Each member of the City Council having received copies of the Minutes of September 21, 1959, reading of the Minutes was dispensed with and approved on motion of Councilman Hubbard, seconded by Gould and carried. On motion of Councilman Gould, seconded by Hubbard and carried, the lowest and best bid of E. D. Johnson & Company, in the total amount of $10,285.00, was accepted and the other bids rejected. . This being the date set for hearing on the 1959-60 Budget, the Mayor asked if there were any protests, and Mr. J. Ogden Markel, 1814 So. Patton Street, stated that he felt the Budget provides an opportunity for a decrease in the property tax rate, and as~d the City Council to ccmpr~ise between $1.44 and the $1.40 to lower the tax rate. The hearing was closed. On motion of Councilman Heinly, seconded by Hub- ha~d and carried, the Budget for 1959-60 was adopted. ,, The Council having unanimously waived the reading of the Ordinance, on motion of Councilman NeLly, seconded by Hubbard and carried, the following Ordinance entitled: "Ordinance No. NS-400 adopting the annual Budget for the fiscal year commencing July l, ~959, and fixing the limitations of expenditures for the several funds and the functions, departments and activities carried on under such funds" was considered and passed as an emergency Ordinance by the following vote: Ayes, Councilmen Royal E. On motion of Councilman Gould~ seconded by Brewer and carried, the following Ordinance entitled: "Ordinance establishing street right-of-way lines along portions of Main Street and Walnut Street" was introduced, considered and placed on file for second reading. Mr. Clarence L. Hall, 12351 Westminster Avenue, representing property owner Dr. R. M. Mueller, stated that this property was most southerly and adjacent to Newhope Street, and presented a petition signed by eight other property owners, protesting that portion of the Amendment Application referring to R-2 zoning, and requested that the City Council change the portion shown as proposed R-2 to R-3 zone. On motion of Councilman Gould, seconded by Hubbard and carried, the petition was received and filed. It was moved by Councilman Gould that the Amendment Application be referred bask to the Planning C~ission. Motion withdrawn. Hearing was closed. It was moved by Councilman Gould that an Ordinance be passed to second reading, subject .to the R-3 uses for residential purposes only, without prejudice, to file the application. Flower Street, in the R-2 District. Mr. Roy Felkner, 613 So. Garnsey Street, protested the erection of this apartment house, on this small lot, and made reference to the protest petition signed by eighteen persons and previously presented to the Planning C~mmission. On motion of Councilman Heinly, seceded by Brewer and carried, the recammendation of the Planning Commission was approved, and Variance Application No. 1180 denied. Communication was again read from the Planning Commission recommending approval of Variance Application No. 1181, filed by Helen M. Berrus, to remodel existing duplex to be used as income property, and construct an additional three-unit apartment, consisting of one three-bedroom, one two-bedroom and one one-bedroom unit on property situated north of 1919 S. Evergreen Street, and to include 1911 S. Ever- green Street, in R-1 District. Councilman Gould inquired abcmt the garages facing the street which are sometimes looked upon with scme question. The applicant stated she was informed that a Variance was not required where the garages are concerned, and there is no garage cn the property at the present time; also, would like a small studio apartment above the garage, a~l an area for a playground. Mr. Jo L. Sharar objected to the dedication of a street easement for the fall width of the property a strip of land 42.00 feet wide measured parallel to and northerly of the center line of Eighth Street,the 15-foot rear-yard reduction, and the requirement of street improvem~uts at this time, but agreed to the condition reference the driveway approach. Carrillo, to erect a duplex on parts of property consisting of three lots, on property situated at the northeast corner of Orange Avenue and Adams Street, in R-1 District, was granted, subject to conditions. On motion of Councilman Hubbard, seconded by Brewer and carried, the recommendation of the Planning C~.m~ission was approved, and Variance Application No. 1185, filed by T. J. and E. M. Bowman, to increase number of paying gaests from six to ten, was granted on property situated at 617 Orange Avenue, in R-1 District~ subject to conditions. On motion of Councilman Gould, seconded by Brewer and carried, the recommendation of the Planning Cmmaission was approved, and Variance Application No. 1186, filed by C. Martinez, to waive requirement that two dwellings be attached in the R-2 District, en property situated at 945 West Chestnut Street, was granted, subject to conditions. On motion of Councilman Brewer, seconded by Hubbard and carried, the recommendation of the Planning Commission was approved, and Variance Application No. 1187, filed by S. & E. Meras, to decrease of one foot in required side yard, on property situa- ted at 413 South Bristol Street, in R-2 District, was granted, subject to conditions. Communication was read from the Planning Commission reccmmending approval of Variance Application No. 1189, filed by the Church of Religious Science, to construct an addition