HomeMy WebLinkAbout80-081REL:ms 4/2.8/80 RESOLUTION NO. 80-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA OVERRULING THE ZONING ADMINISTRATOR'S APPROVAL OF MINOR EXCEPTION APPLICATION 80-12 AND DENYING SAID MINOR EXCEPTION APPLICATION. WHEREAS, on May 19 , 1980, a public hearing was duly held before the City Council of the City of Santa Ana on Minor Exception Application 80-12, which seeks to allow the sale of beer and wine in a proposed market within an existing service station, at 3312 West First Street in the C2 District; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as follows: 1. That based on such public hearing and on the oral and documentary evidence submitted therein, the City Council does hereby overrule the Zoning Administrator's approval of Minor Exception Application 80-12 and does hereby deny said Minor Exception Application. 2. That the City Council hereby adopts as its findings of fact for denial of said Minor Exception Application, the following: (a) First Street, between Harbor Boulevard and the Santa Ana River, presently provides two establishments in which alcoholic beverages are sold for off-site consumption and three establishments in which alcoholic beverages are sold for on-site consumption. (b) The public is adequately served by such existing establishments within the area. (c) An over-concentration of establishments selling alcoholic beverages in a limited area is detrimental to development and future occupancy of property in such area to its highest and best use. (d) The addition of another establishment selling beer and wine, as proposed in this minor exception application, is not necessary or desirable, in that it will not provide a service or facility which will contribute to the general wellbeing of the neighborhood or the community. RESOLUTION NO. 80-81 PAGE TWO (e) Such addition of the proposed use for sale of beer and wine to the area would result in an over-concentration of establishments selling alcoholic beverages, and would thus be injurious to property in the rea.
