Each member of the City Council having received copies of the Minutes of March
16 and March 23, 1959, reading of the Minutes was dispensed with and approved
on motion of Councilman Hubbard, seconded by Gould and carried.

fact that the City Council considered the amount of money involved was not justified

Ordering work
The Mayor Announced this is the time and place for hearing protests or objections
against the improvement of Towner Street et al, in Assessment District No. 202, and
asked the Clerk if she was in possession of the affidavit of publication, affidavit
of posting and affidavit of mailing. The Clerk stated she had the affidavits, and
on motion of Councilman Hubbard, seconded by Hall and carried, the affidavits were
received and filed. The Mayor asked the Clerk if she had received any written
protests or objections against the proposed improvement. The Clerk stated she
received a written protest from Paul E. Berry, owner of property at 11~6 South
Shelton Street. On motion of Councilman Gould, seconded by Hubbard and carried,
the protest was received, filed and overruled. On motion of Councilman Gould,
seconded by Hall and carried, the hearing wns declared closed. The Council having
unanimously waived the reading of the Resolution, on motion of Councilman Gould,
seconded by Markel and carried, the following Resolution entitled:
"Resolution No. 59-66 of the City CounCil of the City of Santa Aha
ordering work to be done on Towner Street and other streets in
accordance with Resolutiom of Intention No. 59-45"

This being the date set for hearing and no protests having been received, Amendment
Application No. 268 filed by the Southern California Edison Company was considered
to amend Sectional District Map 14-5-10, Exhibit D, to reclassify from R-1 and R-2
Districts, to C-2 District, property (approximately 305 feet by 285 feet) located
at the southeast corner of the intersection of First and Sullivan Streets. On
motion of Councilm~ Gould, seconded by Hubbard and carried, the following Ordinance
entitled:
"Ordinance amending Article IX of the Santa Aha Municipal Code to
change district classification on Application No. 268 and to amend
Sectional District Map 14-5-10, Exhibit 'D''
was introduced, considered and placed on file for second reading.
On motion of Cou~cilm~ Hubbard, seconded by Gould and carried, Map of Tract No.
3356 filed by Fairview Homes, for the dedication of Fairview Avenue, Lingan Lane,
Adrian Way, Edison Way, D~hl Lane, Wilshire Avenue, Townsend Street, Raitt Street
and alleys for public use; all vehicular access rights on Fairview Avenue and Raitt
Street ~ dedicated to the City of Santa Aha, also Lots 'A' and "B" for drainage
purposes; also sewer easement as designated on map, and bond in the sum of $110,000.00,
were approved, license fee in the sum of $4500.00 accepted and agreement covering
improvements ordered signed.
On motion of Counc~lm~u Hubbard, seconded by Hall and carried, action was continued
until the next meeting on Tentative Map of Tract No. 3374 filed by Herbert amd Zella
M. Salverson and Theo and Nona Y. Lacy, on property located generally between Memory
Lane, Flower Street and the Santa Aha Freeway creating 37 residential lots and one
large site.
On motion of Councilman Hubbard, seconded by Gould and carried, Tentative Map of
Tract No. 2743 filed by Robert G' Risse, owner's representative, creating 28
residential lots located generally at the southeast corner of the intersection of
Hazard Avenue and Newhope Avenue, was approved subject to conditions.

On motion of Councflm~n Hubbard, seconded by Hall and carried, Preliminary Record
of Sur~ey Map filed by Industrial Enterprises, defining a parcel located on the
south side of Chestnut Street approximately 1000 feet east of McClay Street, was
approved subject to conditions.
Nayor Hetn]y dis~lualified himself on the following matter and Vice-Mayor Markel
assumed the Chair. C~cation was read from the Planning Department reference
Preliminary Record of Survey Map filed by Edward Hall dividf=g into two parcels
property located generally between Cedar Street on the west, Standard Avenue on the
east and approximately 400 feet north of St. Andrew Place. Attorney Harold Heinly,
on behalf of Leonard Earl and Mr. Barker, stated Mr. Ball is not the record owner
of all the property concerned and did not understand how Mr. ~1 l could file an
application for a subdivision and not be record title holder of the property involved.
Also, the Preliminary Record of Survey Map should be re-submitted, or, Mr.
should settle this problem with regard to the property he sold to Leonard Earl and
Mr. Barker, and suggested the matter be continued until such time as Messrs. Earl,
Barker and Hall were present. On motion of Councilman Hubbard, seconded by Gould