to a nonconforming use, on property situated at 307 E. McFadden Street, in R-1 District, subject to conditions. Rev. Craig Carter, 1417 W. 9th Street, protested the replacement of 45 feet of sidewalk on Orange Avenue; that the addition of the room in their own backyard is intended to take care of nursery children and will not increase the capacity of the Church, ~r the present parking facilities. Hall None None Cmmmunication was read from the Planning Ccmm~ission recommending the name of McClay Street, from Delhi Road on the south to its juncture with Grand Avenue on the north, be changed to Grand Avenue, as requested by R. E. Birtcher of Hodges Building Corporation. It was moved by Councilman Hubbard, seconded by Gould and carried, that a Resolution be adopted changing the name of the present McClay Street to Grand Avenue, from the north City Limits to the south City Limits. It was moved by Ceuncil-mn Heinly, seconded by Hubbard and carried, that the original motion be amended and that said change of street name be effective July 1, 1960, and the business houses on said street be so notified. Mr. R. E. Birtcher, of Hodges Build- ing Corooration, stated he owns industrial property on Delhi Road and on Chestnut Street, and is also concerned about the street name change on stationery. Mayor Hall left the Chair. Councilman Hubbard assumed the Chair. Mayor Hall stated he felt the street name of Grand Avenue is satisfactory, and because we have not ex- tended names of other streets, there is no reason why there should be a change in this street name. It was moved by Councilman Gould, seconded by Hubbard and car- ried, that the matter be tabled. It was moved by Councilman Heinly, seconded by Hubbard and carried, that the matter be brought back on the table. The Council having unanimously waived the reading of the Resolution, on motion of Councilman Heinly, seconded by Hubbard and carried, the following Resolution entitled: "Resolution No. 59-267 changing the name of a portion of McClay Street" was considered and passed by the following vote: Ayes, Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, Bob Brewer, A. A. Hall Noes, Councilmen None Absent, Councilmen None ,, Attorney W. J. Clemons, representing Alfred H. and Edna H. Stennett, reference Variance Application No. 1160, to establish an office and a storage yard for heavy equipment on property situated at 14695 South Verano Street, in R-1 District, stated one of the conditions imposed on the Variance was that an agreement be entered into, that the street would be paved and curbs and sidewalks installed. He said that it would be financially impossible to do this and is willing to deed property to the City since there are no curbs or sidewalks in the rest of the area; that if Verano Street is ever widened, it will probably be on a district setup whereby all property owners will be assessed equally. The matter was removed from the Agenda, and it was suggested to Mr. Clemons that he contact the City Attorney as to reconsideration of this matter. Communication was read frmm the Planning Department changing Condition No. 3 on Preliminary Record of Survey, filed by J. C. Axelson, et al, creating three parcels, located general~v on the east side.of Standard AVenue, south of .McFadden Avenue, and subject to conditions. On motion of Councilman Hubbard, and secc~ded by Brewer, ~ Preliminary Record of Survey map was approved and Con- dition No. 3 was changed to read "40 feet from center line of Standard Avenue to property line." Mr. J. W. Reagan, 2027 North Main Street, representing Mr. Axelson, said that two parcels of this property was sold before map was approved~ and since there are now actually three er four owners involved, would it be agree- able with Planning Commission iE item 7 regarddng dedications is made now but improve- ments later as each owner improves his own piece of property, which would be agree- able to the o. ners. Axelson, et al, on behalf of all four property u,~rs, was approved, subject to cc~ditions heretofore recommended, and the one condition which was eliminated, "No. 7," read that all i~provements be made in accord- ance with the design standards and specifications of the City's Subdivision Ordin- ance, and that said improvements shall be made prior to the issuance of any building permit, and the Building Department shall be sc instructed as each lot is individually im proved." ,, Cmmmunicatic~ was read from the Planning Department recommending approval of Prelim- inary Record of Survey, filed by Carl O. Johnson, creating four lots located generally on the north side of Harvard Street, approximately 940 feet west of Greenville Street, subject to conditic~s. Mr. Leo J. Friis, in partnership with Mr. Johnson, stated there is a 230 foot frontage on this lot and there are two dwellin~on this property, both with sanitary facilities. At this time a second house is being relocated with the approval of the Building Departmer~, and objected to installing sidewalks, curbs and gutters, the installation of the sewer and improvement of Harvard Street. On motion of Councilman Heinly, seconded by Hubbard and carried, Preliminary Record of Survey, filed by Carl O. Johnson, was approVed, subject to all cmditions, and proper officials authorized to e~ter into an agreement with Mr. Johnson,that in the event any property owner requests permission to connect onto the sower, they pay their front foot cost.
