Neialy The Mayor and Vice-Mayor being absent, the Clerk stated nominations are in order for Mayor Pro-Tern. It was mowed by CoUnci~maln Hubbard and seconded by Co~lncllman N~I 1, that Stanley C. Gould, Jr., be nomtr~ted Mayor Pro-Tern; and upon call for a vote Stanley C. Gould, Jr., was u~ elected Mayor Pro-Tern. ~iMayor Pro-Tern Gould stated this is De~olay Civic D~y and that Richard Bates represented Counc~!m~n Gould, Richard ~n represented City Manager Carl Thornton, D~ve Murry represented Counc~!m~ H_~!!, and Ron Carey represented Councilman Hubbard. .The Pier, of Allegiance was given. Invocation was given by ~everend Garland G. Lacey of the Wilshire Presbyterian Church. Each member of the City Council having received copies of the Minutes of March 2, 1959, reading of the Minutes w~s dispensed with and approved on motion of Counc~]m~n Hubbard, seconded by Hall and carried. Bids Construct Mayor's Office and Planning Department on third floor City Hall Hearing Amend. Appl. This being the date set for continued hearing and no protests having been received, Amendment Application No. 266 filed by Louis Struikm~n~ was considered to reclassify from R-1 District to C-1-PK District, property located on the south side of Edinger Street west of Sullivan Street. On motion of Councilman Hubbard, seconded by Hall and carried, the following Ordinance entitled: "Ordinence amending Article IX of the Sauta AnaMu~icipal Code to che~ge district classification on Application No. 266 and to ~nd Sectional District Map 22-5-10, Exhibit 'B'" Hearing - A.D. 201 Improve Main St. btn Edinger St. and Delhi Road was introduced, considered and placed ~ file for second reading. The Mayor Pro-Tern announced this is the time and place for hearing protests or object- lens against the assessment for the improvement of Main Street, in Assessment District No. 201, and asked the Clerk if she was in possession of the affidavit of publication, affidavit of posting and affidavit of mailing. The Clerk stated she had the affidavits and on motion of C(~lctlmau Hubbard, seconded by Hall and carried, the affidavits were received and filed. The Mayor Pro-Tern asked the Clerk if she had received any written protests or objections against the assessment, the improvement as constructed, or the proceedings, and the Clerk stated she received a written protest from Attorney Clifford J. Baxter on behalf of Mark B. Lindsey et al. On motion of Councilman Hubbard, seconded by Hall and carried, the ~retest was received and filed. Attorney Baxter stated that the property owners involved received a letter similar to the photostatic copy of the letter which is attached to his letter, and he has set forth the nature of the protest in that at the time of the original letter of the Manager, dated November 29, 1956, the estfm~te on this improvement was to be from $2.30 to $2.80 per front foot. The pro- testants would like an explanation as to the disparity between the estimated cost of the street lighting improvement and the difference between the Manager's estfm~te and the $5.16 per front foot which it actu-lly cost, and the proportionate cost the City pays. The M~nager explained that the letter from which Mr. Baxter quoted was mailed about eight months after the beginning of the development of the project. The~was an error in the figures. The original cost was l~ased on the cost of another lighting system Assessment District, but did not take into consideration the development of the cost figure; the difference between the laying of the conduit in an open trench and the ultfmate cost which increased the costs of boring,which was in error. From the period Canvass Election Returns - "Sullivan and Edinger Annex" Canvass Election Returns - "mst Santa Aha Annex" Ordinance of early Spring, 1956, to the actual development of the project, the project was ~ delayed for a period of some two and one-half years, and durin~ that period of time, the base cost increased 25% plus. The figures were computed on the basis of the origina~ estfm~ted cost. At this point it is ~ossible for the City to make an add- itional contribution of $11,1OO.OO and it would be roughly a lO~ decrease in charge to the abutting property owners. Attorney,Baxter stated he did not know what the original esttm,te was but contended the difference in the cost of the trench and the boring method did not account for a 100% increase and felt a grievous error must have been made in the orig~n~ est~,~te, and felt the City should bear the cost