Ninth and Tenth Streets, was approved subject to conditions.
On motion of ~ouncLlsm~n Hubbard, seconded by Hall and carried, the reco~ndation
of the P],nning Con~nission was approved' and Variance Application No. 1072 filed by
Suburban Builders, Inc., granted to permit erection of a sign, 8 :feet by l0 feet in
size (instead of 8 feet by 12 feet, originally requested), for a period not to
exceed six months, on property situated on the south side of East Seventeenth Street,
between 1720 and 1730, in lt*t District, subject to a condition.
On motion of Councfl,mn Hubbard, seconded by Markel and carried, the recommendation
of the Planning Commission was approved and Variance Application No. 1079 filed by
Ruth M. Hicks granted to permit construction of a two-story, six-unit apartment
house, consisting of two two-bedroom units and four one-bedroom units, the existing
single-

Con~unication was read from the Planning Commission recon~nending approval of Variance
Application No. 1082 filed by Gerald J. Garcia to permit construction of a single-
fsmtly three-bedroom house on rear portion of lot, on property at 1531 West Second
Street, in R-2 Di~trict, subject to conditions. It was moved by Councilman Gould~
seconded by Hubbard and carried, that Variance Application No. 1082 be granted sub-
ject to conditions. It was moved by Councilman Gould and seconded by Markel that
the Variance Application be reconsidered.

It was moved by Councilm-n Gould, seconded by Markel and carried, that a Resolution
be adopted overruling the recommendation of the Planning Commission and the Variance
be granted subject to conditions, and the further condition that the applicant be
required to pave to City standards and specifications that portion of Forest Avenue
whic~ abuts his property. Andrew Conti, representing the applicant, s~ated the

replace the ten square feet of broken sidewalk and construct a driveway in accord-
ance with City standards and specifications but it would not be necessary to pave
the street as it would be a great expense to the applicant. Counc~lm~ Markel
withdrew his second and Councilman Gould withdrew his motion. On motion of
Councilman Markel, seconded by Gould and carried, the matter was continued until
the next regular meeting.
Coemmmication was read from the Planning Commission recnmme, nding approval of
Variance Application No. 1085 filed by Ralph C. Anderson to permit moving of exist-
ing nursery business back 75 feet to comply with dedication of land right-of-way and
widening of Seventeenth Street, and at the same time create off-street parking space
and expand existing building facilities; and to erect a sign, 50 square feet in size,
to lie flat against the building or on top of building, on property situated at
1222 East Seventeenth Street, in R-2 District. The applicant protested the condition
requiring construction of sidewalk but stated he would dedicate the property and
bear the expense of curb and gutter. The Council having unanimously waived the
reading of the Resolution, on motion of Counc1~m~n Gould, seconded by Hubbard and
carried, the following Resolution entitled:
"Resolution No. 59-67 granting Variance on Application No.

