The Mayor announced this ~s the time and place for the continued hearing of
protests or objections against the assessment for the improvement of St.
Andrew Place and other streets in Assessment District ~1o. 199. The Mayor
stated he had received a letter signed by H. £. Dold, 302 Victoria Street,
Costa Mesa, owner of property described as Lot l0 Block ll Tract 560, in
Assessment District ~o. 199, objecting to the exceedingly high charges for
the work done. On motion of Councilman Hubbard, seconded by Hall and carried,
the communication was received and filed. Abe ~ayor inquired if there was
anyone in the audience who wished to protest; no protests were received, and
it was moved oy Councilman Hall, seconded by Hubbard and carried that the
heari~g be closed. The Council having unanimously waived the reading of the
Resolution, on motion of Council~u Hubbard, seconded by Brewer and carried,

Attorney Charles G. Schlegel, representing The Gallegos Corporation, requested
that his client be allowed to correct Alternate No. 2 from $1,200.00 to
$12,000.00 due to an obvious clerical error in computation~on his ~id for the
construction of the Police FacLlity Ouilding, and to accept the bid as the
lowest and best bid. Mr. Schlegel stated he had previously submitted letters
reco~ending the work of The GaLlegos Corporation, from Harold ~imeno,
Architect; ~. o. Marschner, Construotion Supervisor~ Bureau of Hospitals;
Taylor & Connor, Architects, Pasadena; Everett Parks and Paul Davis,

bid and the next lowest bidder. 'the Clerk swore in ~udy ~. Gallegos. Mr.
Gallegos stated in Alternate No. 2 he was personally responsible for the trans-
posing of a decimal point which read $1,200.00 instead of the intended
$12,000.00. This error was due to the rush and confusion as the firm was
late in getting all the figures together. Mr. Schlegel presented a bid sheet
showing the figures compiled by Mr. Gallegos. He cited the Lemoge Electric
vs County of San Mateo case in which there was no meeting of the minds. Nylin
Hurd stated he was second low bidder and did not feel the bid in question can
be corrected. The Mayor read a letter from Harold Gimeno, and on motion of
Councilman Hubbard, seconded by Hall and carried, the communication was received
and filed. The Mayor inquired if Mr. Gallegos wanted his original bid to
stand. Mr. Schlegel stated that Gallegos did not want to withdraw his bid;
t~re may be a question of declaratory relief and said the City Attorney's
Opinion No. 217 indicated the bid cannot be amended. On motion of Councilman
Gould, seconded by Brewer and carried, the matter was continued until June l,

1959, and The Gallegos orporatlon granted permissiG~ to file a written state-
ment of the law involved.

On recommendation of the Manager and on motion of Councilman Hubbard, seconded
by Brewer and carried, the~id of Gilbert & Stearns, Inc. in the total amount
of $10,756.00 was accepted, and all other bids rejected.
On motion of Councilman Hubbard, seconded by Brewer and carried, Tentative ~ract
Map 3416, filed by Hodges Building Corporation, creating 14 industrial lots
located generally 1000 feet north of McFadden Street on the west side of McClay
Street, was approved, subject to conditions.
On motion of Councilman Hubbard, seconded by Hall and carried, action was
continued to June l, 1959, on Preliminary Record of B~vey filed by H. L.
Dady redefining lot lines and joining property located generally on the east
side of °Ullivan Street between Fairview Avenue (~est McFadden Avenue) and
Monta Vista Avenue.

Communication was read from John H. Siegel, Civil Engineer, on behalf of ~r.

Communication was again read from the Planning Commission recommending denial
of Variance Application No. 1095 filed 0y ~'airview Homes to construct multiple-
family units on property consisting of 30 lots, (Nos. 19 to 48 inclusive,
Tract 3366) situated between ~ingan Lane on the north and Wilshmre avenue on
the south, 15 lots facing west side of Raitt Street and 15 lots facing east
side of Townsend Street, in R-1 Oistrict, in accordance with the Planning
Comm~ssinn's standards, and decrease front yard setbacks from required 60
feet to 50 feet, frcm center l~ne ef street. .ayne Lubke, 1234 South Douglas
Street, requested permission to have the persons opposed to the granting of
the Variance stand, and approximately 50 persons stood, de stated these
multiple-dwellings would create a traffic problem, there is no buffer zo~e,
and the unite wo~ld be entirely surrounded bM homes. R.L. Jacobson,
1033 S. wood Street, stated he had talked with a number of people as to the
use of the vacant land in t~ area, and it was the ur~lerstanding of all that
it would De built to homes. Jim Mac,lin, 1712 ~. Douglas Street, preferred
the area remain single residences~ Ralph Kaiser, 1134 S. Douglas Street,
stated no hardship existed and the Planning Commission voted against this
Variance. There is a personal gain for Fa~rview Homes, and it is a known fact
than when apartments are constructed in a residential area, the valuation of
the property decreases. The type of apartments to be built has not been
indicated to the satisfaction of tne residents, nor the value thereof. C.W.
Hester, 620 Vance Street, representing Fair~iew Ho~nes, stated he wished to
withdraw the Variance Application, and the request was granted.
On motion of Councilman Hubbard, seconded by Hall and carried, the recommen-
dation of the Planning Commission was approved and a ninety-day extension of
time granted on Variance Application No. 1038 filed oy Verlin B. and ~yrtle
E. Anderson to permit construction of concrete dock (40 feet by 22 feet)to
extend into the rear yard requirements; said dock to be used primarily for
loading and unloading of oxygen, acetlylene and other steel cylinder containers,
on property situated at ll7 Opurgeon Street, in C-2 District.

dwelling with single-car garage, as per plot plan, on property situated at

On motion of Councilman Hall, seconded by Brewer and carried, the recommendation

dation of the Planning Co~aission was approved, and Variance Application No.