of the difference in the charge. Dr. Mark Lindsey, 1933 South Main Street,stated he signed the petition for the lights and understood the cost would be from $2.30 to $2.80 per front foot. He further stated he had not seen the notice regarding the total cost of the improvements. The Director of Public Works stated the notices had been placed 2' to 3' above the ground every 300' in the area. Mrs. Ethel E. Hooper, 905 South Main Street, owner of property in the 1900 and 2000 blocks South Main Street vigorously objected to the increased assessment and said Main Street is heavily travelled and felt the City and not her property benefited from the improvement; also she saw no evidence of the notices in her area. On motion of Councilman Hubbard, seconded by Hall and carried, the hear~ was declared closed. On motion of Councilman Hubbard, seconded by Hall and carried, the matter was continued until April 6, 1959. This being the date to canvass voters' ballots cast at the "$,llivan and Edinger Annex" and it satisfactorily appears to the City Council of the City of Santa Ana that notice of said Special Municipal Election was duly given and the Election was duly and regularly held on March 10, 1959, according to law. On m~tion of Councilman Hubbard, seconded by Hall and carried, the Clerk was ordered to open the Precinct envelope and proceed with the canvassing of the ballots. There was only one voting precinct established for the purpose of holding said Election, consisting of a con- solidation of the regular election precincts established for holding the last general State and County elections. As a result of the T~lly, the Council determined and the Clerk declared that there were no absentee bat lots voted at said election; that the proposition submitted to the Electors was: .~h~l 1 the territory designated "Sullivan ( YES ) and Edinger Annex" be annexed to the ( ) Cit~ of Santa Ama? ( NO ) and that there were a total of ~11 votes cast at said Election of which number 239 were voted "Yes" and 72 were voted "No". On motion of Councilman Eubbard, seconded by Hall and carried, the following Ordinance entitled: "Ordinance declaring the result of the canvass of the returns of the Election in the territory known as 'Sullivan and Edinger Annex' and approving the annexation of said territory to the City of Santa Aha" was introduced, considered and placed on file for second reading. Warty Tancredi, 1623 French Street, on behalf of the appli- cant, said the other residents of the ar~a should participate in the paving of the alleys and questioned the legality of improving City owned property, and that Mr. Weinberg is wtll ing to make a contribution toward the paving of the alley. The applicant said he believed the alley should be left in its present condition but if the .l~ey has to be improved, the property owners should baud together J~o pay for the improvements. Hazel Proctor Pegler, 611 West Eighth Street, Realtor, stated the City owns the alley and it should be left in its present condition until the other residents assist in paying for the improvements. Heinly Communication was read from the Pl-=ntng Commission recommending approval of Variance Application No. 107~ filed by Goldie and Vaughn O. Glbbens to maintain a rest home for four elderly women (with living ~uarte~s for husband, wife and son) on property situated at 1202 North Townsend Street, in R-1 District, in the existing single family, three-bedroom dwelling on front portion of the lot, for a period not to exceed six months durtng which time the applicant is to make every effort to find new quarters for a rest home or make sufficient arrangements for disposition of the existing rest home. Robert Janickt, lO15 North Townsend Street, on behalf of eight persons, protested against the granting of the Variance and stated the living quarters are inadequate to accommodate seven persons; the residents in the area do not want a zone change in the neighborhood but did not object to the Variance being granted for a six months period only. Mrs. Gibbens said she did not know they were operating illegally as they have a license from the Welfare Department and the premises were inspected by the Fire Department; she has two elderly wom~n in her care at the present time and plans to find other housing within the six months period. On Councilman motion of/Hubbard, seconded by Nall and carried, the recommendation of the Planning Commission was approved and the Variance granted for a period of time not to exceed six months and that it be limited to four elderly persons, (with living quarters for husband, wife and son). Thompson granted to permit construction of an office building (42½ feet on property at ~17 West Eighth Street, by 85 feet in size~/for the use of Otto A. and Robert H. Jacobs, Attorneys, the entire ground floor to be reserved e!m~st exclusively for vehicle parking (nine off-street parking spaces), with the exception of a ~me~l portion at the rear that may, for a time, be rented to the architects, subject to conditions. On motion of Councl!.