Cnmmunication was read from the Planning Commission recoam~nding denial of Variance
Application No. 1078 filed by Carl K. Pearlm~n~ M.D. to enlarge existing medical
building, deleting portions of the yard requirements on the south side of the property
for a distance of 16 feet at the east end of building and 32 feet at west end of
building, on property situated at 1518 North Sycamore Street, in R-3 District.
Attorney Robert Jacobs, on behalf of Mrs. ~m~a Childers, objected to the Variance
as it would be detrimental to his client's building depriving the tenants of
sufficient light in the offices. Attorney Milford W. r~hl, representing the appli-
cant, presented the Council with copies of the plot plan, a letter from Carl D.
Cronin, D.D.S., stating he has no objection to the Variance Application; also, a
letter from Dr. Pearlman advising that the Variance Application to extend his build-
ing on the rear portion of the property is withdrawn and the only portion on which
a Variance is requested is the extension of a small front section. Attorney Milford
W. Dahl explained that Mrs. Childers and Dr. Pearlm~an operate a joint parking lot
and the construction to the rear of the property would eliminate some parking area;
the applicant has a problem so far as storage space is concerned, and this area is
being devoted to professional use. Attorney Robert Jacobs stated Mrs. Childers
constructed her building after Dr. Pear~ma~ the overb-~g of the roof goes up to
about i foot of the property line but adhered to the 5 foot set-back line; does not
believe this application shows grounds for a Variance as there is no hardship upon
the land and it is purely a personal acconm~dation requested by the applicant. On
motion of Colznc~lm~n Hall, seconded by Markel and carried, the reccmm~endation of
the Planning Commission was approved and the Variance denied.

Co~mr~uication was read from the P18nning Co~aission recommending denial of Variance
Application No. 1080 filed by Elmer Buckertto construct a detached garage on rear
portion of the lot, with a two bedroom apartment above, on property situated at 2-108
Orange Avenue, in R-2 District. On motion of Councilman Hubbard, seconded by Gould
and carried, the recc~mendation of the Planning Commission was approved and the
Variance denied.
On motion of CouncJlmsn Hubbard, seconded by Gould and carried, Variance Application
No. 1083 filed by Farmers Underwriters Association to construct a building to be
used for a regional office of the Farmers Insurance Group, the offices to be used
only for a~m~strative purposes, and no sales operations to be conducted therefrom,
except on the supervisory level, on property situated on the east side of Flower
Street between Memory Lane and the Santa Aha Freeway, and petition signed by approx-
~metely 341 persons protesting against the granting of the Variance, were referred
to the Planning Commission for disposition.
On motion of Co~lejlm~n Hubbard, seconded by Hall and carried, action was continued
until the next informa~ afternoon session of the City Council on comm~uication from
the Planning C~_~-~iission advising consideration was given to c~m~Uication from the
Orange County Street Naming Committee regarding street name changes, and the
Commission does not favor changing of First Street to Bolsa Avenue, Seventeenth Street
to Westminster Avenue, but would look more favorably upon the change of McClay Street
and

Bond in the sum of $64,000.00 filed by Fairview Homes for improvements in Tract

Communication was presented from Nick PokraJac, General Contractor, regarding
financial curtailments and harassment at the job site in the concluding weeks of
construction of the Santa Aha College swimming pool and requesting redress of $290.8~.
On motion of Counc!l~en Hubbard, seconded by Gould and carried, a letter was ordered
forwarded to the Santa Aha Board of Education with the statement that the City Council
rejects said claim and feels no legal obligation for payment thereof.
On motion of Councilman Hubbard, seconded by Markel and carried, the communications
from the City of Orange proposing to annex property located between Fat~haven and
LaVeta, ;~est of Esplanade, Annexation No. 106, and property located northeast of
Tustin and Villa Park on the north side of Orange, Annexation No. 107, w~re received,
filed and the Mayor directed to write a letter to the City of Orange objecting to
the proposed annexations Nos. 106 and 107 because it is inconsistent with the
"gentlemen's agreement" betw~mn the City of Santa Ana and the City of Orange.

