HomeMy WebLinkAbout79-121KLG:ms 8/1/79 RESOLUTION NO. 79-121 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA REQUESTING THE COMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS "TUSTIN AVENUE AND FAIRHAVEN AVENUE SOUTHEAST ANNEXATION" TO THE CITY OF SANTA ANA AND DIRECTING THE CLERK OF THE COUNCIL TO FILE A CERTIFIED COPY HEREOF WITH THE ORANGE COUNTY LOCAL AGENCY FORMATION COMMISSION WHEREAS, it is the desire of the City of Santa Aha to annex into its boundaries certain inhabited property constituting an incorporated island, which is delineated on the map attached hereto and described as "Exhibit A" and described in "Exhibit B" also attached hereto, pursuant to the provisions of Part 2 of Division 2 of Title 4 of the California Government Code; and WHEREAS, it has been determined by the Orange County Local Agency Formation Commission that the subject territory is within the Sphere of Influence of the City of Santa Ana; and WHEREAS, the City Council hereby determines that the proposed annexation is categorically exempt from the CEQA requirements for environmental impact review; and WHEREAS,' it is the desire of the City of Santa Ana to extend the full range of municipal services to said unincorporated'island; and WHEREAS, it is hereby determined that the City of Santa Ana is currently providing and has in the past provided a variety of municipal services to the Proposed annexation: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana. That the City of Santa Ana requests the commencement of annexation proceedings regarding said inhabited territory in accordance with the Municipal Organization Act of 1977, Part 2 of Division 2 of Title 4 of the California Government Code, governing unincorporated island annexation. e That the proposed annexation be made pursuant to Sections 35013 and 35150 (f) of the Municipal Organization Act of 1977. e That the following factors have been considered and findings as follows are made thereon: The subject territory contains single family residences and some commercial buildings. The subject territory is presently zoned Single Family Residential and Commercial Highway by the County of Orange and would be prezoned by the City of Santa Ana to maintain consistency with adjacent sites and the General Plan. RESOLUTION NO. 79-121 PAGE TWO The subject territory is presently receiving water, sanitation and street lighting services from agencies other than Santa Ana. These services will either be continued by the agencies so serving, or replacement services will be provided by Santa Ana. The subject territory contains the following public improvements: curbing, street lighting, sidewalks and gutters. That the City Council finds and petitions the Local Agency Formation Commission to determine, pursuant to Section 35150(f) of the Municipal Organization Act of 1977, and based in part on the factors enumerated in paragraph 3 herein, that the proposed area: de Does not exceed 100 acres in area; Constitutes the entire island; Is substantially surrounded by the City of Santa Aha; Is substantially developed; Is not prime agricultural land; and Is receiving benefits from the City of Santa Aha. That the Local Agency Formation Commission is hereby petitioned to conduct required hearings on the subject hereof, and thereafter to authorize the Board of Supervisors of Orange County to order the annexation without an election of the subject territory. That the subject area is a developed area of 25.7 acres, consisting of single family residences and commercial buildings. The area is substantially surrounded by the incorporated limits of the City of Santa Ana. That the justification for the proposed change of organization is to provide full municipal services to a develped County island area, thereby increasing the quality, economy and efficiency of such services to the areas. 8. That the Clerk of the Council is hereby directed to file a certified copy of this resolution with the Executive Officer of the Local Agency Formation Commission. GOW, City Attorney MAYOR RESOLUTION NO. 79-121 Legal Description For The Tustin Avenue and Fairhaven Avenue Southeast Annexation To The City of Santa Ana, California All that certain territory situated in the County of Orange, s}tate of California, more particularly described as follows: Beginning at a point in the existing Northerly boundary of the City of Santa Aha, said point being the Northeast corner of the "Santa Clara and Tustin N.W. Annex" to the City of Santa Ana; Thence along the said existing City boundary in a generally Westerly and Northerly direction as established by the said "Santa Clara and Tustin N.W. Annexation", and by the "Fairhaven and Tustin Southwest Annex to the City of Santa Ana" to the most Easterly Northeast corner of last said Annex, said corner being a point in the existing boundary of the City of Orange; thence along the said boundary of the City of Orange in a generally Easterly and Northeasterly direction as established by "Annexation No. 249" to the City of Orange; thence continuing along the said boundary of the City of Orange in a generally Easterly, Southerly, Southeasterly, Southerly and Easterly direction as established by the "Annexation No. 149-A" to the City of Orange, to a point in the existing boundary of the City of Tustin; thence in a generally Southerly direction as established by the "Marshall Annexation" to the City of Tustin to the Point of Beginning. ~TA CLA£A AND TUSTII~ N. · A NIVE-X CITY OF SANTA P.