~n Hubbard, second by Hall and carried, the recommendation of the planning Commission was approved and Variance Application No. 1077 filed by Rom Investment Company granted to permit construction of a two-story, six-unit multiple famtly apartment, with decrease in front setback from the required 60 feet to 45 feet (15 feet from property ll~e)~ on property situated at 1425 East Fruit Street, in R-1 District. C~ication was read from the Pl~nnt~g ~Commission recommending denial of Variance Application No. 1071 filed by James W. and Richard P. Matthews to erect a one-story, two-bedroom house on front part of the lot, on property situated at 1228 West Cul~bon Street, in R-1 District, with attached gate, e; and one duplex (one bedroom sach unit) on rear part of lot, with parking area for two cars and to demolish existing house on the property. The applicant stated he had ample off-street parking and presented photographs of the property. On motion of COunctlm~n Hubbard, seconded by Hall and carried, the recommendation of the Planning Commission was approved and the Variance denied. On motion of Councilman Hubbard, seconded by Hall and carried, the recommendation of the Planning Commission was approved and the request of Louis Struikm-n granted to establish set-back lines on property consisting of approximately ten acres, lo~ated generally at the southeast corner of the proposed Fairview Street and Edinger Street intersection. Communication was presented from the Planning D~partment recommending that the name of Pankey Street be changed to Hunter Avenue, in honor of Ex-Connc~lm~ Orson Eunter and Ex-Clerk of the Council Erma Hunter. The Council having ,,nanimously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Hall and carried, the following Resolution entitled: "Resolution No. 59-57 changing the n~me of Pankey Street ~o Hunter Avenue" was considered and passed by the following vote: Ayes, Counc~!,~n Royal E. On motion of Councilman Hubbard, seconded by H~ll and carried, proper officials were authorized to execute renewal permit with A. E. Fowler and Sons to remove sand £~m the City owned portion of the channel bed of the Santa Aha River, which permit is to be renewed under the same terms and conditions as existing permit. On motion of Councllm~u Hubbard, seconded by Ha~ and carried, the Purchasing Agent was authorized to advertise for bids for Special Valve for M. W. D. Vault at Bristol and Talbert, Specification 67B-2, and t~o four-door se8~s for the Police D~partment, Specification 62~-17; bids to be opened April 6, 1959. The Council having unanimously waived the reading of the Resolution, on motion of Councflman Hubbard, seconded by Hall and carried, the following Resolution entitled: "Resolution No. 59-61 accepting deeds where City is paying no cash consideration" from D & L Homes, Inc. for easement for drainage purposes ten feet wide, between Lots 30 and 31 at the southeast corner of Townley Street and Marty Lane, in Tract No. 2762; from Santa Aha Medical Arts, Inc., for street easement over the southerly 130 twelve feet of property on the north side of Seventeenth Street Immediately east of~ Lincoln Avenue, said easement being ~60.12 feet from east to vest, and from Quentin L. P. Waltz (over-size driveway) Reso. No. 59-62 Initiating proceedings for annexation of terri- tory designated "Delhi and Greenville S.W. Annex" (set hearing date) corner of Delhi Road, subject to the conditions as imposed on Variance No. 995. On motion of Counctlm~n Hubbard, seconded by Hall and carried, the request of R. P. Waitz was granted for a 35-foot driveway at 1211 East First Street. The Council having lmantwaously waived the reading of the Resolution, on motion of Councilman Hubbard, seconded by Hall and carried, the following Resolution entitled: "Resolution No. 59-62 initiating proceedings for the ~nnexation of territory to the City of Santa Aha, designating the name of 'Delhi and Greenville S. W.
