George Barsumian, Jr. et al, regardi~ rAclassification of the proper~y
be corrected to read as follows: "be reclassified from the R-1 to the

change district classifications on Amendment Application No. 280
and to amend Sectional District Map 9-5-10, Exhibit B"
was introduced, considered and placed on file for second reading.
This being the date set for hearing on Amendment Application No. 281, initiated by
Planni~ Commission, amending Sectional District Map 9-5-9, Exhibit C, to reclas-
sify from R-1 District to C-1-PK District, property situated generally on the east
side of Tustin Avenue, between a point 540 feet north of the north line of First
Street and a point 1,571 feet north of the north line of First Street, measured at
a depth of 557 feet east of the east line of TustLu Avenue. Dixon W. Tubbs,
14732 Tustin Avenue, stated that he is partial owner and trustee for other owners
of this property;and in view of the fact that the Freeway is going to take the
property, they are endeavoring to secure land for commercial development in the
area. The hearing was closed. It was moved by Councilman Gould and secomied by

Communication was again read frcm the Planning Commission recommmnding approval of
Variance Application No. 1135, filed by Elite Sal es Corporation, to construct
thirty-six triplexes on thirty-six lots, on property situated between Hobart and
Edinger Streets, ~mmediately west of the James Madison School and Park, subject to
conditions. Attorney Walter H. Steiner, representing applicant, stated all con-
ditions have been clarified, and the Planning Commission has approved the ~ew map

recomnem~ation of the Planning Commission was approved and Variance Application
No. 1135, filed by Elite Sales Corporation, wa~ granted, subject to conditions.
Communication was again read from the Planning Commission recommending den~l of

on behalf of the applicant, stated there are other businesses in this particular
area, such as a service stationj welding shop, grocery store, etc. The building
has been changed into au office building, and if the Variance is gra~ted will have
stored therein only two tractors, two trucksa and no gasoline, and no burning of
oil will be permitted. The applicant has dane considerable work on the yard and
will construct a fence as high as necessary at the back ofthe yard. Also, the
district has a business right across the street, storing eight or ten times more

On motion of Councilman Hubbard, seconded ~y Gould and carried, the recommendation
of the Planning Commission was approved and Variance Application No. ll50, filed by
Robert M. and E. Virginia Holt granted to remove existing garages located on rear
of the lot, on property situated at 721 South Sycamore Street, in the R-3 District,
and to provide off-street parking for the property to the rear fronting on Main
Street, subject to conditions.
On motion of Councilman Hubbard, seconded hy Gould and carried, the recommendation
of the Planning Commission was approved and Variance Application No. 1167, filed by
Delores Medina granted to erect a new home on the rear of the lot, unattached to the
present building, and to occupy sam~ on completion, with a s~milar new home on the
front portion, on property situated at 706 North Fairlawn Street, in R-2 District,
subject to conditions.

the Variance due to the noise, cars and general activity surrounding the garage.
The applicant stated he has a disability ~ich precludes him from securing regular
employment and is attempting to go into business for himself. He presented a peri-
tion signed by 50% of the property owners within 300 feet of the proposed auto re-
pair business at lllll E. Fifth Street, favoring the granting of the Variance. On
motion of Councilman Gould, seconded by Brewer and carried, the petition was re-
ceived and filed. The applicant stated he has no intention of conducting a wrecking
yard, and only mechanical repair work would be done inside the building. The Council

family residential lots and leaving one large paroelfor possible cca~ercial devel-
opment; located generally at the' southwest corner of Bolsa Avenue (First Street)
and Verano Street, subject to conditions. Mr. Savage stated that he would like to
file a Record of Survey, concurrent with survey map showing the area as not a part
of the subdivision, leaving ~mprovements and actual construction as the responsi-
bility of the property ~vners. Objection was made as to conditions 5, 7 and 8, add
he requested deferrment of action until September 21st. On motion of Counc~ lnmn

Communication was read from the Planning Departmout recommending approval of

the norbh side of Brook Street, and 80 feet west of the center line of South
Baker Street, subject to cc~ditions. On motion of Councilman Gould, seconded by
Hubbard and carrie~ the Preliminary Record of Survey Map was approved, filed by

book, print, or other publication in which there are prominently featured, by use
of drawings, cartoons, or photographs any obscene or indecent displs~ of the male
or female figure, andproviding the penalty for the violation thereof. Motion lost
for lack of a second. Cou~lc~lman Brewer moved that an Ordinance be sdopted pro-
hibiting the pcssession~ printing, display, distribution~ offering for sale, or
sale of obscene or indecent printed matter,drawings, cartoons, or photographs.
Motion lost for lack cfa secoud. Councilman Brewer requested that Councilmen Gould
re-submit his Ordinance, changing the age limit from 18 to 24years. After discus-
sion it was moved by Councilm~n Brewer and seconded by Gould that an Ordinance be
adopted prohibiting ultimately for use by children, under the age of 21 years, of
any magazine, book, print~ or other publication in which there are prominently
featured, by use of drawings, cartoons, or photographs an~ obscene or indecent
display of the m~le or female figure, amipr~viding the pemalty for the violation
thereof. Councilman Hubbard stated there is a State law to cover the printing,
distributiom~ or selling of lewd literatare and read Section 311 of the California
Penal Code, and said that if the Council passed an Ordinance in conflict with the
State law, that it may be decla red unconstitutional. Councilma~ Gould stated that
he had discussed this with the Committee, and proceeded to read Section 3il of
the California Penal Code; this is a 8~*ficult field to legislate in, and any
Ordinance to regulate it would be reasonaole. The Ordinance is a step in the
right direction and would be a help. Statements were made by the Mansger, the
Attorney, and several persons in the aulience. Edward J. Allen, Chief of Police,
stated he cannot be in favor of this Ordinance and there should not be any age
limit on indecent literature.

Com~,nication was presented from Arthur R. Hal 1, 1523 Dresser Street, protesting
the adoption of the so-called "Smut Law" ordinance~ and petition si~ed by approxi-
mately 109 members of the Church of Jesus Christ of Latter D~ Saints, requesting
the adoption of an ordinance to prohibit sale of ohseene litera~zre to minors.
On motion of Councilman Hubbard, seconded by Gould and carried, the communica-
tion and petition were received and filed.

The Council having unanimously waived the reading of ~he Resolution, on motion of
Councilman Gould, seconded by Hubbard and carried, the following Resolution entitled:
"Resolution No. 59-244 concerning parking limtts~ions and curb markings
in accordance therewith"
establishing red zones for bus stops and crosswalks c1~ erance on North Main Street
from 18th Street to Santa Clara Avenue, as recommended by the Department of Public
Works, and establishing a green zone at 2201 North Main Street, reference request
of Johnson's Market,was considered and passed by the following vote:

Gu motion of Councilman Gould, seconded by Hubbard and carried, the oral request of
Joseph Long, on behalf of the Santa Ana-Tustin Co~mUnity Chest, to place Red Feather
Flags on the light standards, in the d~vnt~wa area, Septm~ber 4 through November 30,
1959, for the purpose of publicizing the Co,unity Chest Ca~oaign, was granted
for the period of the campaign, and for this year only.

The Council having unanimously waived the reading of the Resolution, on motion of
Councilman Gould, seconded by Hubbard and carried, the following Resolution entitled:
· Resolution No. 59-245 amending sections 2 and 3 of Resolution No.
58-281, and repealing Resolution No. 5114 and all Resolutions
amending said Resolution No. 5114"
