HomeMy WebLinkAbout80-089EJC:ar 5/14/80 RESOLUTION NO. 80-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA FIXING AND ESTABLISHING THE COMPENSATION FOR THE OFFICE OF CITY MANAGER OF THE CITY OF SANTA ANA, EFFECTIVE JULY 7, 1980, AND REPEALING RESOLUTIONS INCONSISTENT HEREWITH BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA: 1. That the salary for the office of the City Manager of the City of Santa Ana is hereby fixed and established at Four Thousand Eight Hundred Thirty-three Dollars ($4,833.00) per month. 2. That said salary shall be paid in the same manner and at the same times as other monthly salaries in the city are paid, and shall take effect and be paid from and after July 7, 1980. 3. That the city shall pay to the Public Em- ployees' Retirement System on behalf of said officer an amount equal to five percent (5%) times the compensation upon which such retirement contributions are calculated. Such payments are not an increase in base salary. 4. In addition to the salary hereinabove fixed and established for said office, said officer shall receive, as additional compensation, the following employee benefits: (a) Deferred Compensation Said officer shall receive as deferred compensation an amount equal to one percent (1%) of said officer's monthly salary. The amounts contributed by the city under this provision shall be subject to the terms and conditions of the City of Santa Ana Deferred Compensation Plan, and subject further to the conditions that: i. Said officer shall not have any vested right in the amounts contri- buted by the city until termination of employment with the city; and ii. The city will pay the total amount of contributions plus any earnings thereon to said officer upon termin- ation, resignation, retirement, dis- missal or death. (b) Health Insurance The city will contribute the following amounts toward the payment of the premiums for said officer and dependents, if applicable, under the existing health insurance program (or a new program providing substantially similar coverage and benefits): RESOLUTION NO. 80-89 PAGE TWO i. If the officer aforesaid does not have dependents included under the program, one hundred percent (100%) of the premiums; ii. If the officer aforesaid has dependents included under the program, an amount equal to ninety percent (90%) of the total premium applicable to the "family plan" covering said officer and his or her dependents. (c) Disability Insurance The city shall pay the full premium for a long-term disability insurance plan for said officer. (d) Automobile The city shall provide, at said officer's option, the amount of automobile allowance authorized from time to time by the City Council, or in lieu thereof an automobile for said officer's exclusive use. (e) Housing Expense Said officer shall receive, as additional compensation, the following: i. The city shall provide interim financing for a term not exceeding one (1) year to eliminate double mortgage payments in the event said officer is unable to sell said officer's residence in the State of Maine prior to pur- chasing a residence in Santa Ana. In the event said home is not sold within one (1) year from and after the date of this resolution, the city and said officer shall renegotiate the foregoing provision. ii. The city shall provide financing at an interest rate not exceeding ten percent (10%) such that said officer's total monthly payment for housing, in- cluding principal, interest and taxes, shall not exceed One Thousand Dollars ($1,000.00) per month; provided, how- ever, said officer shall--~--the net equity received from the sale of said officer's residence in Maine toward the downpayment required for a res- idence in Santa Ana; and provided further that the total purchase price o~ a residence does not exceed One Hundred Seventy Thousand Dollars ($170,000.00). Said financing shall include a provision that in the event RESOLUTION NO. 80-89 PAGE THREE the residence or any part thereof, or any interest thereon, is sold, agreed to be sold, conveyed or alienated by said officer, or by operation of law or otherwise, the entire amount of principal and interest shall become immediately due and payable; and in the event said officer resigns or is dismissed from office, or for any other reason vacates such office, the entire amount of principal and interest shall become due and payable within ninety (90) days of resignation, dis- missal or vacation. iii. The city shall provide as addi- tional compensation in the event tem- porary housing is required by said officer, all expenses for such tem- porary housing which exceed the sum of One Thousand Dollars ($1,000.00) per month, provided, however, in no event shall such sum exceed Five Hundred Dollars ($500.00) per month. (f) Movin~ Expense The city shall pay for all reasonable and necessary moving expenses incurred by said officer in relocating from the State of Maine to the City of Santa Ana. (g) Dental Insurance The city will contribute up to a max- imum of Fifteen Dollars Thirty-two Cents ($15.32) per month toward the payment of premiums for dental insurance plans pro- vided by the city for said officer and any eligible dependents. (h) Life Insurance The city will seek to amend the group term life insurance policy it maintains on behalf of its employees in order to provide said officer with term life insurance cover- age in an amount equal to twice said officer's annual rate of salary, provided said officer can provide evidence of insurability if so required. Said life insurance coverage shall include an Accidental Death and Dis- memberment (AD & D) provision. The city will pay any reasonable additional premium cost to provide such life insurance coverage at no cost to said officer. In the event said officer is deter- mined to be ineligible for life insurance coverage in an amount equal to twice the annual rate of salary, the city will attempt to provide as much additional coverage above existing amounts as may be obtained without said officer having to provide evidence of insurability, but in no case shall the amount of coverage be less than the existing $20,000.00 AD & D coverage. RESOLUTION NO. 80-89 PAGE FOUR (i) Carry Over Benefits In addition to the benefits specified in subparagraphs (a) through (h) herein- above, said officer shall receive any and all benefits accorded unrepresented execu- tive management employees of the city who are miscellaneous members of the Public Employees' Retirement System (PERS). (j) Retirement In order to assure that said officer shall continue in a vested retirement system, the following retirement plan will apply provided said officer and the city enter an agreement to implement such plan: i. The city and said officer will contribute to the Public Employees' Retirement System (PERS) or any successor retirement system the amount required by law to be paid by the city and said officer. ii. The city will pay to the Inter- national City Manager's Association ("ICMA") an amount equal to the city's contribution to PERS on behalf of said officer. iii. If and when said officer has been credited with five (5) year's service by PERS while in the employ- ment of city, the total amount of the contributions by city to ICMA shall be repaid to city by said officer in a manner to be determined at the end of such five (5) year period. 5. Resolution No. 79-163 of this Council, adopted September 17, 1979, and any and all other resolutions of this Council inconsistent herewith, are hereby repealed.
