occupied by qualified low- and moderate-income households

in Special Assessment District 241, created under the Improve-
ment Act of 1911, are hereby authorized, subject to a maximum
of $800.00 for each such loan for any such benefited property.