Communication was read from the Planning Commission reccmmending approval of
Variance Application No. ll05 filed by Ea~mond J. and Dorothy Van Beek to use

and auto wrecking yard, and for retail sales of new and used auto parts; to

On motion of CounciLman Hubbard, seconded by Brewer and carried, the recommen-
dation of the Planning Commission was approved, and Variance Application No.

subdivision sign l0 feet Oy 24 feet in size, with a cut-out, this sign to
advertise and direct traffic into subdivision (Tract 2762) which is at the

Communication was read from the Planning Commission recommending denial of

to use existing two bedroom house as the professional offices of the Penn Mutual
Life Insurance Semi, any and to erect a small professional sign c~ front lazn,
on property situated at 712 North Bristol Street, in R-2 District. ~obert W.
Allen, one of the applicants, submitted a letter from Lydia M. Stauffer~

establish and operate a guest home in existing three bedroom single family
dwelling situated on front part of lot, on property situated at 2314 North
Bristol Street, in k-2 District. Kenneth Williams, 2309 N. Hesperiau, stated
it was a poor location for this type of bnsiness as it is near a school and
in the way of ingress and egress for school chilch'en which would create noise
for elderly patients; there are other locations more suitable for this type of
endeavor and all the residents in the area, with one exception, strongly oppose
the granting of the Variance. Orrison L. Steen, 2218 N. Hesperian, ~len
L~Fton, 1235 ~. Sauta Clara Avenue, and H. "'. Thidinga, 1402 Marion Nay,
appeared in protest. ~liff Collins, 1046 W. 17th Street, on behalf of the

the Variance is granted, and if the Department feels it is an improper loca-

Charles L. Kleppsattel, 1718 "oodland Place, speaking in b~half of approx-
imately 35 parents in the area, stated about two weeks previously the traffic
guard was removed without notice to the school nor the parents at the corner
of Flower and Edinger Streets. The traffic guard had been at this location
for some five years, and it is a four-way stop. There are two other schools
in this area, with a new school under construction. Approximately 1~5 children
from Glenn Martin Grammar School and St. Anne's use this crossing, and approx-
imately 800 to 900 cars per day cross the intersection. A four-way stop is
confusing for a child of gramm~r scho~age. Mrs. Margaret Butler, 1813
Woodland Place, Oob Driscoll, 1521 S. Parton Street, Danny ~ordell, lbo5
'(oodland Place, and George Krock, 1814 S. darnsey Street, requested re-
instatement of the crossing guard. Itwas moved by Councilman Hall, seconded
by Hubbard and carried that the crossing guard be re-instated at this inter-
section to remain until the end of the current school year and the Council
will make a further study of the list of the warrants causing removal of
crossing guards at various locations.

was read from the ~irst Street I~provement association requesting the Council
to make a study to determine whether or not the present one-way streets are now
advantageous and for the best interest of business and the Oity, and requestdno
continuance of this matter for approximately two months, and that business grou?s
and other interested persons be requested to consider the matter and be givem
an opportunity to report their opinions to the Council. ±t was moved by Council-
man Gould aud seconded by Brewer that the matter be referred to ~he City
Manager, and the proper departments, to make a survey and study to determine
whether or not the present one-way streets serve the best interests of business
in the City; and the City Manager instructed to complete this survey within
sixty days. mr. Herbert ~iller stated business has been affected adversely by
the one-way streets; it is growing in the outlying districts but not down-town.
Bill Lowe, co-owner of Hugh J. Lo~e & Son, said the one-way streets was on a
trial ~asis and does not believe one-way streets have ~elped bus~ness in any
way. W. H. Spurgeon, Jr. stated he had objected to the one-way streets orig~n-
ally and a survey should be made of the business men and property owners for
their opmnmo~s on how it affects ~usiness. *. Ogden ~arkel spoke briefly on
behalf of one-way streets. Miles Leach, 2025 W. Tenth Otreet, stated he
had lived in three cities whero there were one-way streets, but believes the
system here is inadequate as set up. It was moved by Councilman Halt, seconded
by Gould and carried, that the motion be a~nded and the matter be immediately
discussed with the Down-A~own Business ~en's association, the FL~st Street
Improvement Association, a representat~ive from the City Council and the
Administrative Staff, and the Retail Division of the Chamber of Co~m~erce
to submit t4eir recommendation regarding one-way streets by June 1,1959.

J. Ogde~ Markel, owner of two lots in Assessment District ~o. 199, stated a
strip l0 feet ~ide and 94 feet deep was paved with asphalt and the assessment
for the work was $h32.76, and he was charged with the overhead of planning,
surveying, etc. which meant overhead expense in excess of 300~ for sidewalks,
c~rbs and the street. The Mayor suggested the matter be referred to the
Department of Public ~orks.
Communication was read from the Planning Commission reco:~mending adoption of
proposed amendment of Master Plan of Streets and Highways. The Oounci~ ha-~ing
