HomeMy WebLinkAbout79-126KLG: ar 7/26/79 RESOLUTION NO. 79-126 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ENCOURAGING LEGISLATION TO ENSURE REASONABLE TIME LIMITS BETWEEN EACH STEP OF THE RECALL PROCESS WHEREAS, the procedures for recall of elected city officials are established by the State Leqislature and set forth in the State Elections Code; and WHEREAS, the Elections Code currently provides elected officials seven (7) days in which to respond to a formally presented Notice of Intention tO Circulate a Recall Petition; and WHEREAS, once such Notice has been responded to by the elected official, the Elections Code does not impose a deadline by which the recall initiator(s) must submit the Notice the Clerk of the Council for certification and approval of the recall petition; and WHEREAS, this omission in the Elections Code has created a situation whereby the recall initiator(s) can prolong the recall process and, thus, cause great harm to elected officials by subjecting their credibility and character to doubt and inhibiting the performance of their duties; and WHEREAS, the lack of a reasonable time limit for submission of the Notice to the Clerk of the Council is an invitation to abuse the recall process. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA, AS FOLLOWS: That this Council hereby requests the League of California Cities to seek leqislation to amend the Elections Code to provide a specific and definite time limit between all of the steps in the recall process; That this resolution be forwarded to the League of California Cities prior to August 9, 1979 for consideration by the General Assembly at their 1979 Annual Conference in San Francisco.
