RESOLUTION NO. 79-135
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA ANA AFFIRMING THE
DECISION OF THE PLANNING COMMISSION
DENYING CONDITIONAL USE PERMIT NO.
79-7 AND DENYING APPEAL NO. 404
WHEREAS, a public hearing was duly held before the
City Council of the City of Santa Aha on August 6, 1979, on
the action taken by the Planning Commission in denying
Conditional Use Permit No. 79-7, which application seeks to
allow construction of forty condominiums at 2701 North
Broadway in the P District;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. That based on such public hearing and the
oral and documentary evidence submitted therein, the City
Council does hereby affirm the action of the Planning
Commission in denying Conditional Use Permit No. 79-7, and
deny Appeal No. 404;
2. That the City Council hereby adopts the
following as its findings of fact for denial of Conditional
Use Permit No. 79-7, that certain "Findings of Fact, Conditional
Use Permit No. 79-7, attached hereto as Exhibit A, and
incorporated by reference herein as though fully set forth.

FINDINGS OF FACT
CONDITIONAL USE PERMIT NO. 79-7
1. The subject site is more appropriate for professional
use than multi-family residential use because its only
access is on to an arterial street with severe rush hour
traffic congestion. Residential development would increase
such traffic congestion more than professional development.
The traffic congestion would be less of an annoyance to
professional use occupants than to residential use occupants.
2. Even though the site may be capable of development as
an apartment complex without the need for discretionary
approval by the City, there is no apparent liklihood of such
development occurring in fact. In any event, the problems
of traffic congestion are even less compatible with condominium
use than with apartment use.
3. The proposed use for condominiums would therefore be
detrimental to the general welfare of persons residing
therein and of persons working in neighboring properties and
it would not contribute to the general well-being of the
neighborhood.
