HomeMy WebLinkAbout80-014EJC: adg 12/28/79 RESOLUTION NO. 80-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA PROVIDING FOR THE METHOD OF NOTICE TO PROPERTY OWNERS PURSUANT TO THE MARKS-FORAN RESIDENTIAL REHABILITATION FINANCING ACT OF 1973, AS AMENDED, AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH WHEREAS, by Resolution No. 79-217, the City Council of the City of Santa Ana adopted a comprehensive residential financing program pursuant to the Marks-Foran Residential Rehabilitation Act of 1973, as amended (California Health and Safety Code ~ 37910 et seq.); and WHEREAS, California Health and Safety Code Section 37912 provides that the City Council may determine the method of disseminating information relating to the time and location of a required public hearing, boundaries of the proposed residential rehabilitation area and a general description of the proposed residential rehabilitation program; and WHEREAS, the City Council desires to provide the method of notice as required by said Section 37912 and to make express findings in connection therewith. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. That the approximate cost of providing notice to all real property owners within the proposed residential rehabilitation area at the address shown on the latest assessment roll pursuant to California Health and Safety Code Section 37912(b) (3) (A) is as follows: Printing of Notice ......... $ 450.00 Stuffing Envelopes 435.00 Envelopes (44,420 @'~[6~'~.) 1,740.00 Postage (44,420 @ $.13 ea.) 5,655.00 TOTAL $8,280.00 2. That the approximate cost of providing notice to all real property owners within the proposed residential rehabilitation area by sending such notice in conjunction with water billings, publication, and posting pursuant to California Health and Safety Code Section 37912(b)(3)(B) is as follows: Printing & Folding Notice .. $ 450.00 Stuffing Envelopes ........ 435.00 Publication ................ 620.00 Posting .................... 100.00 TOTAL $---~,605.00 3. That notice provided with the City water billing will reach 35,697 property owners (82%) and 7,830 property renters, as determined from deposits required for water service when requested by non-property owner applicants, (18%), for a total of 43,527 active water billing accounts. RESOLUTION NO. 80-14 PAGE TWO 4. That the latest assessment for the proposed residential rehabilitation area has 44,420 parcel listings. 5. That providing notice of the required public hearing by use of notice mailed with the City wa~er billing, publication of such notice pursuant to California Government Code § 6066, and posting of such notice at the public facilities as herein provided, is hereby found and determined by the City Council to be at lower expense and at least equal to the mailed and distributed notice required by California Health and Safety Code § 37912(b)(3)(A). 6. That the City Manager is hereby authorized to provide notice of the time and place of a public hearing before the City Council, the boundaries of the proposed residential rehabilitation area, a general description of the proposed residential rehabilitation area, and other relevant matters as required by the Marks-Foran Residential Rehabilitation Act of 1973, as amended, in the following manner: a. Mailing of such notice in conjunction with the City's water billing; and b. Publication of such notice pursuant to California Government Code § 6066; and c. Posting of such notice at all City of Santa Ana public facilities, all County of Orange public facilities located within the City of Santa Ana and at all other facilities and places deemed appropriate by the City Manager to reach the greatest number of persons at least two (2) weeks in advance of such public hearing.