On motion of c°Unci~ma~ Hubbard, seconded by Gould and carried, proper officials
were authorized to execute agreement dated March 4, 1959, with the County of
Orange for soil surveys and other tests to determine the proper pavement design
on certain projects.
On motion of Councilman Hubbard, seconded by Mm~rkel and carried~ the application
of Orange County Association for Mental Health, for permission to solicit funds
on May 10th and llth, was referred to the Orange County Council of Community
Agencies for recommendation and report.
Communications were read from volunteer firemen of Santa Aha Gardens and volunteer
firemen of Newhope donating to the Santa Ana Fire Departr~nt E. and J. resuscitators
subject to certain conditions. It was moved by Councilman Hubbard, seconded by
Hall and carried, that the M~ager be directed to write letters aceepting.the fire
equipment with thanks.
On motion of Councilman Hubbard~ seconded by Hall and carried, the Purchasing Agent
was authorized to advertise for bids for the construction of two tennis courts in
Memorial Park, Specification No. 6~1-12 and Drawing C-2659, and to sell by
negotiation scrap metal which has accumulated at the Corporation Yard, which has
an estfm~ted value of $250.00; bids to be opened May 4, 1959-
On motion of Councilman Hubbard, seconded by Hall and carried, the communication
from Reverend George J. Busdiecker, Pastor of the St. Peter Evangelical Lutheran
Church, reference proposed Ordinance regarding use of candles in religious
services was received, filed and the Clerk instructed to advise Reverend Busdiecker
there is no proposed Ordinance at the present time regarding the use of candles in
religious services.

of east-west through streets and to take such action as necessary to further the
procurement of the rights-of-way necessary for the extension of Edlnger Street

It was moved by Councilman Hubbard that the unauthorized expenditures of City fund~i
made by Mayor Dale H. Heinly and Councllm-n J. Ogden Markel be affirmed, ratified
and confirmed. Motion lost for lack of a second. It was moved by Councilm~u
Hall, and seconded by Hubbard, that those expenditures which have been ma~e
by the City Council to date be considered properly approved. Councilman Gould
said he felt the matters should be acted upon separately, regardless of the fact
that the matter had been discussed at the inform-] afternoon session and questioned
the Mayor regarding a sum of $600.00, paid in 1957-58, and stated that in the past
three and one-half y~ars trips were made to New York, Portland, Washington, Miami
Beach, Rio de Janeiro and E1 Salvador, in the sum of $5,787.05, and also mentioned
the trips made by Counci]mauMarkel to Washington, D.C. and San Diego, in the amount
of $1,382.00. Counc~]m-n Gould contended that each one of these trips was uot
approved by the Council. Mayor Heialy repeatedly informed Councilman Gould that
the money was appropriated in the Budget. Mayor Heinly made mention of the $200.00
given to Councilman Gould to make the trip to Los Angeles and Councilman GoUld stated
the expenditure was authorized. Councilman Gould attempted to question the City
Manager and was ruled out of order by the Mayor. Councilman GoUld said Mayor
Heinly and Councilman Markel should dis~,al ify themselves since it involved them and
Mayor Heinly informed Councilman Gould there is nothing in the Cbert~ that would
eliminate them from voting. Mayor Heiuly stated the subject had been thoroughly
discussed in the afternoon session and called for a roll call vote.

On motion of Councilman Hubbard, seconded by Gould and carried, the request of
approximately thirteen residents in the 1400 block South Baker Street was ~enied
that a survey be conducted by the Traffic Division to determine parking facilities
for students driving cars to Mater Del High School and that "No School Parking" signs
be placed in the 1400 block of South Baker Street; the Clerk was instructed to advise
the first signer on the petition of Council action. Andrew Bey~r, 1437 South
Baker Street, stated the students from Mater Dei High School park in front of
residances in the area neighboring the school w~en there is adequate parking around
the school, creating a hardship on the residents of the area. It was moved by
Councilm~n Gould, seconded by Hall and carried, that the Mayor be instructed to write
a letter to the Father at the Mater Del High School requesting him to ask the co='
operation of the students to park around the school and not in the neighboring area.
On recommendation of the Department of Public Works and on motion of Councilman
Hubbard, seconded by Hall and carried, the request of the Standard 0il Company was
granted to eliminate two 20-foot approaches and install one approach approximately
80-feet long, .being 'the full length of the property at Tenth and Main Streets.
On motion of Councilm~n Hall, seconded by GOuld and carried, the request of William
D. Greschner Company was granted for two 40-foot driveways and one 20-foot driveway
at the Medical Arts Center, 17th and Lincoln Streets, in accordance with condition
